SUPPLEMENTAL AFFIDAVIT-COMPLAINT

I, PATRIA GLORIA A. INOCENCIO-ORTEGA, D.V.M., R.N. MAN Filipino, of legal age, with address at c/o Roque & Butuyan Law Offices, 1904, Antel Corporate Center, 121 Valero Street, Salcedo Village, Makati, Metro-Manila, AFTER TAKING OATH, states as follows:

I. I am the lawfully" wedded spouse of the late Gerardo Valeriano Ortega D.V.M. a.k.a. "Doc Gerry", whom I married on April 9, 1988 at a church wedding in Bulacan. A copy of my marriage contract is attached hereto as Annex "A" and made an integral part here:?f;

2. I begot five legitimate children with Doc Gerry, to wit:

Attached hereto are copies of the Birth Certificates of our children marked as Annexes "B" to "B-4".

3. Doc. Gerry and I are veterinarians practicing our profession aside from the fact that we became environmental activists in Palawan;

4. In 2001" Doc. Gerry run and won as provincial board of Palawan during which time and in the course of his tenure, Doc. Gerry had. access to information and docunrents about the-widespread corruption in the provincial government of Palawan and whereby he became the fiscalizer and foremost critic of then Governor Mario Joel T. Reyes (or .Joel T. Reyes hereafter);

5. In 2004, .Doc Gerry run for governor against, among others, then Governor Joel T. Reyes under the platform of good governance and anti-corruption but lost to the latter;

6. After his loss, Doc. Gerry and I wanted to leave the country thinking that the political and economic situation in the country has become hopeless and we 'thus took up nursing thinking that this would be our alterriativ.. professions when we leave for and work abroad;

7. Fortunately, sometime in the second half of 200i, Doc. Gerry was

contacted by ABS-CBN Foundation as project director of Bantay Kalikasan- Palawan -. .Thereafter and up to the time of his murder on 24 January 2011, he became an anchor/commentator in various radio stations in Palawan which served as his vehicle __ __in his Palawan-wide anti-corruption campaign and environmental activism, especially with respect to the environmentally disastrous mining operations;

8~-In ·---his anti-corruption campaign involving the provincial government of Palawan, it was then Governor Joel T. Reyes who was the principal target of his criticisms. In particular, Doc. Gerry riled at Gov. Reyes and the provincial government of Palawan and then President Gloria Macapagal Arroyo as well for the unconstitutional] illegal and anomalous arrangement with respect to the Malampaya Funds;

9. Added to such anomalous "sharing agreement" is the fact that the fund has not been properly audited and it was just recently, sometime in 2009 to early 2010, that the Commission on Audit ("COA") conducted a Special Audit of the said funds given to the provincial government of Palawan;

10. And despite repeated follow ups in 2010 by Doc. Gerry and

his group for the eOA to release the Special Audit Report, the eGA has not given any indication that the audit has already been completed or that a report has already been completed;

11. This has been one of the issues that had borne the brunt of

the criticisms of Doc. Gerry and naturally, since it was former Governor Joel T. Reyes who presided over the m.anagemen t and disbursement of the funds during his incumbency as governor from 2003 to 2010, Governor Reyes had been the object of such criticisms and com~~;ntaries;

12. Aside from the Malampaya Funds, during his term as

governor of Palawan from 2001 upto 2010 and even before that when he succeeded Governor Socrates when the latter died in a plane crash in 2000, Governor Reyes was also the chairman of the Palawan Council for Sustainable Development (PCSD) whereby the latter is instrumental in the approval of the awards for mining concessions within the province of Palawan;

13. The Philippiriea'oand Palawan's environmentally disastrous

experience with ITlini~':l;:g; operations moved Doc. Gerry and our group to oppose mining operations in our province and the grant of such concessions to mining companies and operators;-- ---

14. Besides, Doc. Gerry and our group realized and are of the

opinion that if only the province's lawful share in the Malampaya

._Funds· or royalties woulo' be given to the province, such funds would suffice for the devr-lopmental and social services needs of the province and there WOLl ldbe no need for the province to attract mining operators just so ma.ke money for its requirements;

15. After the elections of 2010, and despite the fact that Mr. Joel

T. Reyes lost in the congressional race for the province's secorid district, Mr. Reyes and some other losing politicians of the province, were again appointed as members of the PCSD thereby prompting Doc. Gerry and his group to hurl criticisms regarding his unlawful appointment and Mr. Reyes' apparent effort to retain his influence in PCSD that presides over the mining concerns and approval of mining applications in the province;

16. These twin issues on mining and corruption in Palawan, as

has always been the case, were the two most prominent and burning issues concerning Palawan, and Doc. Gerry's commentaries andccriticisms on these issues contributed to the loss of Mr. Joel T. Reyes in his bid to be elected as a Member of the House of Representatives for the 2nd District of Palawan;

17. In December 2010, after the PCSD gave approval to large

scale mining in the province, Doc. Gerry and his group, together with Bantay Kalikasan of Ms. Gina Lopez, decided to launch a campaign against the said decision and mining in general;

18. On 23 January 2011, Doc. Gerry, his group and Bantay

Kalikasan, launch' the Ten Million Signatures Campaign against and for the banning of mining operations in the province of Palawan;

19. On 24 January 2011, after his radio program and before he

was due to leave for Manila for the kick-off of the Ten Million Signatures Campaign, Doc. Gerry, my beloved husband and loving father to our kids, was shot dead inside an "Ukay-Ukay" store in the National Highway, Barangay San Pedro, Puerto Prin..cesa__City,

20. On that day, at about ten o'clock in the morning, one of our

neighbors at the Veterinary Clinic frantically called me saying, "Doc Patty, si Doc Gerry riabar'il!" I immediately rushed to the Ukau-ukau store where my husband had reportedly been shot. At that time, I was praying that the shooting was not fatal and that my husband would survive.

21. However, when I saw my husband's body, I knew that he

would not survive. I saw that there was was blood leaking out of his forehead and nose, and t.hexe was a lot of blood already staining the floor. I asked them to cover his body with a blanket as there were already a lot of bystander's gawking at the scene. I held his hand over the blanket and silen tly prayed, asking Gerry what he wanted me to do.

22. Soon after, some of our friends arrived, as well as my second

daughter, Erika. I was in shock at the time, and let our friends take over dealing with the authorities as well as preparations for the interment. Later, I was informed l hat the gunman who had shot my husband had been captured I responded to this by repeatedly saying thatthey should not hl,lrt the killer as I was sure that the killer was only' ordered to do it. I wanted to make sure that

whoever ordered my husband killed would be brought to justice and the killer could be the person most likely to identify the mastermind.

23. I was later informed that the shooter's name is Marlon

Ricamata and that another suspect by the 'name of Dennis Aranas, the alleged look out, was also arrested.

24. A few days after the murder, I learned that the gun used to

kill my husband was registered to Atty. Romeo Seratubias, who was provincial administrator during the term of then Governor Joel T. Reyes. On the same day, I was also informed that a certain Arturo "Nonoy" Regalado had surrendered to' the Philippine

---National Police (IIPNP") or the National Bureau of Investigation ("NBI"), claiming that he purchased the gun used to kill my husband from Atty. Seratubias.

25. I was also later informed that another member of the group

suspected of killing my husband, a certain Valentin Lesias had also surrendered to the PNP. Afterwards, I was informed that a per son claiming to be the link between the mastermind of the murder and the gunmen, a certain Rodolfo Edrad, alias "Bumar," had also already surrendered to the NBI. I discovered that Edrad is one of former Governor Reyes's close-in security guards, and had a] so been a security aide of former Marinduque Governor Jose T. Carreon. It came as no surprise to me that Edrad pointed to the involvement of former Governor joel T. Reyes as the mastermind of the murder of my husband and of Coron Mayor Mario T. Reyes, Jr. as having given money to Edrad after the murder was committed.

26. On the basis of the foregoing and of the affidavits of Arturo

Regalado, Rodolfo EClrad and Armando Noel (A copy of which is attached hereto as Annexes "C", "D" and "E", respectively) and of the report of the police and NBT investigation of the crime, in order to initiate the proper criminal proceedings for Murder against the perpetrators, mastermind/ s and all persons involved who conspired to the murder of my husband, Doc. Gerry, including but not limited to the following:

a) Former Palawan Governor Joel T. Reyes who may be served subpoen a at any of the following addresses: 1) No. 1363 Caballero Stree(\ Dasmarinas Village, Makati City; 2) Brgy. Tigunan, Aborlan Palawan; 3) Ma. Cristina or Ma. Theresa Street, Ayala Alabang Village] Muntinlupa City;

b) Former Marinduque Governor Jose T. Carreon with address at No. 11 Rome Street, Merville Park Subdivision, Paranaque City;'

c) Former Provincial Administrator of Palawan Atty. Romeo Sero rubiaa with address at Brgy. San Manuel, Puerto Prj ncesa City, Palawan;

d) Cc iro n, Palawan Mayor Mario T. Reyes, Jr. with address at

Caron, Palawan or Ayala Alabang Village, Muntinlupa City;
