Steve, I am the Governors POC for interaction between the state of Washington and the Department of Homeland Security (DHS). The attached Memorandum of Agreement is the template for an Agreement DHS is entering into with all states and territories. Please work with the State Attorney Generals office to identify the state authorities that should be inserted in the MOA as well as amendments or revisions you or the Attorney General believe should be made to the template. Upon completion of a final draft prepared by you and your staff in consultation with the Attorney Generals office, please forward it to me and I will circulate it to all board members through the Chair (Chief Batiste). Upon governing board coordination and formal approval, I will then submit the signed MOA to DHS. In the interim, please send me an electronic copy of all WSFC governing documents

Dear MG Lowenberg, Last summer the Department started an effort to have Memorandums of Agreements (MOAs) signed between the Department and the States regarding Department of Homeland Security personnel deployed to fusion centers such as the Washington State Fusion Center (WSFC). The MOA was the product of discussions between the Department and our state and local homeland security partners regarding the need to formalize the assignment of DHS personnel to work at fusion centers and facilitate a robust information sharing environment. Please take the following steps upon review of this document: Insert Relevant State Authorities: Section II Authority includes a placeholder for applicable authorities. Review to Ensure that All State Equities are Reflected: Confirm that the MOA addresses all state concerns related to the assignment of I&A staff at a fusion center. Provide all changes to DHS for final review. Prior to signing, the DHS Office of Intelligence and Analysis will review any changes submitted and coordinate the final version of the agreement for signature. Signature by Appropriate Signatory Authority: Identify an appropriate authority that may sign the agreement on your behalf once the agreement is finalized.
