UNITED STATES CO URT O F APPEALS

FO R TH E TENTH CIRCUIT

Clerk of Court

In re:

CA RR IE M ARIE N EIGHBO RS, No. 10-3251

M ovant.

OR DER

Before KELLY, O’BRIEN, and HO LM ES , Circuit Judges.

Carrie Neighbors has filed a motion for leave to file a second or successive

28 U .S.C . § 2255 motion to vacate, set aside or correct her sentence. On

September 22, 2010, M s. Neighbors was convicted of wire fraud, mail fraud, and

money laundering. She has not yet been sentenced and has not previously filed a

§ 2255 motion. Because she has not previously filed a § 2255 motion, she does

not need authorization from this court to file her first § 2255 motion (we do note,

however, that any § 2255 motion challenging M s. Neighbors’ sentence would be

prem ature at this point since she has not yet been sentenced). Accordingly, w e

DISM ISS as unnecessary M s. Neighbors’ motion for authorization.

Entered for the Court,

ELISABETH A. SHUM AKER, Clerk
