Re: Foreclosure Crisis

Dear Ms. Epstein:

I have received and reviewed your e-mails of April 27 and April 30, 2010. I must
respectfully reject your request for a meeting.

As Chief Judge, I am responsible for the administration of the courts here in the Fifteenth
Circuit. The courts are not an investigative body. We do not investigate allegations of fraud
because, ultimately, those matters may be brought to the courts for legal determinations to be
made on the merits.

The courts must remain independent and impartial. lf a court were to conduct its own
investigation, thereafter, it would be impossible for the court to impartially try either a civil
complaint or a criminal charge that arose from or was in any way involved with that
investigation.

Your April 27 e-mail indicates that you have reported your findings to Florida Office of
the Attorney General and to the U.S. Department of Justice. lt is those entities that would be
responsible for investigating and, ultimately, determining whether or not to bring criminal
charges or a civil action. Therefore, if you believe a fraud is being perpetrated upon the courts,
you should continue to provide support for your claim to those agencies.

I note that you make reference to your efforts towards the defeat of the non-judicial
foreclosure bills. As an aside, I can tell you that the Circuit Judges' Conference and the iudicial
Branch also opposed those bills. The courl's goal remains to fairly resolve the legal disputes
between the parties that come before it and we will continue to make our best efforts to do so.
However, we cannot both investigate allegations and, thereafter, impartially preside over legal
proceedings based upon them. Of course, relevant evidence of fraud in a specific case may
always be presented in a court proceeding on a case-by-case basis.
