1. REQUEST FOR INTERLOCOTORY REVIEW
‘The decision of the Middlesex Probate and Family Court on the motion to correct the record and obtain an
‘evidentiary hearing is being appealed from is interiocotory and appealable under G.L.c. 231, sec. 118.
1 STATEMENT OF THE ISSUES.
On March 11, 2005, the petitioner received a certified copy ofthe official docket entries for docket number
99P S181.
‘On April 1, 2005, the petitioner filed a motion to correct the record and obtain an evidentiary hearing, Said
motion was scheduled to be heard on April 29, 2005 before Justice McSweeny. Furthmore the petitioner
requested certified copies of several hearing transcripts heard before the Middlesex Probate and Family.
Court.
“too busy" to correct the record. Petitioner responded that this does not give the Court the authority to
ignore the petitioner's due process right’.
Furthermore, a recent investigation by channel 4 news, Joe Berginatin found Judges arriving late and
leaving early. Which raises the issue ofthe Courts responsibilities and how it has effected the petitioner's
legal rights by a practice and parter of Judicial misconduct
The Middlesex Probate and Family Court has aegeleted to preserve the records in tis said case. The
Plaintiff attempted to correct the record and obtain an evidentiary hearing. Said motion was denied on April
29, 2005 ( MeSweeny, J.), Justice McSweeny, stated "inasmuch as the matter should be brought tothe
attention of the Register of Probate as "Keeper of the Records’
‘On May 5, 2005, the petitioner faxed Register Bunomo a request to schedule a meeting and to correct the
