‘The undersigned affant, being duly sworn, deposes and says
1.1, the undersigned affiant, Officer David Godwin #3332, being duly sworn, does depose, and state
that | am a member of the Middletown Police Department and have been since November 09, 1994.
This affiant is assigned to the Traffic Unit, and has received training from the Institute of Police
Technology and Management in: At-Scene Traffic Homicide Investigation, and Traffic Crash
Reconstruction, among others. | am also an accredited Traffic Accident Reconstructionist through the
Accreditation Commission for Traffic Accident Reconstruction. At all times mentioned herein, | was
acting as a member of said department. The following facts and circumstances are from personal
knowledge, and observations, as well as information received from other officers acting in their official
capacity, and statements made by prudent and credible witnesses
2. On Sunday, July 24, 2011 at approximately 0225 hours, a fatal motor vehicle collision occurred on
South Main Street at its intersection with Highland Avenue. The incident involved a 2002 Honda Civic,
and a 2008 Ford F350 in an offset head-on type collision. As a result of the collision, Mr. Alexander
Martinez, a passenger of the 2002 Honda died.
3. The 2002 Honda Civic, bearing Connecticut passenger registration number: 256XMJ, VIN:
2HGES26752H503636, is owned by, Karen C. Roesler, of 82 Wilcox Avenue, Meriden, Connecticut
08451. The vehicle was operated by, Mr. Jedidiah B. Roesler, of 82 Wilcox Road, Meriden,
Connecticut 06451. Date of birth: 10/08/1988.
4. The 2008 Ford F350, bearing Connecticut combination registration number: 72CUA7, VIN:
1FTWF315X8ED79141, is owned and was operated by, Mr. Stephen M. Tyrseck, of 9R Mountain
Road, Durham, Connecticut 06422. Date of birth: 03/08/1975.
5. The passengers of the 2002 Honda are the following: Ms. Colleen M. McNally, of 30 Rose Circle,
Meriden, Connecticut 06450. Date of birth: 09/19/1992; Mr. Nicholas J. Teodosio, of 84 Crown Street

Extension, Meriden, Connecticut 06451. Date of birth: 08/13/1990; Mr. Alexander L. Martinez, of 64
Wilcox Avenue, Meriden, Connecticut 06451. Date of birth: 07/12/1991
6. The surviving occupants of the 2002 Honda, and Mr. Tyrseck were transported by Hunter's
Ambulance Service to Hartford Hospital for the treatment of non-life threatening injuries sustained in
the collision. Mr. Martinez was pronounced dead at the collision site, having sustained multiple blunt
traumatic injuries.
7. On July 24, 2011 at approximately 0225 hours, Sergeant Scott Aresco, Traffic Unit Supervisor, and
| responded to the motor vehicle collision at the intersection of South Main Street and Highland
Avenue. | was advised by officers that Mr. Roesler and Mr, Tyrseck appeared intoxicated. They stated
that the operators had an odor of an alcoholic beverage about their breath as well as slurred speech.
Officer Robert Kraeger reported that Mr. Roesler had difficulty walking. Officer Peter Botsacos and
Officer Edwin Ortiz reported that they observed Mr. Tyrseck staggering at the collision site,
Additionally, Officer Ortiz stated that Mr. Tyrseck was staggering backwards as he spoke with him, and
nearly fell several times. He said that he had to physically hold him from falling to the ground.
8. Sergeant Brian Hubbs reported that he observed Mr. Tyrseck sitting on a curb at the intersection of
South Main Street and Highland Avenue. He reported that they are friends, and that he appeared to be
intoxicated. He further stated that his eyes were glassy, and that he was staring blankly at the
roadway. According to Sergeant Hubbs, Mr. Tyrseck was having a hard time remaining in an upright
Seated position, and had to use his arms to prevent himself from falling over,
9. Sergeant Hubbs reported that when he asked Mr. Tyrseck if he was alright, he looked up at him,
and that it was evident that Mr. Tyrseck was so intoxicated that he did not recognize him. Sergeant
Hubbs wrote that Mr. Tyrseck simply replied, yes sir, | am okay, slurring his words, He stated that Mr.
Tyrseck had an odor of an alcoholic beverage coming from his breath
10. When | spoke with Mr. Tyrseck, he reported that he was traveling southbound on South Main
Street when his vehicle was struck by the 2002 Honda. He said that he did not see the vehicle before
the impact. Mr. Tyrseck indicated that the 2002 Honda had traveled south from Highland Avenue onto
South Main Street, and "t-boned' his vehicle.
11. Lasked Mr. Tyrseck if he had been drinking alcoholic beverages, and he replied, "Yes." He was
asked what type of alcoholic beverages, and what time he drank. Mr. Tyrseck replied, "five or six Bud
Light Beers several hours ago." When asked where he had been drinking, he chose not to state. While
| spoke with Mr. Tyrseck, he had a strong odor of an alcoholic beverage coming from his breath. His
eyes were red and watery, and his speech was slurred. Mr. Tyrseck swayed slightly back and forth

while | spoke with him,
12. This officer then administered field sobriety tests of which Mr. Tyrseck failed.
13. Sergeant Hubbs later approached this officer and advised me that he believed that Mr. Roesler
was also intoxicated. He said that Mr. Roesler had a strong odor of an alcoholic beverage coming from
his breath as well as slurred speech. Mr. Roesler had already been transported to Hartford Hospital.
Officer Douglas Clark of the Traffic Unit went to Hartford Hospital.
14. On July 24, 2011 Officer Clark took a written, swom statement from Mr. Roesler detailing prior
activities, and his account of the incident. Mr. Roesler reported that on July 23, 2011 at approximately
2000 hours, he arrived at Nicholas (38 residence SAREE
15. The operator stated among other things, "I went to Nick's house for a party for Nick going into the
Navy. While at Nick's house we were drinking. We were drinking beer and whiskey. | had 4 or 5 beers
and 1 shot of whiskey. I'm not sure what time I left Nick's party but | believe it was 1:30 AM. | was tired
and Alex and Nick wanted to go home."
16. According to Mr. Roesler, "We got into my Honda Civic. | was driving, Colleen was in the front
passenger seat. Nick was behind me and Alex was behind Colleen. | drove to the area where the crash
happened. | came to the intersection and | had a blinking yellow. | saw a vehicle coming toward us. |
thought | had more time. | made the left turn and the vehicle hit my passenger side. | believe it was a
big truck.”
17. The operator said, "I swear | had enough time to turn. | wasn't speeding. I'm not sure who hit us but
| know a truck stopped and called 911. | just made sure that | was okay and that everyone else was
okay but Alex wasn't in the car. | don't know what the name of the street I was on but | had turned off
Randolph Rd onto this street and had just turned left toward the street that would have taken me past
Wesleyan when this crash occurred.”
18. Officer Clark reported that he spoke with Mr. Tyrseck at Hartford Hospital. Mr. Tyrseck reported i
that he was driving from Cromwell, to his residence (9R Mountain Road, Durham, Connecticut) when
the collision occurred. According to Mr. Tyrseck, he was in Cromwell visiting a friend from 2000 hours
till 0000 hours on July 24, 2011. Officer Clark stated that the operator admitted consuming alcoholic
beverages while at his friend's residence. The operator reportedly could not account for his time from
0000 hours till the collision.
19. Officer Clark reported that Mr. Tyrseck stated that he did not remember much about the crash, but
