UNOPPOSED MOTION TO PLACE APPEAL IN ABEYANCE PENDING RESOLUTION OF UNITED STATES V. ALVAREZ The defendant, Aaron Lawless, by and through his attorneys, James Wyda, Federal Public Defender, and Lauren E. Case, Staff Attorney, hereby requests this Honorable Court to place this case in abeyance pending the resolution of United States v. Alvarez. As grounds for the motion, undersigned counsel states the following: 1. Currently pending before this Court is the Governments appeal of Magistrate Judge
DiGirolamos opinion finding that 18 U.S.C. 704(b), the Stolen Valor Act, is unconstitutional. 2. The Supreme Court recently granted certiorari on the very issue presented in this
case. See United States v. Alvarez, ____ S.Ct. ___, 2011 WL 3626544 (Oct. 17, 2011). 3. In the interest of judicial economy, Mr. Lawless proposes holding this case in
abeyance pending resolution of the Supreme Courts decision in Alvarez. 4. Counsel for Mr. Lawless will promptly notify this Court when the Supreme Court
decides Alvarez. 5. Assistant United States Attorney, Hollis R. Weisman, has no objection to this request.
