Corrupt Officers, Developers and Politicians hand in glove to grab the plot reserved for college under Town

Planning Scheme at Borbhatpada, Kastur Park, Borivali West, Mumbai admeasuring about 29,777.30 sq.meters (3,18,403 sq feet). Owned by Municipal Corporation of Greater Mumbai. -------------------------------------------------------------------------------In 1978, by fabricating documents out of 29,777.30 sq meters, 12,015 sq. meters (1,29,290 sq feet) declared as slum for only 77 rooms of 14 houses (Area is actually covered only 1035 sq meters (11,140 sq feet). Further 4544.20 sq meters (48,896 sq feet) is declared as censuses slum, record of huts on censuses slum is not available in any concerned department. In the year 1998 the plot was hypothetically divided into 2. 1 Plot would be developed for Arts and Science, Commerce, Law College and the other as Professional College. Accordingly advertisement was given in the leading newspapers inviting applications from the registered Educational Institutes for giving plot for college purposes on lease basis. Since this was not materialized Joint MC (I) / AMC (WS) was asked to readvertise. The Estate Department Neglected to readvertise till the beginning of 2004. Thereafter SRA was sanctioned to Shrinivas Developers with the blessings of Politicians One of the record available points towards Shri Sunil Tatkare then Minister for State (Urban Development) and Shri. Sitaram Kunte (Present Municipal) the then Additional Municipal Commissioner (Project). As per section 37 (1B) of MRTP Act 1966, SRA cannot be developed on final plot which is reserved for designated purpose (in this issue College) without inviting objections from the general public, without the approval of government and without sanctioning by the government which is mandatory requirement. Secondly as per 88 (a) of MRTP Act 1966 on and after the day on which final scheme come into force all lands required by Planning Authority, shall unless it is otherwise determined in such schemes vestes absolutely in the planning authority free from all encumbrances. If this is the case how the hutments were not shifted when the final scheme came into force. It seems that even paper advertisement by society/ developer was not given for the development of SRA scheme. Even CEO of SRA Authority has not given notification in the newspaper for the approval of SRA. As per the record available Chairman of the improvement committee Shri Yogesh Sagar and Shri Ashish Shelar also called on to convey their recommendation in favor of the slum redevelopment. Which shows even in the BMC House the advertisement for the college was not cancelled and SRA was approved on college reservation plot. As per the record there is no Panchnama Report, No Demand registered and even no Inventory Report. Then how table survey of 624 hutments (which number is required for SRA as per density) was made, which is the biggest fraud. The letter of 2004 of Shri Gopal Shetty MLA (BJP) of Borivali shows that he strongly advocated for the college on entire plot By putting his physical security at stake and also ready to leave politics and to settle in his native place, and asked to give him a ticket of Rs.500 if SRA and Mall will be constructed on the college plot. But now the same MLA advocates on behalf of the developer. There is record available for receiving donation by Bharatiya Janta Party from the developer. Though issue of eligibility of hutments are pending the same MLA along with the then Senior Inspector Police, Developers and other Netas gives the keys to the tenements in the rehabilitation building without the permission of SRA.

The High Power Committee in the appeal allowed Satra Properties (I) Ltd (the party to Shrinivas Developer for the joint venture) as intervener though SRA Authority are not recognized them as developer and who are also not in SRA records. Even High Power Committee overlooked the affidavit they filed including the papers concerned with the loan of 50 Crore rupees taken by mortgaging structures on BMC plots by submitting forged documents to The Indian Bank. The High Power Committee in its interim order dated 5th June 2010 stated Prima Facia, this case has elements of offences that may fall within the ambit of corruption and economic offenses. Regarding the criminal angle of present case the matter may be listed along with 86 number of ACB complaints which are being looked into by this committee as per High Court Order in PIL No 156 off 2006 and the matter will be taken up for the hearing on priority. But as per the judgment pronounced on 21st May 2011 the appeal to HPC was disposed of since nothing survives in the appeal. On 29th September 2011 ie. during the pendency of PIL filed in the High Court in this case, full OC for 2 rehabilitation buildings and part OCC for the sale building No.8 are given by the SRA Authority which is objectionable. Though the PIL is filed for the cancellation of SRA, which is illegally sanctioned, and taking back the college plot by the Municipality after demolishing all illegal construction and using it for college purpose only, at present the hearing is going on in the High Court regarding the eligibility and legality of huts. Since the interim stay was not granted in the High Court the petitioner Smt. Meera Kamath aged 65 years wanted to file SLP in the Supreme Court. Being herself a volunteer of India Against Corruption contacted Mumbai Convener Shri Mayank Gandhi for the help of a Lawyer in the Supreme Court, since she was assured full support of IAC in this case. But I understand that Shri Mayankji refused to help informing that he doesnt know any lawyer of Supreme Court. This matter was also brought to the notice of Shri. Arvind Kejriwal and other IAC Volunteers. Whether IAC is helping only the selected persons like Mrs. Anjali Damania? Whether help or no help Mrs. Meera Kamath is determined to fight for the college plot till the end. At present she is having Police protection, Are you ready to help her? Record shows matter also referred many dignitaries like Shri Sharad Pawar, Chief Minister, Commissioner of Police, Shri Eknath Kadse etc.
