INFORMATION

I, Daniel T. Satterberg, Prosecuting Attorney for King County in the name and by the authority of the State of Washington, do accuse JOSE R. ABARCA of the crime of Theft in the First Degree, committed as follows: That the defendant JOSE R. ABARCA in King County, Washington, during a period of time intervening between February 24, 2010 through January 8, 2012, with intent to deprive another of property, to-wit: lawful U.S. currency, did obtain control over such property belonging to King County Department of Adult Detention, by color and aid of deception, and that the thefts were a series of transactions which were part of a criminal episode or common scheme or plan or continuing criminal impulse in which the sum value of the property taken did exceed $5,000; Contrary to RCW 9A.56.030(1)(a) and 9A.56.020(1)(b), and against the peace and dignity of the State of Washington. And I, Daniel T. Satterberg, Prosecuting Attorney for King County in the name and by the authority of the State of Washington further do allege the crime involves the following aggravating factor and accuse the defendant JOSE R. ABARCA of committing said offense, that the current offense was a major economic offense or series of offenses, so identified by consideration of the following: multiple incidents per victim, monetary loss substantially greater than typical for the offense, occurred over a long period of time, and the defendant used his

position of trust to facilitate the commission of the current offense, under the authority of RCW 9.94A.535(3)(d). COUNT II And I, Daniel T. Satterberg, Prosecuting Attorney aforesaid further do accuse JOSE R. ABARCA of the crime of Forgery, based on a series of acts connected together with another crime charged herein, committed as follows: That the defendant JOSE R. ABARCA in King County, Washington, on or about November 8, 2011, with intent to injure or defraud, did falsely make, complete and alter a written instrument, to-wit: military orders, and knowing the same to be forged did possess, utter, offer, dispose of and put off as true to King County Department of Adult Detention such written instrument of the following tenor and effect: altered dates to report; Contrary to RCW 9A.60.020(1)(a), (b), and against the peace and dignity of the State of Washington. Young, WSBA #24504 CAUSE NO. 12-1-05510-2 SEA PROSECUTING ATTORNEY CASE SUMMARY AND REQUEST FOR BAIL AND/OR CONDITIONS OF RELEASE The State incorporates by reference the Certification for Determination of Probable Cause in Seattle Police Incident Number 12-79817.

REQUEST FOR BAIL Pursuant to CrR 2.2, the State requests the Court issue a summons directing the defendant to appear in court. As of September 27, 2012, the State is unaware of any criminal history for the defendant. Nonetheless, the defendant was an officer for the King County Department of Adult Detention and submitted false military leave reports to avoid working for over a year. He submitted false reports on multiple occasions. His crimes should be considered as a severe abuse of public trust. Signed this 27th day of September, 2012.
