Reservation Agreement

This reservation agreement is your contract to occupy The Blue Bungalow vacation property located at 569 Park Avenue in Park City, UT; responsible Guest must complete and return agreement with deposit to guarantee reservation. Guest(s) acknowledges and understands that he/she is a licensee of the management company and not a tenant; and that he/she is not acquiring any interest in the property. Guest acknowledges and agrees that the unit licensed in accordance with reservation agreement is privately owned. Any reservation obtained under false pretense shall be subject to forfeiture of payment, deposit and/or rental money, and the party will not be permitted to check-in. The use of the facility described above is PROVIDED ON AN AS IS BASIS, AND AGENT MAKES NO WARRANTIES EXPRESS OR IMPLIED, ORAL OR WRITTEN INCLUDING ANY WARRANTY OF MERCHANTABILITY OF FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL OWNER OR AGENT BE LIABLE FOR DIRECT, SPECIAL, INDIRECT INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE OR KIND WHATSOEVER arising out of this agreement or as a result of Guests use of the unit. Responsible party must be 21 years or older with valid I.D. and Credit Card (MC, VI, DC). Additionally, the individual signing the rental agreement represents to the management company that he/she will be an occupant of the dwelling during the entire term of this rental agreement, and that he/she meets the aforementioned age requirements. This property is privately owned, and the management reserves the right to refuse service to anyone. Management will not be responsible for loss of money, jewelry, or other valuables during their stay. Guests shall inspect and be familiar with the proper use and application of such items prior to use or ask for instruction prior to usage. Guest(s) hereby agrees to indemnify and hold owner harmless from any and all claims including those of third parties, arising in any way on premises. Children under the age of sixteen may not use hot tub without adult supervision and agree to hold owner harmless from any claims of injury or drowning. Guests assume the risk of injury or losses relating to any recreational activities and will hold owner and agent harmless of such incidents. Guests understand responsibility as occupant and accept financial burden for any damages to property caused by any member of party. CHECK IN TIME: Guests may check in after 3:00 P.M. Early arrival may be arranged with permission. Please provide your ideal check-in time:________AM PM CHECK OUT TIME: Check out time is 11:00 A.M. Late check out is not always possible but might be arranged with at least two days advance notice before departure. Guests must have permission to extend stay. DAMAGES/INSURANCE: Guests shall leave premises in clean, undamaged condition. Guests are responsible for any damage they may cause during their stay. You have purchased

an accidental damage insurance policy. The purchase of an accidental damage insurance policy is non-refundable. This policy offers from $1,500 to 10,000 dollars of coverage for accidental damage to the vacation home during your stay depending on the policy coverage purchased. Policy details and coverages are detailed separately and should be reviewed prior to purchase. An email containing the accidental damage insurance policy will be sent via email to the guest prior to arrival. Liability is not limited to the policy coverage. If damage caused by the guests to any part of the rental property exceeds the amount of the damage protection policy, guest understands and agrees that they are responsible to pay the additional cost for replacement or repair of damaged items. Guests understand that Owner or contractors may enter premises, with guests prior approval, to perform repairs or maintenance on property. Guests are not entitled to monetary compensation for items deemed unusable. TELEPHONE USE: Local and domestic long distance telephone calls are freeall collect, third party, 411 information, international or fee based calls must be charged to guests credit card. Any changes to the owners telephone service are prohibited and such charges will be passed along to the guests for reimbursement, in addition to a $25.00 processing fee. Guests should consider using cell phones to make fee based calls. OCCUPANCY: The Guest agrees not to exceed 6 occupants, including children. If guests arrive with more people in their party than stated in the reservation agreement, NO ONE will be permitted to enter the house and NO REFUND will be issued. The Owner must approve any use of the dwelling other than residential use during a family vacation. ALL GUESTS AGREE TO HAVE NO SOCIAL, COMMERCIAL, WEDDING OR ENTERTAINMENT VENUE PARTIES OR BANDS ON PREMISE. Occupancy and use of premises shall not be such as to disturb neighbors. SMOKING/DRUGS: Smoking or illegal drugs are not allowed on premise. Guests smoking or possessing illegal drugs must vacate premises and will forfeit all money for the balance of their stay and incur a minimum additional penalty of $250. PETS: Pets are not permitted in or on the premise. Guests with pets must vacate premises and will forfeit all money for the balance of the stay plus incur a minimum additional penalty of $250. MISCELLANEOUS: We request that all skis, poles and snowboards be stored in the racks provided for guests in the mudroom. A mudroom is located just inside the front door where boots, outdoor shoes and wet clothing can be removed and stored to prevent water damage. Hard-soled or wet shoes must not be worn on hardwood floors. Water and harmful objects must also be kept off hardwood floors. Guests agree to comply with all Park City municipal codes and laws. This agreement shall be governed by and construed and performed according to the laws of the State of Utah, USA. All parties agree that any dispute out of this agreement shall be resolved in the State of Utah, USA. Should litigation arise concerning provisions of the agreement, reasonable legal fees will be awarded to prevailing party.

Information regarding individual listings is believed accurate but cannot be guaranteed. Arrival info with driving directions will be E-mailed two weeks in advance of stay. Upon your arrival, please review the guest welcome and info book to become familiar with features in home. Please let us know if anything in the home does NOT operate as soon as possible. I, ___________________________________, having registered as occupant and responsible party of Escape on Empire for the nights of _______________to________________, a duration of nights, declare under penalty of perjury that no more than six (6) persons including myself will be using the vacation home on Empire Ave., Park City, Utah, and I understand I will be charged a minimum of $500 per day, per person, on any day that more than ten persons occupy the property. Email transmission of any signed original document and re-transmission of any signed email transmission is considered binding and the same as delivery of an original. Reservation agreement becomes invalid with any alteration. I declare that I have read the above provisions and am signing this declaration with the full knowledge and understanding of the consequences of violations listed above. I also understand and agree that the credit card submitted as payment for accidental damage insurance will be used to collect damage charges going beyond the scope of the insurance policy. This contract may not be revised or altered without written permission and all verbal agreements must be integrated in contract.
