REGULATION OF THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA No. 35/M-DAG/PER/11/2011 CONCERNING PROVISIONS ON THE EXPORT OF RATTAN AND RATTAN PRODUCTS BY GRACE OF THE ALMIGHTY GOD, THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA,
Considering:
a. that in the framework rattan utilization in sustainability and availability of raw materials for rattan finishing goods industry and support increasing export of rattan products, it is necessary regulation concerning the provision on the export of rattan and rattan products; b. that based on the considerations as intended in paragraph a, it is necessary to stipulate Regulation of the Minister of Trade:

In view of:
1. Trade Ordinance 1934 (Statute Book No. 86/1938); 2. Law No. 5/1984 concerning Industry (Statute Book No. 22/1984, Supplement to Statute Book No. 3274); 3. Law No. 10/1995 concerning Customs (Statute Book No. 75/1995, Supplement to Statute Book No. 3612) as amended by Law No. 17/2006 (Statute Book No. 93/2006, Supplement to Statute Book No. 4661); 4. Law No. 41/1999 concerning Forest (Statute Book No. 30/1999, Supplement to Statute Book No. 3888); 5. Law No. 39/2008 concerning State Ministries (Statute Book No. 166/2008, Supplement to Statute Book No. 4916); 6. Government Regulation No. 34/2002 concerning the Management of Forests and the Use of Forest Area (Statute Book No. 66/2002, Supplement to Statute Book No. 4206); 7. Presidential Decree No. 260/1967 concerning the Affirmation of Tasks and Responsibilities of the Minister of Trade in Foreign Trade Field; 8. Presidential Regulation No. 28/2008 concerning National Industry Policy; 9. State Ministries as amended by Presidential Decree No. 77/2011; 11. Presidential Regulation No. 24/2010 concerning Position, Duty, and Function of State Ministries as well as Organization Structure, Duty and Function of First Echelon of State Ministries; 12. Decree of the Minister of Industry and Trade No. 558/MPP/Kep/12/1998 concerning General Provisions in Export as amended several times, the latest by Regulation of the Minister of Trade No. 01/M-DAG/PER/1/2007; 13. Regulation of the Minister of Trade No. 20/M-DAG/PER/5/2008 concerning Provisions on the Export Forestry Industry Products; 14. Regulation of the Minister of Trade No. 31/M-DAG/PER/7/2010 concerning Organization and Work Flow of Ministries;

DECIDES:
To stipulate:
REGULATION OF THE MINISTER OF TRADE CONCERNING PROVISIONS ON THE EXPORT OF RATTAN AND RATTAN PRODUCTS

Article 1
In this Ministerial Regulation: 1. Natural rattan is rattan in the form of natural, not be rubbed, not be washed, not be smoked by sulfur. 2. Mixed rattan is in the form of rubbed, washed of rest of skin, cutting part of epidermis, not dried yet. 3. Washed and Sulfurized Rattan hereinafter called W/W Rattan is rattan from mixed rattan that is smoked by sulfur, fried, fired and dried, but still in the form of natural and skinned. 4. Semi-finished rattan is rattan further worked into fine polished rattan, rattan core and rattan barks. 5. Rattan products are finishing goods of rattan that has value added made from rattan raw materials. 6. Registered Forestry Industry Products Exporter hereinafter abbreviated as ETPIK is forestry industry company that has secured a certificate of recognition from Director General of Foreign Trade, Ministry of Trade to export forestry industry products. 7. Surveyor is business entity that has Survey Service Business License (SIUJS) from Ministry of Trade. 8. Minister is minister who handles governmental function in the field of trade. 9. Director General is Director General in the Foreign Trade section.

Article 2
Rattan in the group of Ex HS 1401.20 are:

a. Natural rattan; b. Mixed rattan; c. W/S rattan; and d. Semi finished rattan, are prohibited to be exported.

Article 3
(1) Rattan products are in the group of Ex HS. 4601, Ex HS. 4602, Ex HS 9401 and Ex HS. 9403 only can be exported by company already obtain recognition as ETPIK. (2) Export of rattan products as intended in paragraph (1) should be verified or technical inquiry before loading of goods. (3) Implementation of verification or technical inquiry on the export of rattan products as intended in paragraph (2) is conducted by Independent Surveyor. (4) Result of verification or technical inquiry on the export of rattan products as intended in paragraph (2) is written in the form of: a. Surveyor Report (LS) in case checked rattan is in according to the effective regulation; or b. Report of Checking Result (LHP) in case checked rattan is not according to the effective regulation. (5) Surveyor Report (LS) as intended in paragraph (4) a is used as customs complementary document, that is necessary to be submitted with export customs notification at Customs office. (6) All expenses caused by verification or technical inquiry activities on the export as intended in paragraph (2) is borne by government. (7) Report on the verification or technical inquiry result as intended in paragraph (4) should be submitted by surveyor at the latest on 15 of the ensuing month to the Director General, with copies to: a. Director General of Agro Industry, Ministry of Industry; and b. Director General of Forestry Business Fostering, Ministry of Forestry. (6) Surveyor that does not implement obligation as intended in paragraph (7) will get sanction in the form of revocation on the stipulation as Surveyor.

Article 4
Export Approval Letter (SPE) that is issued based on Regulation of the Minister of Trade No. 36/M-DAG/PER/8/2009 concerning Provision on the Export of Rattan and Regulation of the Minister of Trade No. 28/M-DAG/PER/10/2011 concerning Amendment to the Regulation of the Minister of Trade No. 36/M-DAG/PER/8/2009 concerning Provision on the Export of Rattan, still can be used until December 31, 2011.

Article 5
Regulation of the Minister of Trade No. 36/M-DAG/PER/8/2009 concerning Provision on the Export of Rattan as amended by Regulation of the Minister of Trade No. 28/MDAG/PER/10/2011 are revoked and declared null and void.

Article 13
This Ministerial Regulation shall come into force since January 1, 2012 and will be evaluated periodically. For public cognizance, this Ministerial Regulation shall be promulgated by placing it in the State Gazette of the Republic of Indonesia.
