AFFIDAVIT

I, James A. Taylor, declare as follows:

have been employed as an officer with the Memphis Police

I
Department since 1993. I have been assigned to the Organized

Crime Unit since 1997, and I am currently a sergeant. I have

also been designated as a Drug Enforcement Administration ("DEA")

Task Force Officer ("TFO") since 2000.

have been involved in numerous narcotic investigations

I
including undercover operations and the investigations of
methamphetamine drug trafficking. Based upon my personal
participation in this investigation, and information provided to
me by other law enforcement officers, I am familiar with the
facts and circumstances referred to in this affidavit. On the
basis of that familiarity, I have determined the following:1

On May 12, 2006, Shelby County Detective R. Jewel obtained a

state arrest warrant for Justin Davis for possession of
methamphetamine with intent to distribute and (6) six other
felony State drug charges in violation of 39—17—417, Tennessee
Code Annotated. On May 18, 2006, Detective Jewel received
information that Justin Davis was at the residence at 5178 Rich
Road in Memphis, Tennessee. Shelby County Assessor's records
show that Marcello Arsura is the owner of this residence.

On May 18, 2006, Detective Jewel along with Detective

Simonson, Lt. Nelson, Ptl. Trippett and Ptl. Edwards traveled to
5178 Rich Road to arrest Justin Davis on State drug charges.

After arriving at this location, several deputies went up to

the door. The door was open, and deputies could observe a person
inside the residence. Deputies announced several times that were
with the Sheriff's Office, but no one would come to the open
door. Deputies entered the residence and located Marcello Arsura
in the back bedroom of the residence and observed in plain
view
one plastic baggy of methamphetamine on a table inside the room.

Marcello Arsura became combative with the Deputies, and he

was restrained. During the confrontation Lt. Nelson was injured.
The Detectives secured the residence until a search warrant
could
be obtained.

This affidavit is a summary of pertinent information and

does not contain every fact concerning this investigation known
to me.
