A RESOLUTION Revoking the declaration of a state of emergency issued by the President of the Federated States of Micronesia on May 23, 2011. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 WHEREAS, on May 23, 2011, the President of the Federated States of Micronesia declared a state of emergency to provide the authority to reprogram funds to support the operation of the Program Management Unit under the Department of Transportation, Communication and Infrastructure; and WHEREAS, Congress finds that the President has failed to establish, pursuant to article X, section 9, of the Constitution, that the declaration of a state of emergency is necessary to preserve public peace, health, or safety, at a time of extreme emergency caused by civil disturbance, natural disaster, or immediate threat of war, or insurrection; and WHEREAS, Congress finds that the present situation does not rise to the level of an extreme emergency caused by disaster and requiring a state of emergency to preserve public peace, health, or safety pursuant to title 41, section 705, of the Code of the Federated States of Micronesia; now, therefore, BE IT RESOLVED by the Seventeenth Congress of the Federated States of Micronesia, First Regular Session, 2011, that pursuant to the authority vested in the Congress under article X, section 9 of the Constitution, the declaration of a state of emergency issued on May 23, 2011, is hereby revoked; and

BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the President of the Federated States of Micronesia.
