das ABSOLUT POWERLINE SCHIENENSYSTEM ist ein 1-phasen-stromschienensystem. die schiene besteht aus einem festen aluminiumprofil und lsst sich dennoch auch in radien biegen. das schienensystem empfiehlt sich aufgrund seines reduzierten designs und der flexiblen anbringung insbesondere fr den shop- und officebereich als auch fr den privaten wohnraum. das schienensystem ist fr jegliche beleuchtungssituationen geeignet. drei unterschiedliche leuchtenarten stehen fr das schienensystem zur verfgung. nach persnlichem empfinden und je nach raum kann es individuell gestaltet werden.

the ABSOLUT POWERLINE MONORAIL SYSTEM is a one-circuit power rail system. the monorail is made of a solid aluminium profile and it can still be bent to radii. the monorail system is especially recommended for the use in shop and office areas as well as for the private living space due to it minimalist design and flexible installation. the monorail system is suitable for any lighting situation. three different types of lighting are available for the monorail system. it can be customised according to personal wishes and depending on the room.

zuzglich fracht und verpackung. diese wird ge sondert in rechnung gestellt. es gelten unsere am tag der lieferung gltigen preise aus unseren preislisten, sofern nichts anderes vereinbart ist. bei bestellungen unter einem nettoeinkaufs wert von unter euro 100, berechnen wir euro 9, mindermengenaufschlag. b) ein versand erfolgt stets auf gefahr des kufers und zwar auch dann, wenn frachtfreie lieferung vereinbart worden ist oder der versand mit eigenen fahrzeugen durchgefhrt wird. die gefahr geht im falle des versands mit der aufgabe zum transport auf den kufer ber. die ware wird nur auf besonderes verlangen des kufers versichert. die kosten einer versicherung trgt der kufer. c) sofern nichts anderes vereinbart ist, ist der rechnungsbetrag ohne abzug bei warenerhalt fllig. zahlt der kufer den rechnungsbetrag nicht innerhalb von 10 tagen nach zugang der rechnung, so gert er auch ohne gesonderte mahnung in verzug. im falle des zahlungsverzuges des kufers sind wir berechtigt, verzugszinsen in gesetzlicher hhe, mindestens aber in hhe von 12 % p.a. zu fordern. die geltendmachung hherer verzugsschden bleibt unberhrt. d) aufrechnungs und zurckbehaltungsrechte stehen dem kufer nur dann zu, wenn seine gegenansprche rechtskrftig festgestellt, unbestritten oder von uns anerkannt sind. e) wird nach abschluss des vertrages erkennbar, dass unser anspruch auf die vom kufer zu erbringende gegenleistung wegen mangelnder leistungsfhigkeit des kufers gefhrdet wird, sind wir berechtigt, unsere leistung solange zurckzuhalten, bis der kufer die gegenleistung erbracht oder sicherheit geleistet hat. erbringt der kufer innerhalb einer frist von einer woche nach aufforderung weder die vollstndige gegenleistung noch eine geeignete sicherheit, sind wir berechtigt, vom vertrag zurckzutreten. 323 bgb fi ndet entsprechende anwendung. unser recht, unter den gesetzlichen voraussetzungen schadensersatz zu verlangen, bleibt unberhrt. 4. mngelgewhrleistung, schadensersatz, rgepflichten a) die gelieferte ware ist durch den kufer unverzglich auf vollstndigkeit und mangelfreiheit zu berprfen. mindermengen, falschlieferungen und uerlich erkennbar beschdigte waren sind bereits auf der empfangsquittung zu vermerken. smtliche beanstandungen sind uns unverzglich schriftlich mitzuteilen. kommt der kufer diesen pflichten nicht nach, gilt die ware als genehmigt, es sei denn, es handelt sich um einen mangel, der bei der untersuchung nicht erkennbar war. zeigt sich ein nicht erkennbarer mangel erst spter, so hat der kufer diesen unver zglich nach der entdeckung spezifiziert zu rgen. kommt er dieser verpflichtung nicht nach, gilt die ware auch hinsichtlich eines solchen mangels als genehmigt. b) bei rechtzeitiger und berechtigter beanstandung der ware sind wir berechtigt, die mangelhafte ware nach unserer wahl zurckzunehmen und durch vertragsgeme ware zu ersetzen oder die gelieferte ware sofern dies mglich und fr den kufer zumutbar ist nachzubessern. c) sind wir bei berechtigten und fristgerecht gergten beanstandungen nicht bereit oder in der lage, innerhalb angemessener nachfrist fr eine mngelbeseitigung/ersatzlieferung zu sorgen, ist der kufer nach seiner wahl berechtigt, vom vertrag zurckzutreten oder eine herabsetzung des kaufpreises (minderung) zu verlangen. d) unsere haftung auf schadensersatz, gleich aus welchem rechtsgrund (einschlielich deliktischer ansprche), richtet sich nach den gesetzlichen vorschriften, sofern der schaden auf vorsatz oder grober fahrlssigkeit durch uns, unsere vertreter oder erfllungsgehilfen beruht. die haftung fr einfache fahrlssigkeit ist ausgeschlossen, sofern keine schuldhafte verletzung einer wesentlichen vertragspflicht vorliegt oder wir eine garantie oder ein beschaffungsrisiko bernommen haben. die haftungsbeschrnkung gilt nicht in fllen der verletzung von leben, krper oder gesundheit eines menschen. die haftung aufgrund der bestimmungen des produkthaftungsgesetzes bleibt ebenfalls unberhrt. e) schadensersatzansprche des kufers sind auf den typischen, vorhersehbaren schaden begrenzt. das gilt nicht bei ansprchen, die auf vorstzlichem oder grob fahrlssigem verhalten durch uns, unsere gesetzlichen vertreter oder erfllungsgehilfen beruhen. die begrenzung gilt ferner nicht fr die haftung fr schden aus der verletzung des lebens, des krpers oder der gesundheit eines menschen und in fllen einer haftung nach den bestimmungen des produkthaftungsgesetzes. 5. verjhrung a) smtliche gewhrleistungsansprche des kufers bei mngeln der gelieferten waren (einschlielich schadensersatzansprche) verjhren in den fllen des 437 abs. 1 nr. 3 bgb in einer frist von 1 jahr. die frist beginnt mit der ablieferung der waren. b) ansprche des kufers auf schadensersatz wegen pflichtverletzungen nach 280 bgb verjhren ebenfalls in einer frist von 1 jahr. der beginn der verjhrungsfrist richtet sich nach dem gesetz. c) die verjhrungsregelungen unter a) und b) gelten nicht fr flle des unternehmerregresses ( 478, 479 bgb) sowie fr schadensersatzansprche aus einer verletzung des lebens, des krpers oder der gesundheit eines menschen. sie gelten ferner nicht in fllen, in denen vorsatz oder grobe fahrlssigkeit von uns, unseren gesetzlichen vertretern oder erfllungsgehilfen vorliegt. 6. eigentumsvorbehalt a) wir behalten uns das eigentum an den gelieferten waren bis zur vollstndigen bezahlung smtlicher forderungen aus den geschftsbeziehungen zwischen uns und dem kufer vor. b) der kufer ist berechtigt, die vorbehaltswaren im normalen geschftsverkehr weiter zu veruern, sofern er sich nicht in zahlungsverzug befi ndet. eine verpfndung oder sicherungsbereig nung ist ihm nicht gestattet. c) der kufer tritt hiermit im voraus smtliche forderungen aus weiterverkufen der unter eigentumsvorbehalt gelieferten waren an uns ab. wir nehmen diese abtretung an. der kufer bleibt zur einziehung der forderungen berechtigt, solange er seine verpfl ichtungen gegenber uns ordnungsgem erfllt und kein insolvenzverfahren gegen den kufer eingeleitet bzw. die einleitung mangels masse abgelehnt worden ist. wird die vorbehaltsware zusammen mit anderen waren weiter veruert gleichgltig, ob ohne oder nach verarbeitung, verbindung, vermischung oder vermengung , so gilt die oben vereinbarte vorausabtretung nur in hhe des rechnungswertes der vorbehaltsware, die zusammen mit den anderen waren weiter veruert wird. d) sofern wir wegen pfl ichtverletzungen des kufers, insbesondere wegen zahlungsverzugs, zum rcktritt vom vertrag berechtigt sind, hat der kufer die unter eigentumsvorbehalt gelieferten sachen nach erklrung unseres rcktritts unverzglich zurckzugeben. die kosten fr die rckgabe trgt der kufer. e) bei pfndung oder sonstigen eingriffen dritter hat uns der kufer unverzglich schriftlich zu benachrichtigten. soweit der dritte nicht in der lage ist, uns die gerichtlichen und auergericht lichen kosten einer klage gem 771 zpo zu erstatten, haftet der kufer fr den uns entstandenen ausfall. f) wir verpflichten uns, die uns zustehenden sicherheiten auf verlangen des kufers insoweit freizugeben, als der wert unserer sicherheiten die zu sichernden forderungen um mehr als 10% bersteigt. die auswahl der freizugebenden sicherheiten obliegt uns. 7. anwendbares recht, gerichtsstand, erfllungsort a) fr diese geschftsbedingungen und die gesamten rechtsbeziehungen zwischen den parteien gilt das recht der bundesrepublik deutschland mit ausnahme des internationalen privatrechts und des unkaufrechts. b) gerichtsstand fr alle sich unmittelbar oder mittelbar aus dem vertragsverhltnis ergebenden streitigkeiten ist brhl, sofern der kufer kaufmann, juristische person des ffentlichen rechts oder ffentlich rechtliches sondervermgen ist. c)
