SENATE President Juan Ponce Enrile on Wednesday vowed to warn voters in next years election about the dangers posed by Senator Antonio Trillanes IV, who is running for re-election.
Im going to bring this to the people and tell the people about this man, who he is, what kind of senator he is, what kind of military ofcer he is, and the hazard he is creating for this country, said Enrile, one day after exposing Trillanes clandestine meetings with Chinese government leaders at the height of tensions over a territorial dispute between Manila and Beijing in April. The Palace on Wednesday distanced itself from Trillanes, who claimed he was holding backchannel talks with the Chinese on orders of President Benigno Aquino III, a claim that Malacanang denied. Presidential spokesman Edwin Lacierda said Trillanes did not have plenipotentiary powers when he went to China 16 times as a backchannel negotiator, and was not acting as the Presidents alter ego. He could not conrm or deny Trillanes claim, however, that it was the Palace that nanced his trips. Asked if the Palace regretted accepting Trillanes offer to serve as a backchannel negotiator, Lacierda said: Hindsight is always... 20-20. In the wake of the word war between Enrile and Trillanes and the sniping against Foreign Affairs Secretary Albert del Rosario, the President sent Trillanes a text message asking him to stop granting interviews. We would certainly hope that the senator would refrain from making statements, the Palace ofcial added. But Trillanes, a former military ofcer who led several failed coup attempts against former President and now Pampanga Rep. THE Judicial and Bar Council announced on Thrusday it has started screening the applications of 15 nominees to the seat in the Supreme Court vacated by Justice Maria Lourdes Sereno, who was appointed last month by President Aquino as Chief Justice. JBC ofcials said the screening process, which would include background candidates competence, integrity, experience and educational background. The candidates include trial court judges, justices from the Court of Appeals, deans of prestigious law schools and wellknown law practictioners, a senior ofcial said. The ofcial said seven Court of Appeals justices were among the candidates: Ramon Bato, Rosemari Carandang, MagReyes, Jose Reyes and Noel Tijam. Law school deans Jose Manuel Diokno of De La Salle University and Cesar Villanueva of Ateneo Law School joined other candidates that include Teresita Herbosa, Marivic Leonen, Raphael Lotilla, Adoracion Cruz-Avisado, Joe Santos Bisquera and Maria Cristina Cornejo. As this developed, a senior ofcial of the Foreign Affairs Department identied the ve candidates which Secretary Albert del Rosario department submitted to Mr. Aquino to replace Sonia Brady as Philippine Ambassador to China. Brady 71, suffered from a stroke in her residence in Beijing and has been conned in a hospital. The source said Brady is recovering very well, although she still couldnt speak. The DFA ofcial, which asked not to be identied, said the candidates were Undersecretary for Migrant Affairs Jesus Yabes, Philippine Ambassador to London Ricky Manalo, Undersecretary for Policy Erlinda Basilio, former Ambassador to Malaysia Vic Licaros and Philippine Representative to the United Nations in Geneva Evan Garcia. Basilio accompanied DFA secretary Albert del Rosario in Phnom Penh, Cambodia during the 45th Association of the Southeast Asian Nation ministers meeting. The source said that among the ve candidates, Yabes appeared to be the best bet. He is a China expert, the source said. Yabes was a former Philippine ambassador to Islamabad, Pakistan. He was also a former consul general to China from July 2002 to July 2007 and likewise served as deputy chief of mission to Tokyo, Japan. I had no phone calls from GMA [Arroyo], Enrile told reporters in an ambush interview. He said Arroyo also did not send a representative to push for the passage of the bill. In fact, that was the rst time I learned that the former President was interested in CamSur, Enrile said. I dont think that there is any senator here who knows that the former President is interested in the division of CamSur. Arroyo, now a Pampanga representative, also denied Trillanes claims. Elena Bautista-Horn, her chief of staff and spokesperson, said Trillanes claims were unfounded and baseless. No, she [Arroyo] never called Enrile regarding Camarines Sur. The President said he and Hu could divorce diplomatic niceties so that both sides can really understand each others position on the territorial disputes in the West Philippine Sea. Mr. Aquino said that while he could not describe PhilippinesChina relations as warm, it was now less cold than when both sides were in a stalemate over territorial disputes. He said certain positions may have been lost in translation and could be claried if he and Hu could have a heart-to-heart talk. During the Vladivostok summit, Mr. Aquino was still able to raise the territorial disputes issue during his bilateral meetings with Vietnamese President Truong Tan Sang and Malaysian Prime Minister Najib Abdul Razak. The Malaysian leader underscored the importance of nalizing a binding Code of Conduct that will govern territorial conicts in the region. Tan Sang, on the other hand, echoed the Philippine position on the need to nd peaceful resolution to the dispute in accordance with international laws, including the United Nations Convention on the Law of the Sea. In a separate bilateral meeting with Tan Sang, Hu told the Vietnamese leader that parties with conicting claims must avoid taking any unilateral measure that will magnify, complicate or internationalize the dispute to prevent the issue from affecting East Asian cooperation and regional stability. The Chinese leader described the dispute as a chronic headache that should be resolved properly through dialogue and negotiations during his bilateral meeting with the Sultan of Brunei, Hassanal Bolkiah.

He, however, noted that PhilHealth has recorded a reserve fund of P90B in 2010 and today has P103 billion, with a P39 billion net income. Under the approved House Bill 5727, which the DOH and the Department of Finance are supporting, the projected incremental revenue to be collected from tobacco and alcohol is around P32 billion, P28B of which would come from tobacco and P4 billion from alcohol. From the P32 billion incremental revenue, 15% was promised to be used for to-
bacco farmers programs and 85% for universal health care, which is estimated at P24B annually (from the projected P32 billion). The Republic Act 9334, which was enacted in July 2004 increased the excise tax rates imposed on alcohol and tobacco products. The law provides that 2.5% of the revenue will nance PhilHealth services. Recto pointed out that he had to bring the matter in the open because the DOH was asking for the funds when they failed to complete the documents required by the Budget department.

Police chief not quitting
I AM retiring on March 16. This was the reaction of National Police chief Nicanor Bartolome as he faced the media to clear the air of talk of his early retirement. He had gured in controversy over a supposed Malacanang plan to install him as undersecretary of the Interior and Local Government to replace Rico Puno, deputy of the late Jesse Robredo. While Puno resigned from his post, Bartolome appeared to be staying on since a new Interior chief, Manuel Roxas II, was conrmed the other day by the Commission on Appointments. Bartolome, who will be reaching mandatory retirement age of 56 in March 2013, also dismissed speculation that he will be running for an elective position after his retirement. A REPORT produced by an online journal and a public relations company has ranked Manila last in terms of location branding among key Asian capitals. The results of the survey, released by Public Affairs Asia and Ogilvy this week, showed Manila in last place among 16 cities, with a brand value of just 5.6 points, behind Jakartas 5.9 points. The report, Location Branding 2012, highlights brand attributes (or the lack of them) that countries, cities and regions must focus on to attract foreign direct investments and tourism. Many politicians who have been tarred and feathered in ways a lot less severe than Trillanes has been would have slunk away in the hopes that the public forgets about their public immolation. But Trillanes, perhaps because he is so thoroughly clueless about politics, just keeps soldiering on. Yesterday, Trillanes even led a bill in the Senate calling for the creation of a Department of Sports. Like Jim Carreys relentless and implacable character in The Mask, Trillanes seems to be saying to his foes and to everyone else thinking of going against him: Somebody stop me! *** But even if the unrepentant Trillanes goes down in ames, he should still answer questions about his commission to Beijing, where he met 16 times with Chinese ofcials who may or may not be aware that they were not only dealing with a political lightweight but also with someone who had no authority to enter into any meaningful agreement with them in Manilas name. And since there is no more sense in keeping a lid on Trillanes China sojourns because everyone in the country already practically calls him Ambassador, he should be man enough to answer these questions. For starters, Trillanes should declare what ofcial support he received during his short stint as special envoy to China. Did the government pay for his trips, did he pay for them out of his own pocket or did private citizenshere and in Chinashoulder the cost? What agreements did Trillanes make on behalf of his supposed principal, Aquino? What happens now to these pactslike the one lifting the ban on Philippine bananas that Trillanes claims to have singlehandedly engineered and how do they bind the Manila government? How can Trillanes justify meeting with Philippine Ambassador to Beijing Sonia Brady and making all those unsavory and derogatory comments about Del Rosario, not knowing that Brady was steeped in the foreign services esprit de corps that forced her to reconstruct the conversation with the senator? Will the Senate or Malacaang investigate Trillanes, with a view to censuring him or even charging him with treason, as Enrile has alleged? Trillanes, if he wants to come out of this mess a little better off than he is now, must come clean about his short and unusual commission. It is the only honorable way out for him after his bad hair day at the Senate.

Ninoy. Invoking his martial law powers under the 1935 Constitution, if and when confronted with lawless violence, invasion, insurrection, or rebellion, or imminent danger thereof, when the public safety requires it, he issued Proclamation 1081 to crush the rebellion and create a new society. The martial law regime came to be known by that name. I arrived at the Palace early that fateful morning. Inside the Presidents ofce, my ofcial folder was waiting, and the radio-tv crew standing by. I was to read the proclamation and all other announcements by my lonesome, while the Presidents picture loomed in the background. I felt uneasy about it, but I was told this was the decision from on high. However, before we could start, the First Lady entered the scene. She found it most unusual that the nation would be listening to the presidential spokesman, but not to the President. It was absurd. Mrs. Marcos feared it would provoke all sorts of speculation about the Presidents health, with all its unwanted consequences. It was the most sober and perceptive observation we heard that morning, and everyone agreed. So we put it to the President, who welcomed it. The problem though was that no speech had been prepared beforehand. Although I was in charge of all the speech-writing, I had no part in the martial law decision-making, and no opportunity to prepare one. So right there and then I grabbed the electric typewriterthere were no computers yet thenand started pounding. I had no chance to read what I wrote, the page was taken away as soon as it left the typewriter. But the text, for all its defects, turned out to be far less turgid than the proclamation. The freewheeling press proved to be among the rst casualties. Not only were the newspapers closed, many of
my best newspapermen-friends were jailed. Then censorship was imposed. I tried to employ as many of the displaced newspapermen and broadcasters as I could, but not everyone needed or wanted a government job. Certainly not Teodoro Doroy F. Valencia, the dean of Filipino columnists. Having lost his paper, and his column (Over a Cup of Coffee), Doroy created his own forum where he would continue to be heard. This was the daily kaffeeklatsch at the Intercontinental Hotel, which became known as the 365 Club. This has survived all sorts of natural calamities and political bad weather, and will be celebrating its own 40th anniversary tomorrow, under Emil Jurados watch. With its own ideas about how the free press should work, it was not easy for the martial law regime to liberalize. But in the end Marcos saw that even censorship was no helpin order for the foreign correspondents to write favorable things about the country, they had to y to Hong Kong and le their stories from there to show their reports were uncensored. Within months, Marcos lifted the censorship and let the media police their own ranks. The jailed newspapermen were released. Some moved on to Australia, Canada, and the United States. At some point, some columnists started writing paeans to Marcos the way some propagandists today write about the Aquinos. I was disturbed by this. I asked the editors if we could try a short period of honest journalism without anyone trying to drown Marcos in saccharine and incompetent praise. I LOOK forward to the launching of the book of Senate President Juan Ponce Enrile entitled A Memoir. It will be launched on September 27, next Thursday, at the Peninsula Manila, Makati City. The JPE book will be his legacy because he will retire from politics next year and settle down in Cagayan province. Published by ABS-CBN, the book will set right many of the distortions of history during the 19 years of the Marcos regime. The book also contains Enriles breakaway from the Reform the Armed Forces Movement. W h a t s interesting in the Enrile book is his account of the rise and fall of taipans and tycoons known as Marcos cronies. JPE is privy to these stories. These will surely make the book controversial. More than being controversial, however, Enriles book is expected to put things at the right perspective. *** I agree with those who say that President Benigno Aquino III was playing a dangerous game with China when he appointed Senator Antonio Trillanes to do some backdoor negotiations with our giant neighbor. This is in relation to the dispute over some islands in the West Philippine Sea, as Malacaang calls it. Some say Trillanes volunteered for the job, though. Enrile said that Trillanes was a fraud and a coward after the latter stormed out of the plenary session while he was being grilled about his clandestine meetings (15 or 16 times) with Chinese ofcials. Enrile came out with the notes of former Philippine Ambassador Sonia Brady, which had Trillanes calling Foreign Affairs Secretary Albert Del Rosario a war freak and |a traitor. Trillanes was not able to stand the heat. What is Malacaang doing, having a senator like Trillanes participating in the sensitive talks? The President is the sole policymaker and the Foreign Affairs Secretary is the sole spokesman. Philippine ofcials need to speak in one voice. Trillanes calling Del Rosario a war freak and a traitor sends a clear message to China that the Philippines speaks with a forked tongue. Beijing must now be laughing at us. Enrile also called Trillanes a fth columnist, the name used to refer to Spaniards who collaborated with the enemy during the civil war in Spain.
WEDNESDAYS session of the Senate was the dening moment for Senator Antonio Trillanes IV where he was exposed, in the words of Senate President Enrile, as a coward and a fraud. Trillanes stood up to deliver a privilege speech against Enrile and the Senate Presidents supposed bullying on the creation of the new province of Nueva Camarines. He only succeeded, however, in exposing his many pretensions. People have long suspected that Trillanes is unreal especially when the news came out that even while in detention he had the dubious distinction of being one of the biggest spenders among the senators. He rants about public ofcials being free in spending the peoples money but in his stint as senator he proved that he is of the same ilk. Trillanes has many other posturing among them being a senator and expert parliamentarian. He thinks he is such a veteran legislator that he even declared Senate President Juan Ponce Enrile as out of order when Enrile interpellated him. He also wants to be known as a sports leader and he is advocating the abolition of the Philippine Sports Commission. It seems that Trillanes is dreaming of being the head of the new sports body that he wants to be created in lieu of the PSC But it is Trillanes new assumed role as the countrys top diplomat that really

THE Bureau of Customs is now investigating 14 steel makers in Subic, Cebu and Davao after other steel makers complained the companies were allegedly engaged in the technical smuggling of steel from China.
We have acted on their complaint about the alleged undervaluation and subjected the importer to post entry audit and their shipments valuation were referred to the Value Classication Review Committee for review and disposition of the case, Customs Commissioner Ruffy Biazon said on Thursday.
Biazon issued the order after Manila and Luzon-based steel manufacturers complained that manufacturers in Subic, Cebu and Davao that the steel that the companies imported from China are undervalued and may constitute technical smuggling. But Biazon cautioned that in cases of undervaluation, you cannot right away say there is a violation... Brown Co. Inc., the holding company of the Brown Group of Companies, to build a 135-megawatt coal power plant in Iloilo province costing at least P12.5 billion.
A Brown said in a disclosure to the stock exchange the power plant, which will use clean coal technology, was expected to become operational by 2015. A second 135-MW plant is also being considered for future development. The plant is targeted to ll the anticipated tight power supply situation in Panay and the Visayas grids by 2015, as economic activity continues to expand in the area, A Brown said.

LARGE-SCALE miners and the Environment Department are engaged in a word war over the provisions of taxation and contract renewals in the new mining policy. The Chamber of Mines of the Philippines charged that Environment Secretary Ramon Paje was skirting the issue on Executive Order no. 79, after claiming the industry was pressuring him. The industry has never sought any assistance from Paje. Why should there be pressure from the industry? the Chamber asked in a statement issued during the
last day of the Mining Philippine 2012 Conference and Exhibition in Pasay City. [We] are not asking Paje to go against EO 79. [We] have in fact issued a statement welcoming the EO. [The chamber] is against the implementing rules and regulations, specically section 9 with reference to expired mining tenements, the group said. It said the provision was not contained in the EO nor in the draft rules during consultations with the industry on Sept. 7 and that it could have been inserted without the knowledge of the other members of the Mineral Industry Coordinating Council. The chamber also criticized
Paje for stating that the fundamental intention of EO 79 was to protect the state and future generations from the menace of a one-sided approach to minerals resource development. The Mining Act of 1995 provides that mineral agreements shall have a term not exceeding 25 years and renewable for another 25 years under the same terms and conditions without prejudice to changes mutually agreed upon. How can contracts be one-sided when it is his DENR and Mines and Geosciences Bureau that draft the contracts and mining cmpanies are only asked to sign the dotted line? the group asked.

STOCKS fell for the third day, as investors fretted about sluggish Japanese trade gures and Chinese factory output that underscored the weakening global growth.
The Philippine Stock Exchange index, the 30-company benchmark index, shed 22 points, or 0.4 percent, to close at 5,294.97 on Thursday. Value turnover amounted to P4.8 billion. The heavier index, representing all shares, also dropped 8 points, or 0.3 percent, to 3,537.69, as losers outmatched gainers, 92 to 58, with 44 issues unchanged. Only four of the 20 most actively traded stocks ended in the green. Universal Robina Corp., the top pick, increased 1.8 percent to P63.40. Alliance Global Group Inc., the second most actively traded, also rose 1.4 percent to P13.16. Other gainers were Puregold Club Inc. which rose 1.2 percent to P29.90 and A. Brown Inc. which added 8.6 percent to P3.52. Ayala Corp. teamed up with A Brown to build a 135-megawatt coal power plant in Iloilo. Ayala Land Inc., the third most actively traded stock, tumbled 3.3 percent to P23.40. Lepanto Consolidated Mining fell 5.5 percent to P1.21 as the London metals index dropped for the third day. Meanwhile, Asian markets were mostly lower as Japanese data showed the countrys powerhouse export sector was continuing to suffer the effects of a slowdown in Europe and elsewhere. Japans Nikkei 225 index dropped 1.4 percent to 9,108.71. South Koreas Kospi shed 0.9 percent to 1,990.65 and Hong Kongs Hang Seng lost 0.5 percent to 20,721.78. Benchmarks in Singapore, Taiwan, Indonesia and mainland China also fell. New Zealands bucked the trend and rose. Asian stocks had rallied a day before, after the Bank of Japan announced an aggressive monetary easing program in an attempt to spur growth and counter the strength of the Japanese yen. But the market impact of the Bank of Japans move was short-lived, a possible sign that investors are getting stimulusweary. The move came days after the US Federal Reserve revealed it will purchase an average of $40 billion of mortgage-backed securities a month until the economy shows signicant improvement. AGRICULTURAL and livestock products distributor Calata Corp. said it will expand its assistance to Luzon-based rice and corn farmers in line with its bid to help increase farm productivity and protect the environment. Calata Corp. chairman and chief executive Joseph Calata said the company would put up soil testing facilities in its more than 100 stores. The facilities will help farmers determine what type of fertilizer and other farm inputs fit the type of soil in their respective farms, Calata said. The soil testing facility will prevent farmers from buying and applying fertilizers that do not t their farms and which end up reducing productivity and harming the environment, Calata said. This is also expected to generate savings for farmers thus raising their income potential through the right and wise use of farm inputs, he added. The use of the facility will be for free, Calata pointed out.

HAPPY Hour buddies almost choked on their drinks when rumors about former Isabela Gov. Maria Gracia Cielo Grace Padacas appointment to the Commission on Elections started ying. While Padaca has developed the image of a reformist and crusader, skeptics claim she has failed to impress constituents during her term as governor in the northern province, with many saying they doubt if she could convincingly win should she decide to run against the Dys again in the 2013 elections. It can be recalled that a former Isabela congressman has accused Padaca of graft in relation to a P25-million rice project that allegedly beneted a non-government organization. According to the Ofce of the Ombudsman, Padaca (who was then governor) awarded the contract without benet of public bidding and thus deemed the agreement illegal. Of course, Padaca in her defense turned the nger on the provincial board, saying they ratied the contract. But then again, doesnt everyone know that a governor can convince board members to toe the line? A Happy Hour buddy commented. Be that as it may, nosey Comelec bystanders claim that the appointment of Padaca could throw the poll body in disarray once again because of the ladys perceived ties with an anti-automation group that has reportedly been trying to derail automation effortsmuch like the way erstwhile Comelec Commissioner Augusto Gus Lagman did in the past. Its not also farfetched that Padaca may just see a Comelec appointment as an opportunity to pay back those responsible for her fall from grace. For sure, these controversial multibillion ro-ro and lola projects are going to haunt the former administration in the months to come. According to Happy Hour insiders, the companies that spearheaded the ro-ro and bridge projects which Senator Osmea identied as British Mabey and Johnson and French Consortium Eiffel Matiereare allegedly controlled by an inuential party list congressman. This same newbie lawmaker has allegedly been funding tri-media campaigns to convince the Aquino administration about the need to prioritize the construction of steel bridges across the country byof coursethe companies that he allegedly owns but which he has temporarily left under the care of trusted business associates. According to sources, Mabey and Johnson has a rather speckled reputation to start with, having been charged with in 2009 of engaging in overseas bribery and corruption as well as violating UN sanctions by paying kickbacks to Saddam Husseins regime for bridge-building contractsthe rst company ever to be convicted in the UK for serious overseas fraud. On the other hand, Eiffel Matiere has earlier threatened to sue the Aquino government for cancelling 66 of the 72 ro-ro projects entered into during the Arroyo administration. ThenTransportation Secretary Mar Roxas said the government would rather face any lawsuit than saddle Filipinos with a costly project that has been found unnecessary and lacking in economic feasibility. Sec. Paje is skirting the issue: its the last-minute IRR insertion, not EO 79
Shortly after the Chamber of Mines of the Philippines (COMP) branded Section 9 of the implementing rules and regulations (IRR) of Executive Order 79 as patently illegal last September 19, Department of Environment and Natural Resources Sec. Ramon Paje released a media statement lambasting COMP and claiming pressure from the industry. COMP takes exception to Sec. Pajes pronouncements, and wishes to shed light on its position regarding the controversial IRR vis--vis the secretarys media pronouncements: Fiction: Paje claims pressure from the mining industry on the issue of EO 79. He maintains that he cannot go against EO 79 (implying that the industry is against EO79). Fact: Sec. Paje is skirting the issue. COMP is not asking Sec. Paje to go against EO 79, and has in fact issued a statement welcoming the EO. COMP is against the IRR that he signed, specifically Sec. 9 with reference to expired mining tenements, which was not contained in the EO, nor in the draft IRR during the MICC consultation with the industry on September 7, 2012 and perhaps was inserted without the knowledge of the other members of the MICC. The industry has never sought any assistance from Sec. Paje. Why should there be pressure from the industry? Sec. Paje never attended any of the stakeholder consultations of the Mining Study Group that was tasked by President Benigno S. C. Aquino III to draft his administrations Mining Policy (EO 79). He was also not present during the September 7 MICC stakeholder consultations on the IRR. Misleading: Sec. Paje defends the controversial Section 9 of the IRR by arguing that one fundamental intention of EO 79 is to protect the State and the future generation (sic) from the menace of a one-sided approach to minerals resource development, considering the long 50year terms of mining contracts. The Truth: The Mining Act of 1995 provides that mineral agreements shall have a term not exceeding 25 years and renewable for another 25 years under the same terms and conditions without prejudice to changes mutually agreed upon. How can mining contracts be one-sided, as Sec. Paje claims, when it is his DENR and MGB that drafts the contracts and mining companies are only asked to sign on the dotted line? The last-minute insertion to the IRR that is Section 9 is worse than the moratorium on new mineral agreements. The moratorium will be lifted once a new mining revenue scheme has been agreed upon. The renegotiation of mining contracts being required by this provision effectively holds a mining tenement contractor hostage to an inconsistency of a mining policy that only serves as a disincentive to both local and foreign investors. Section 9 of the IRR is patently illegal as it effectively shortens mining contracts to a mere 25 years in violation of Section 32 of the Mining Act. In its statement welcoming the issuance of EO79, COMP praised the Mining Study group for employing the consultative process. Section 9 which was not discussed during the consultation with the industry is a clear betrayal of that process. If Sec. Paje is really for the protection of the State and future generations, why is there still a proliferation of illegal small-scale mining and illegal logging under his watch? Why have gold purchases by the Bangko Sentral ng Pilipinas plummeted by 98% -- caused by smuggling by illegal small-scale miners -- under his watch? Fiction: Sec. Paje contends that government gets only 2% share in mining revenues, which is disadvantageous to government. Fact: Sec. Paje exhibits a basic non-understanding of taxation in the mining industry and the reason behind the moratorium on new mining permits, as prescribed by EO 79. The FTAA mining permit provides for a minimum 50% government share of net mining revenues. No less that the IMF, in their study on Philippine mining taxation, made the statement that the current FTAA regime is not competitive internationally. The MPSA mining permit, while not providing for a minimum government share, results in an effective government share of between 40% to over 50%, depending on the level of metal prices. The actual fiscal contribution of a mining company, which equates to the government share, is not just the 2% excise tax, but all other taxes and fees paid by the contractor as well, including income tax, numerous other taxes and fees plus a 5% royalty to government for those operating in mineral reservations and a 1% royalty to Indigenous Peoples for those operating in Ancestral Domains. The moratorium on new mining permits under EO 79 was precisely crafted to address the issue of taxation. Any increase in the excise tax by an amendment of the National Internal Revenue Code will apply to existing mining contractors. The new provision in Sec. 9 of the IRR is therefore not necessary to address the issue of taxation. In addition, large-scale metallic miners have spent a total of P2.2 billion in projects under the Social Development and Management Program (SDMP) and in environmental protection measures. SDMP initiatives include projects in the areas of education, livelihood promotion, infrastructure, and health and sanitation. Environmental protection measures, on the other hand, include projects in mine waste management, progressive rehabilitation, water quality control, and siltation control, among others. Misleading: Sec. Paje claims that government share in mining taxes is not even enough to pay for the environmental impacts of mining. The Truth: A forester by training, Sec. Paje apparently has not bothered to study the Mining Act of 1995 carefully and thoroughly. If he did, he would not have made a statement like this. The fact is, apart from paying taxes, mining firms set aside funds to support programs aimed at mitigating the impact of mining activities on the environment from pre-exploration, to development, to operation, to decommissioning, to rehabilitation. The Mining Act of 1995 requires mining firms to: implement Environmental Protection and Enhancement Plan, Environmental Work Program, Safety and Health Program, Social Development and Management Program implement the conditions of the Environmental Compliance Certificate form the Multipartite Monitoring Team and set up Environmental Monitoring and Guarantee Funds implement the Final Mine Rehabilitation and Decommissioning Plan and set aside funds for financing post-mining rehabilitation conduct independent environmental audits Misplaced: Paje further defends Section 9 by saying this last-minute insertion to the IRR would enable the government to obtain a larger share through the establishment of mineral reservations. The Truth: Sec. Paje believes conversion of all mining areas to mineral reservations is the silver bullet that will provide government additional revenues from mining. That he believes mineral reservations are a cure all solution again demonstrates his basic lack of understanding of the mining industry and the law. While the executive branch is empowered under the Mining Act to establish mineral reservations, the same law also suggests that such power may only be exercised [w]hen there is a need to preserve strategic raw materials for industries critical to national development or certain minerals for scientific, cultural or ecological value. Revenue generation is not, and cannot be, among the legal bases for exercising the power to declare mineral reservations. COMP stands by its statement that the freezing of the grant of mineral agreements, which effectively extends the moratorium on mining that began in May 2010, is specifically worrisome for the industry. The moratorium has already caused an outflow of foreign direct investments from the sector in 2011, exceeding P10 billion based on figures from the Bangko Sentral ng Pilipinas. COMP, however, reiterates its support for a measure that will give the government additional share from mining and will work with the government in this effort. We are carefully and deliberately studying the mining tax issue, taking into consideration the high risks assumed by mining investors, the instability of global metal prices, and the competitiveness of the Philippines vis--vis other mining jurisdictions worldwide. Our members have never waivered in our support for the Daang Matuwid (Straight Path) thrust of President Aquino. We believe though, that obstacles characterized by incompetent government officials who have reneged on their duties and demonstrated ignorance of the law should be removed from the Daang Matuwid.

GMA Network, Inc. (GMA) ended the month of August on a positive note as it topped rival stations in nationwide TV ratings, according to Nielsen TV Audience Measurement.
Based on full August data (Aug. 1 to 25 ofcial data; Aug. 26 to 31 overnight data), the Kapuso network registered an average of 34 percent in total day (6 a.m. to 12 midnight) household audience shares in National Urban Philippines, 1.3 percentage points ahead of ABS-CBNs 32.7, and 19.2 percentage points of TV5s 14.8. In comparison with the previous month, GMA was the only broadcast company whose total day household audience share across all areas (inclusive of the Visayas-Mindanao regions) increased in August, as driven by improved shares in the evening block (6 p.m. to 11 p.m), where viewing levels are at their highest. GMA remained undisputed and topped all dayparts in the important areas of Urban Luzon and Mega Manila, which represent 77 and 59.5 percent of total urban television households in the country, respectively. In Urban Luzon, Nielsen data show that GMA hiked up its total day household audience share compared to the previous month from 37.1 to 38 percent. ABS-CBN scored only 28.6 percent while TV5 lagged farther behind with 14.1 percent. GMA also maintained its solid performance in Mega Manila, even increasing its total day average from 37.9 percent in July to 39.1 percent in August. On the other hand, ABS-CBN managed 26.4 percent, while TV5 got only 14.9 percent. In the afternoon block (12 noon to 6 p.m), GMA posted double-digit margins in audience share over its closest competitor. GMA beat ABSCBN in the afternoon block by 13.9 points in NUTAM, 22.1 points in Urban Luzon, and 24.8 points in Mega Manila. Meanwhile, in the evening block, GMA almost doubled its audience share lead in Urban Luzon and Mega Manila over ABS-CBN relative to July. GMAs margin over ABS-CBN widened from 1.6 to 4.1 points in Urban Luzon, and from 4.2 to 7.9 points in Mega Manila. In NUTAM, GMA increased its audience share by 2.2 points while ABS-CBNs viewership level remained the same. GMA also dominated the list of top programs in Urban Luzon and Mega Manila. Twenty Kapuso shows gured in the most watched program list in Urban Luzon. These are Kapuso Mo, Jessica Soho 24 Oras, Makapiling Kang Muli, Kapuso Movie Night, Luna Blanca: Ang Ikalawang Yugto, Eat Bulaga, One True Love, Wish Ko Lang, and Kaps Amazing Stories, among others. There were also 20 GMA programs in the list of the 30 top programs in Mega Manila with Kapuso Mo, Jessica Soho topping the list. Other high-rating Kapuso shows in Mega Manila include 24 Oras, Makapiling Kang Muli, Kapuso Movie Night, Luna Blanca, Eat Bulaga, One True Love, Wish Ko Lang, and Imbestigador.
