Assertion of Rights Martin Leon Hunsinger (Hunsinger) asserts all his unalienable rights, privileges and immunities at Natural Law, Common Law and Maritime Law, and all his commercial rights relevant to this state. Hunsinger maintains that this appearance is special and not general as said appearance is made under threat, duress and coercion by Plaintiff. This appearance is made solely for the purpose of claiming any and all of Hunsingers unalienable and constitutionally protected rights. BRIEF No Notice Comes now Hunsinger, demanding notice of declination to plead. Hunsinger has received no Notice of any charges against him. There must be Notice. Smith v. O'Grady, 312 U.S. 329 (1941) (O'Grady). Hunsinger does not waive Notice. Related to this, Hunsinger does not waive Arraignment nor the time period after Arraignment during which certain motions may be filed. Since there has been no Arraignment, that time period has yet to start. Also, Hunsinger does not waive his need to have a reasonable time period to prepare a defense, should STATE ever decide to serve Hunsinger with Notice of any charges against him.
