Hitch, City Attorney RE: CITY ATTORNEY REPORT DATE: January 7, 2011 ‘The following is my report to the City Council on several issues in which our office has been engaged since the last Council meeting: 1. Qwens-Brockway. Ihave received information that subject to the review of client sereening protocol (otherwise known as a Chinese wall), that Owens-Brockway will waive its conflict of interest so that I may continue to represent the City in the Owens-Brockway tax appeal, presently before the Michigan Tax Tribunal, and will represent the City in the matter relating to the revocation of the industrial facilities certificate. Iam in the process of drawing up waiver letters and establishing the protocol to assure that confidential information of the City is not viewed by my partner, Bill Hlousefield, who represents Owens-fllinois/Owens-Brockway in workers” compensation ‘matters, and likewise, establishing procedures so that I will have no access to any of the Owens- Tilinois/Owens-Brockway files. 2. Jewelry Sales. Pursuant to discussions with Chief Callahan, I prepared a memo and advised him regarding the secondhand jewelry sale that is to take place at the Senior Center for several days starting on January 18, 2011, TMHiddy
