APPEAL FOR A RELEASE OF WRIT OF MANDAMUS

WHEREAS, the BSN – 4th year students have barred of taking the December 2010 Nursing Licensure
Examination as ordered by Dean Melinda Gablan.

WHEREAS, we have taken the screening examination in July 2010 but did not meet the criteria of
getting the minimum standard and are advised of taking the Examination in December 2010.

WHEREAS, we are aware that every Nursing School has to meet certain Standard by attaining high
standard of results of NLE every succeeding years as a CHED and BON agreed.

WHEREAS, we believe that every student has the right to take the examination anytime he wants ,
and schools are there to counsel, but has no right to stop the liberty to choose and decide.

WHEREAS, we have waited for four months to release our T.O.R. as part of the requirements in
taking the NLE as articulated in RA 9173

WHEREAS, After several months of waiting in July 2010 for the release of T.O.R. ,the School
Administrator has advised us to take another Pre-Board Examination before releasing the T.O.R.

However, after the result released the School Administrator has issued a Restraining Order for the
release of T.O.R. This has delayed our intention and vision for our future as productive Nurses. We
are also aware on the Article III Section I of the Philippines Constitution as stated
“No Person shall be deprived of life, liberty and property without the due process of law,”

Henceforth, the Bills of Rights has defined Liberty (SC2006 “the right to contract, the right to
choose one’s employment , the right to labor and the right of locomotion (Rubi vs. Provincial
Board,39 Phil.660) vis-à-vis, no statistical basis has strengthen the facts of relationship between
preboard and NLE.

WHEREAS, we believe that the positive results are gained by changing the system of faculty and
curriculum from First Year.

Now, therefore, We the 4th year students of Batch 2010 has using the virtue of appeal and liberty
vested by the Philippine Constitution to request and to appeal to the proper authority a release of
writ of mandamus to release de jure document (Transcript of Record).

We humbly asked the proper authority to release our documents for the following grounds of
arguments.
