Carl and Howard Discuss Constitutional Issues {03:49:59.

154} [Carl] Well, I got called into court one day and the judge jams me because I didnt have a license and I asked him, I said, excuse me, your honor, may it please the court, is this a court of law or is this a court of equity, and he immediately popped back, theres no equity here, and I go, well then, how do we hear this civil infraction, your honor? And he goes, thats damned clever; how many times have you pulled that? I said, well, lets see, I think this is the 67th time, your honor, and I won all the other times. Well, youre not going to win todaywhat do you think of that. So try that the next time they pull in front of their magistrate court. [Howard] Well, the fact is, it is not a court of equity although it has equitable jurisdiction but it cant come to be until you put in an equity pleading. Thats what brings up the Article Three equity court. [Carl] And then you turn to the judge and he says, so you dont have a license. I said, well, thats why were here today in court, judge and I wanted to ask you whats the nexus of jurisdictional attachment? And he said, well, you had a license at one time, didnt you? And I says, as a matter of fact, your honor, no I didnt, and he goes, oh. You see theyre using that license as the nexus of jurisdictional attachment under an adhesion contract. [Howard] Oh, yes, that is how you contracted into doing business with the government and gave the government the authority to regulate you by creating these contracts, either license or birth registration or deed registration or puppy dog license or whatever. [Carl] My puppy dog, I told them when the guy came for the dog license, I told him my dog was a free dog, it didnt need a license, it was an American dog. [Howard] Well, now the idiots are being trained to say, oh, I guess you think youre a sovereign, huh? [Carl] I would ask him, are you slandering, libeling and defaming me; whats the name of your solicitor? [Howard] Id just tell him, I hope to hell you got a good lawyer because if not Im going to take everything you got including your pretty little wife and your children. And I hope shes pretty because I cant stand ugly women. And, boy, do I piss people off when I do that to them and I love doing that to them. [Carl] Well, Id like to share an argument with you on the driving stuff. You see, when you get pulled over and they pull you out of the car you need to sit up and say, I know youre probably going to find this hard to believe but Im not really driving. You see, Im traveling. Theres a difference. Driving is a commercial venture for profit or hire on the open road and I dont ever do that. Im just exercising my right to travel freely and

unencumbered and thats Shapiro v. Thompson 394 US 618 which says that my basic right to travel is such an unlimited right I dont even need to bring it up that its self-evident in a free society. The right to travel the length and breadth of that society is a basicand what constitutes a free society. So Im not driving, Im traveling. Now, the State of Michigan arbitrarily and erroneously converted my right into a privilege. Thats in violation of Murdock v. Pennsylvania 319 US 105 which says, no state can convert my secured constitutional rights into a privilege and then require me to pay a fee and get a license for the exercise of the right and further Shuttlesworth v. Birmingham, Alabama said, 373 US 262, that if they do convert rights into privileges and require me to have a license and a fee I can ignore the license and the fee and engage in the right with impunity and thats what I did, I ignored the hell out of it. Now, since I relied on the council of nine justices of the United States Supreme Court I have appeared in defense of .willfulness. Willfulness defined is definedUnited States Supreme Courtintent to avoid a known duty or moral certainty. Thats US v. Bishop, 412 US 346. Since I have a perfect defensewillful, that prosecutor over there couldnt prove that I did anything willful on the best day he ever lived therefore we dont have a cause of action to which relief can be granted. That would be Michigan court rule 2.116(c)(8) and I kind of like cut my costs and feesa fraudulent and spurious complaint and I shut up. The judge rolls around and he says to the prosecutor, well, Mr. Prosecutor, would we venture a response? And the whole court just busted out laughing. The one lawyer yells out, on your feetits your turn to talk. And so Mr.got up and he says, well, your honor, in light of the facts here we have no other recourse but to dismiss this complaint, and so everybody busted out laughing then and then the judge says, he says, well, Im just going to dismiss it, what do you think of that? I said, well, you cant do that, Im going to the Supreme Court, and this lawyer yells out, button it, buddy, you won, shut up. And I said, you cant do that. I want to go all the way to the Supreme court. He said, the Supreme Courts kind of busy this time of year. Were just dismissing it, what do you think of that? And so I said, well, Im very disappointed, your honor, I wanted to go for the whole ride. I paid my ticket and I figure I had a right to ride every ride in the park. And he says, so thats where youre going with this. He said, well, youre out of here, and so the next guy gets up and he says, Im not quite sure what that last guy totally, your honor, but Id like to ditto it on my case. He says, ok, how many people here didnt have any license, raise your hand, and about 16 people raised their hand. He says, ok, youre all free to go, and they just cheered. So I walked to the back of the courtroom and this lawyer is standing in the back, he said, son, Ive been an attorney for 52 years and may I tell you, sir, that was one of the finest arguments I ever heard and it was my privilege to be here today and I know you just shot that off from the hip and thats absolutely incredible. And he says, I know one thing, when you go home tonight and drop your drawers they got to made out of solid brass because you just blew the State out of the water on the right to drive. [Joe] Why dont you tell them about that you have this all on tape? I have your tape but I cant think of your name but I know your name and I have the tapes. But maybe other people might be interested in getting this from you. [Carl] See that? Im out there, huh?

[Howard] As a matter of fact that was all just recorded and it will be transcribed and made available. I just hope you didnt say it so darned fast that nobody could catch it. [Carl] Thats the same way I do the cop too. I say, yes, sir and no, sir, and try and be courteous. A lot of times you can get away with a lot more with courtesy than you can with ridiculous slip, slide and away. A lot of times if youre just a little courteous. [Howard] I agree 100%. Most people should be very polite and very courteous because you do not have the things behind you that I have to be able to threaten people and then execute the threat. So dont do the things that Ive done. Ive talked about some of the things I did in the past and I made these threats in order to get them to admit things. That was my purpose. I dont recommend that you act the way I act. Be very polite, very nice and just tell them what the law says. And if they dont want to listen Now, with what this young man just explained, if he would have added to that what weve learned about that these government people being in breach of their public trust by doing the kinds of things that theyre doing and trying to coerce us into cooperation with their state corporation rules and regulations you would really shoot them down. But its going to take a while for them to learn what all that means. It wont happen right away. [Carl] You got to earn that code, you dont get that for nothing. So hes right about that. He earned that code the hard way. And the reality is if you do it right and you pay attention and you use good judgment and dont run at the mouth and just do exactly what youre required what will happen is the cop will stand there and say, you wait right here, dont go away, Ill be right back, and then hell proceed to go back and get on his radio. I pulled over this guy, and youll hear laughter break up over his radio and then youll hear the sergeant come on, all right, clear the net, get off this radio, this is important, and then hell turn and tell that officer, for God sake dont give that guy any ticket, hell end up owing the whole frickin town. Youll actually hear that over the radio because Ive heard it. For gods sake dont give that guy any ticket and you just go back and tell him to have a nice day and hope we dont get any papers in the mail. [caller] Constitution man, hes on Truth Radio on Sunday night at 7pm, PST.

[Carl] I do all kinds of radio. Im here, Im there, Im everywhere. When Im not there you need to be worried. Im very happy about your radio program. You guys are doing a hell of a good jobkeep it up. [Howard] All the way back in the 1980s I had the same thing happen to me. The police would call in on their radio. I pulled Howard Griswold over. Hes driving a Thunderbird and he doesnt have a license tag on it, and the desk sergeant would say, get the hell away from him, leave him alone. [Carl] on it. [Howard] I love that license plate you used to drive around with that just said my car I took the license plates off of mine. I didnt put anything on it.

[Carl] For a while there you had a license plate that said, my car and they couldnt make any claim against your car. [Howard] I didnt do that but somebody else did. Thats good. We are disrupting their system in so many different ways that its finally starting to expose itself for its own criminal activity. [Carl] [Howard] [Carl] You need to keep going. We got a long way to go and whole lot to do. And a short time to get there in. And a short time to get there in.

[Joe] The gentleman that was talking before, does he know if Pastor Strawcutter is still around? [Carl] Oh yes. Hes still around. You get a hold of Pastor Strawcutter in Adrian, Michigan and hell be more than happy to help you out. [Joe] I just wanted to know if hes still around because I know they took down his radio thing so [Carl] Well, they did. They came out with a whole SWAT team and they took his whole trailer full of radios and everything. Thats alright, we got paid back, we got it back not to worry. Theyd rather French kiss a rattlesnake than mess with Strawcutter. Pastor Strawcutter is that serious. Anyway, you get a hold of Pastor Strawcutter, hes at the Truth of the Lord Jesus Christ there in Adrian, Michigan. Just call up information and ask them for the Truth of the Lord Jesus Christ in Adrian Michigan or ask them for Pastor Rick Strawcutter. They all know who Pastor Rick Strawcutter is down there. Hell be happy to get you any of the tapes or what have you that you need and one of the best tapes to order in the raid tape. They sent 56 state troopers out to arrest me in a SWAT raid, all dressed like Ninja Turtles in camouflage everything and black hoods like they were on a raid in Vietnam during the Vietnam War and they false arrested me and took me to jail. And when they did that they really screwed up badand I was just helping this little farmer keep his farm for being foreclosed on and, of course, it was in the middle of a baby shower. This poor woman had just had a baby and they had a baby shower for her and that raid tape got filmed. One of the persons had a video camera and filmed the raid tape and showed what those officers did and what we did is we went out and one of my associates is an expert aficionado of World War II war films, especially of the Nazis {Nazi: NA (German Socialist) ZI (Zionist) German/Khazar amalgamation of socialistsnow largely over here too} in World War II in Germany} and what we did is we copied one of those fabulous war tapes that had all of those guys in those black suits with those big boots {better to kick your grandmother with} and they would be sitting up there singing bam, bam, bam, shuffle, shuffle, shuffle, bam, bam, bam shuffle, shuffle, shuffle and then theyd show Hitler come up there and Deutchland- Sig heil, sig heil and all this stuff and then

they took the camera and we dubbed in this raid tape and panned over on the door of the state police cruiser, the Michigan state police, and then we panned over on these guys all dressed in their black hoods with their camouflage everything with machine guns and everything. Do you see a difference here? And I will tell you that tape caused one hell of a serious ruckus inside the state police and the next raid they pulled onand they went out there and crossed six lanes on a street called Van Dyke, all the heavy traffic goes into the General Motors headquarters in the morning and they ran across six lanes of huge business traffic and grabbed that camera man and kicked him off the ground andcamera going. He didnt want to talk to youhed really like to talk to him. And Pastor Strawcutter has that raid tape. If you ask him for that raid tape you will be in tears on the floor laughing. Thats what they get for pulling stuff like that. Oh, that wasnt the end of it, the entire, some area of the militia surrounded the state police post at 31and.armed to the teeth and dressed full bore ready for war and the head of the militia came in and said, it would be a real good idea you dont harm a hair on the head of that guy. Were real fond of him in the state of Michigan and these state troopers were putting red magic marker on their necks of their blood type, you see, and I would say, what did you do, cut yourself while you were shaving? Oh, shut up, old man, just shut up and sit down, well handle it. They came in and they basically told them it would be a real good idea if you just let them gowhat do you say? So, the one headquarters officer told well, you take him down to the jail there He said, I aint even getting in the car with that guy, what do you think of that? He said, you take him down there, and he said, I aint going either. He said, my wife will kill me if I dont go home tonight. And the next guy was a young punk kid and hes driving down a thirty-two mile road at a 108 miles an hour in this little bitty car and Im telling him headed for the jail, I said, buddy, you better think about slowing down. I have seen many a 14-point buck crossing this road and if you hit that big guy theyre going to bury you and this car in the same boxyou got it? He said, never mind, just dont come out of those cuffs because, believe me, youd be the first to know it because it would be too late. He said, thats it, and he pulls over and puts another set of cuffs on me. So then they sneak me down to Adrian and bring me before, and that wasnt the end of it. And then people started calling the jail and the next thing you know the sheriffs coming in and saying, some joker just called up here from California, if they harm a hair on your head theres going to be death in the familyyou know anything about that? I said, sir, Ive been in your jail. I dont know anything about anything. Im just trying to sit quietly here and wait for my day in court. You do know that Im issuing a writ of habeas corpus. I want to be brought for the record to look into a probable cause and a unlawful detainer of me against my wishes and over my objections and in the custody of you. The res is in your custody and Im demanding a probable cause hearing. The next thing you know he says, theyre calling here from everywhere, from Walla Walla, Washington, from Phoenix, Arizona, from L.A., San Francisco, Las Vegas and Dallas Fort Worth and Memphis, Tennessee, Gulfport, Mississippi, Orlando, Atlanta, Georgia, Lexington, Kentucky, Pittsburg, Pennsylvania, Detroit, Chicago, and the police department in New York City called and it would be a good idea if you dont harm a hair on the head of that guywere real fond of him in New York City. He says, who do you know on the police department in New York City? I said, by the IRS and he said, yeah, it was in the front page of the paper. Well, I went and put on a seminar with Eddie Kahn there and we got all those cops totally off and we can get them off of you. Oh no, you aint getting me involved in that

stuffthose people will come after you like they did that singer down in Texas and take you right out of your sick bed, Willy Nelson. Remember they dragged him right out of the sick bed in the hospital. I said, well, you choose wisely, and he said, theyve been calling here from England, from France, Italy, Spain, South America, all over Africa, Turkey, Greece, Australia, New Zealand. I guess you are who you say you are. I had to shut my 1800 number off because we couldnt pay the bill. I had to call the phone company and have them shut it off. So then, he says, Im taking you right in front of the judge, right now. So we get down in front of Judge Michael R. Smith, the chief judge. He just poured a cup of coffee. He picks up the cup of coffee and he throws it at the prosecutors head. I know, we dont have enough to do today. You just go arrest the Constitution man, didnt you guys? be down here in ten minutes and Im dismissing everything, what do you think of that? The state trooper stands up, he says, your honor, we have serious charges against this man. He says, no, you dont. .and didnt I tell you then you couldnt do this again? I told you that, then, didnt I? And he said, well, yes, you did. He said, Bailiff, take that gentlemen into custody so the state police lieutenant got arrested, thrown in jail, and I turned to him and I said, do see a trend here? You wait until we get to federal court. Everybody knows me at federal court and were going to have a whole lot of fun. Anyway, I filed a $100,000,000 lien against the guys house for a hundred years. He ended up, his wife beat the hell out of him with a broom handle. He got busted for domestic violence. He couldnt have a gun any more so he couldnt keep his 21 year old job on the state police. He ended up working as a private security guard now. He lost his house. His wife divorced him and he couldnt keep his job at the state police and now he works as a want-to-be cop in some shake and bake restaurant. So, you little people can be effective. I want you to know that. Just keep listening and keep learning and your day is coming. [Howard] With all of what you went through if at that time we would have known then what we know now about breach of trust and the public government being a public trust you could have gone after them and stripped them, the whole crowd of them, of every little piece of property that they have. [Carl] Its worse than that. Theyre a bankrupt public trust and I went after them for that. I asked the bailiff to go over and get me that attorneys business card. He brought it over to me. I checked it. It didnt even have raised letters so I knew he wasnt real proud of what he did. I turned to the judge, I said, excuse me, your honor, may it please the court, I says, but this gentleman doesnt have a right to speak before this court. As a matter of fact, Ive checked with the clerk of the bankruptcy court, the US Bankruptcy Court, and hes not on the list of approved attorneys or trustees of the bankruptcy court. Now, I happen to have his business card, right here, and it doesnt even have raised lettersbeing real proud of what he does here, but if he was a trustee of the United States Bankruptcy Court his card would have raised letters on it and it would say, United States Bankruptcy Court trustee and he would be actually able to speak on behalf of the bankrupt corporation. But since he isnt a trustee of the bankruptcy court and we are a bankrupt corporation, just look at House Joint Resolution 192, June 5th, 1933. A copy is attached to my brief being a part hereof on the record and I am claiming that the State of Michigan as one of the member states of these united States is also a bankrupt corporation and you dont have a right to speak Turn the lights on here because you are civilly dead therefore you

couldnt possibly have a cause of action for which relief can be granted. Your honor, may it please the court, I would move for dismissal{Carls words are breaking the sound barrier at this pointsorry about that}Court Rule 2.116(c)(8) and I further cite Rule 12(b)(6) of the federal court by fraud and I further cite 56E{?] of the federal rules of civil procedure for scandalous pleadings and I would basically state for the record if I cant get my constitutional rights honored here Im going to have no other recourse but to sue and those constitutional rights are supposed to be interpreted in favor of me.beneficiary.the citizens for the protection of my rights and propertythats . V. United States, 273 US 28 and.. {Carl has perfected the art of compressing ten words in the space of one word and he most likely will cross the finish line first} My constitutional rights are supposed to be interpreted to include every word in, every phrase, every syllable, to include the punctuation, to include the intent of the framer who made the Constitution, thats v. Virginia, . 21821 {?} and Ill cite the whole Federalist Book as my reference and at this time, your honor, Im asking the court to take due consideration of all my constitutional rights and make sure that they are protected and she stopped and that guy stood up and said, you have got to be kidding. And the judge turned to him and told him to shut up and sit down, shed handle everything. She then turned to me and said I was one of the finest Americans shed ever had the privilege to know or meet and she never had a gentleman so courteous in her court and she was ordering me released in my own recognizanceand ordered me in jail to be let go to walk out of the court in jail, folks, that they normally theyll never do. Copspulling their guns in andget out of lockup. They let me out and I walked out the front door and the bailiff wanted to intercede and the other bailiff told him, dont mess with that guy, hes heavy duty, the judge let that one go. Im telling you folks out there in TV land you can do this. I got grandmothers who can do this. I got young students every day that do this, truck drivers, you name it, theyre all over. I taught this motorcycle guy. One night he came into the jail. He beat the hell outguards, they beat him up bad and shot him with a taser and just beat the hell out of him and dragged him into my cell. I cleaned him up with some toilet tissue and water from the sink and I says, now, youre really a bad dude, I can see that. You damned sure wiped the floor.. Youre not going to win like that, you understand me? If you want to win you got to use your head better. You need to listen and Ill tell you what, you cant curse anybody, you cant beat on anybody, as a matter of fact, it requires that you be a perfect gentleman so that it looks like youre a person of dignity.like themselvesand if youre a person of dignity they cant trash you because they want to look in the mirror now and shave and if they trash you they lose self respect. So you got to do it my way or I wont help you. But if youll do it my way well work something out. Also, when I get you off I want you going out to one of those magazine shops and I want you to get me about two dozen of those fancy dancyswimsuit editions and I want you to mail one to every floor in this jail. Because if those guys are busy looking at beautiful babes they dont have any time for fighting so that sheriff cant send in his goon squadblack helmetsand beating the hell out of everybodygot it? And thats just going to ruin his dayyou know what I mean? Well, the guy gets up there, he does what I tell him. I do his paperwork. .just do what I tell you and he gets into court. The first thing out of his, good morning, your honor. {Carl hit the afterburners again and is cruising at warp speed} the Michigan courtroom, 2.116(c)(8) andfraudulent and spurious complaint. He hands the prosecutor the documents that I prepared with a sharpened pencil on the cement between the bricks of the jail cell and the paper that was

shoved under the door. He hands the prosecutor and he says, youre served. The judge said, there couldnt be two of those guys, and he leans back and he goes, have you ever seen this paperwork before? And the prosecutor goes, oh, yes, sir, weve seen this paperwork plenty of times, your honor. We know exactly where these papers come from, and he says, were going to have to dismiss this case and you dont have a cause of action. Hes going to have to be let go. So they let him go. So he comes back to the jail a hero. they got to let me go. Im going to sue their socks off I say, well, wait until you get out of here before you start yelling stuff like that or theyll beat you up and throw you in the corner again. So he goes out. He got the two dozen swimsuit editions and mailed them to every floor in the jail. Of course, the sheriff was highly ticked about that because he couldnt send his guards in and beat everybody up anymore because nobody would fight. So it was hilarious. And so, when I left there he says to me, do me a favor, pops, dont ever come back here, we dont ever want you here againyou got that? He says, I dont think theres day gone by that you havent filed at least two or three complaints in my jail. I got the state coming on my ass. I got the governor on my ass. I got everybody and his brother on my ass. Please, please dont ever come back here again. Wed really appreciate the hell out of that. I said, well, you dont even have dancing girls and you dont even have a bar. What kind of hotel you running here? You couldnt be a five star rating. I pulled out my harmonica and out the door I went{to the tune of Dixie}. And all the prisoners stood up and cheered. Yea pops, sock it to them, old manyou know that. So the sheriff says, you better get the hell out of here, pops, or were going to get you for inciting a riot. I said, buddy, lets talk truth here. You dont have enough hair on your ass to put me in a cell back in this jail and then go tell that sheriff that you put me back in a cell in this jail because hes got you in the dusty, rusty butter knife or a dull deer antler. Now, make my day. You throw me back in a cell and see how fast I write another writ of habeas corpus on a roll of toilet paper. Now, thats what has to be done. Now, I need a hundred million of you to go out and do that. Do you think you can do that? Lets get busy.
