Sealed tenders on percentage basis in B-1 Form are invited by the under-signed for the work mentioned below from eligible contractors & will be received in sealed covers addressed to "The Chief Engineer(HQ), MIDC, Mahakali Caves Road, Andheri (E), Mumbai-93 or The Suptd Engineer(MMR), MIDC, Dombivli (E) or The Executive Engineer, MIDC, Dombivli Division, Dombivli (E)" duly superscribed with the name of work. The DD for EMD & separate DD for the cost of blank tender of Natl/Schd Bank shall be drawn in favour of the Executive Engineer, MIDC, Dombivli Divn, Dombivli & enclosed in Envelope No.1 without which no tender will be opened. An undertaking in the Declaration Form provided in the tender, must be signed by the contractor (to declare that no MIDC staff is enrolled as employee in the company). Otherwise tender will be summarily rejected. The tenders shall be received in two envelopes. 1st Envelope shall contain DD for EMD/EMD exemption certificate issued by MIDC, DD for cost of blank tender, qualification documents as specified in the tender, "Reply to Queries of contractors" duly downloaded from MIDC website & completed as specified in the tender & a covering letter and 2nd Envelope containing price bid in B-1 form duly downloaded from MIDC website & completed as specified in the tender. The sealed tenders should be submitted either by RPAD/reputed courier service/hand delivery only. No tender will be accepted beyond the date & time given below:

All original certificates will have to be shown in the office of the Executive Engineer, MIDC, Dombivli Division with certified xerox copies of the original certificates for verification as & when required. The xerox copies will be retained in the office and original certificates will be returned immediately after verification.

Valid registration certificates in proper class will have to be produced (Class of registration: Class III & above with PWD, Maharashtra or in appropriate class with MES/Railways/CPWD/CIDCO/MJP) will have to be produced.
The information furnished must be sufficient to show that the applicant is capable in all respects to successfully complete the envisaged work.

The applicant is expected to have visited the project site before submitting post-qualification form. The conditional applications will not be treated as valid applications. Right to reject any or all post-qualification applications of tenderers without assigning any reason thereof is reserved. Joint Venture or Association (of maximum 2 firms) will be allowed. It should be noted that an agency shall be allowed to quote either individually or in associations. Joint Venture shall be allowed only for plant & machinery & consent letter of JV/Association should be submitted along with PQ. A MOU must be submitted along with PQ form on stamp paper of Rs.100/-. Each Joint Venture partner are requested to give an undertaking on stamp paper of Rs.100/- stating that he will make him as a Joint Venture partner along with main contractor firm M/s._________ only for this work & further he can not make a joint venture partner with other contractor/firm for this work. The main contractor shall furnish the joint venture constituting agreement along with other joint venture partner on Rs.100/- stamp paper along with PQ form only. The joint venture is allowed only for fulfilling technical & experience criteria. It is obligatory that the main contractor in the joint venture gets post-qualified individually for financial criterias as per the norms of MIDC.

Audited (& certified by CA) financial reports, balance sheets, profit & loss account statements etc should be produced for last 3 financial years. Post qualification form & tender form duly filled in by the contractor should be submitted in the office of the Superintending Engineer(MMR), Dombivli or CE(HQ)s office, MIDC, Mahakali Caves Road, Andheri (E), Mumbai-93 on or before the date mentioned in the tender notice.

The information furnished in any other format will not be accepted except Annexures as mentioned under relevant clauses. It shall be noted that, if any information furnished in PQ form or the enclosures/ annexures thereto, is subsequently found to be false/ misleading, severe action against the applicant will be taken by MIDC.

Form General 1.2 CONDITIONS FOR POST-QUALIFICATION

The contractor/firm should have executed a single work of similar nature having following disciplines, of atleast magnitude mentioned below in cost & quantity satisfactorily. The work completion certificate should be produced in the format given in Form E. Disciplines Details MS Pipeline The contractor should have executed single similar type of work work costing not less than Rs.92 Lakhs. The maximum of annual turnover in one of the preceding 3 financial years should not be less than Rs.244 Lakhs. The contractor/firm should own the following machinery/plant in good working condition. (The details should be produced in the format given as Form-A). The machinery taken on lease agreement basis will not be entertained. S. DIRECTIONS FOR FILLING THE POST QUALIFICATION FORM (PQ Form) 1. The contractor should fill-up the blanks of the PQ form downloaded from MIDCs website. The duly filled & signed PQ form along with required documents shall only be submitted along with tender as stipulated in NIT. Each & every page of PQ form shall be signed by the contractor, without which the contractor shall not be post qualified. The information submitted on contractors format ie. other than downloaded PQ form, shall not be accepted & rejected outright. In case of joint venture, each member of joint venture shall submit the Financial Statement F separately & one of the partners (main partner) should individually meet the minimum requirements of financial indicators as mentioned in the PQ form. No changes should be made in the script of the PQ form by the tenderer. If any changes are found to be done on the downloaded document, then the contractor shall not be qualified for the work & his tender shall be rejected outright. The tenderer who fulfills the post-qualification criteria shall only submit the post-qualification form along with tender as stipulated in the NIT otherwise his post-qualification form & tender form shall be rejected outright. In any case, subletting of work will not be allowed. For every year, 10% increase in cost shall be considered from the date of completion of work under E Form (for which experience certificate is produced) upto the date of submission of PQ form & tender. The terms & conditions of the PQ form shall be part & parcel of the tender document. Joint Venture is allowed as per the stipulated conditions.

Important Note: (to be read & signed by the contractor). The contractor shall not be declared qualified unless he produces the required documents & information & fulfills the required criteria as listed below: Certified true copy of valid registration as per clause under appropriate class is not enclosed. The contractor or Joint Venture partner contractors must be registered with appropriate authorities as mentioned under tender notice. The annual turnover of the contractor is less than as stipulated under Clause 6 of Form General 1.3. Certified true copy of valid registration under Maharashtra VAT Act-2002 as per Clause 7(a) & (b) of Form General 1.3 is not enclosed. Does not own the machineries owned as required for the works & has not produced sufficient proof as per Form-A in support of machinery owned by him. The rent agreement for hiring machinery shall not be accepted. (Joint Venture for machinery is allowed as mentioned in PQ Form). Insufficient staff & does not produce the information in Form-B. If the list of works of similar nature in Form-C is not furnished.(The list of one/two works which satisfies the norms of similar nature of work shall only be given for which he should produce experience certificate in Form E). Work done certificate for similar nature of work is not submitted as per Form E. (Only one/two certificates for the works which he claims to be the best & satisfying the required norms shall only be submitted). If the list of works tendered for & in hand as per Form D showing cost of balance work is not furnished. If the actions as stipulated under Clause 3(a), 3(b) & 3(c) of tender are taken & the work is rescinded due to poor performance of contractor.

If the compensation is recovered for slow progress or bad quality of work, the contractor shall not be qualified. If the financial statement in Form-F required as per Clause 15 of Form General 1.3 duly signed by the Chartered Accountant is not furnished. If the bid capacity is found less than cost put to tender. The financial indices for any one of the 3 years are not meeting (Sr No.14, 15 to 17 of PQ form) If the information as stated above is found incorrect or misleading. The information submitted is not readable & certificates are not attested by Gazetted Officer. The PQ form submitted is incomplete & every page of PQ form is not signed. Information is not furnished in the PQ form downloaded from MIDCs website & any other PQ form is used by contractor.

Maximum two contractors can make the joint venture for execution of work, if contractor desires to form a joint venture firm. Joint venture agreement shall be notarized at the time of submission of PQ form without which the contractor shall not be qualified. The contractor shall supply copy of registered JV partnership deed at the time of execution of agreement, without which agreement shall not be executed. Joint venture firm is as whole & not as individual partners. Joint venture firm shall be allowed in respect of work experience & machinery only & no benefit can be availed for financial status. Financial norms shall have to be satisfied by one of the partners (main partner) of JV firm in respect of bid capacity, turnover & other financial indices. Joint venture partners which are associated, should have executed the specific work as mentioned under Sr.No.9 of PQ form & they should fulfill the financial indices, for the magnitude mentioned. In case of joint venture, machineries owned by each partner can be clubbed together to comply norms of machineries. The PQ form shall be accepted in the name of joint venture firm only. In case of joint venture firm, the partner who fulfills the financial norms, should fill up the PQ form & all the partners shall have to produce the relevant documents as required & mentioned in PQ form. When contractors submits the PQ form & tender in the individual capacity satisfying the required norms & the same contractor submits the PQ form & tender as a joint venture partner, in such case the PQ form in individual capacity shall only be accepted. The PQ form & tender submitted in the Joint Venture capacity shall be rejected outright. All joint venture partners shall be fully responsible for the satisfactory completion of work.
