DECLARATION OF ERIC A. MULLER IN SUPPORT OF THE J> ACA
TRUST CLAIM OF MULLER TRADING COMPANY, INC.
I, Eric A. Muller declare,
1. I am the Owner of Muller Trading Company, Inc. (hereinafter referred to as
"Claimant"), and I file this Declaration and declare under penalty of perjury that the following
are true statements and that the attached documents are true and correct copies or original
documents, which are filed with this Declaration for the purpose of supporting Claimant's PACA
claim as a beneficiary of the trust created against, Delta Produce, LP (the "Debtor") in this case
pursuant to the Perishable Agricultural Commodities Act ("PACA"), 7 U.S.C. 499a, et seq. and
the Code of Federal Regulations implementing the PACA promulgated by the Secretary of the
United States Department of Agriculture ("USDA"), 7 C.F.R. 46.46, and I am authorized to
make this Declaration and I am competent to testify at trial, if necessary, regarding the
statements made in this Declaration.
2. The sales transactions between Claimant and Defendants are based on the
following payment term:
Payment was due within ten (21) days after the day on which the produce was
accepted as provided for in the PACA Regulations, 7 C.F.R. 46.2(aa)(5).

agreement, if any, providing for such payment terms are attached to this
Declaration as Exhibit
3. The Claimant sold perishable agricultural commodities (hereafter "Produce") on
credit to the Debtor as described in the chart attached to this Declaration as Exhibit A.
4. The Debtor received and accepted the Produce identified in Exhibit A and no
adjustments have been made on the invoice amount except as listed thereon.
A. In the chart, "Invoice Number" refers to the number under which the Claimant
sold the commodity to Debtor. "Date of Transaction" refers to the date which begins the
payment term between the parties. (For example, if the payment term is the regulatory ten (1 0)
days from acceptance terms, the date would be the date Defendants accepted the Produce; if the
payment term is written twenty-one (21) days from shipment, the date would be the date of
shipment.) "Payment Due" refers to the date payment was due based upon the payment terms
between parties. "Notice Date" refers to the date Claimant preserved its P ACA Trust rights.
''Elapsed Days" refers to the total number of days that have passed since the Payment Due date.
"Invoice Amount Due" refers to the amount owed and remaining unpaid, whether or not it
qualifies for trust protection. "P ACA Trust Amount" refers to the amount owed and remaining
unpaid qualifying for trust protection pursuant to the provisions of the PACA. (To qualify, the
elapsed days must be thirty (30) days or less.)
5. The Claimant preserved its PACA trust interest against the Debtor:
D by serving Trust Notices upon the Company (7 U.S.C. 499e(c)(3))
0 by including statutory required language on Claimant's invoice or other billing
statement (7 U.S.C. 499e(c)(4)).

6. On December 16, 2011, Claimant sent Debtor its Invoice via U.S. Mail and/or
facsimile.
7. True and accurate copies of Claimant's unpaid invoice for the produce it sold to
the Debtor is attached hereto as Exhibit B to this Declaration.
8. Claimant's unpaid invoice contains additional contract terms that provide for the
recovery of the attorneys' fees necessary to collect payment.
9. Claimant's unpaid invoice contains additional contract terms that provide for the
recovery of interest at the agreed rate of 1.5% on all unpaid balances.
10. The Debtor never objected to the Claimant's additional contract terms providing
for the recovery of interest and collection costs, including attorneys fees.
11. The current total amount past due and unpaid from Defendants totals $39,083.10,
of which $39,083.10 qualifies for PACA trust protection.
12. Claimant's PACA Trust Claim is comprised of past due and unpaid invoices in
the principal amount of $24,573.50, Claimant's contract right to recover pre-judgment interest, at
the agreed rate of 1.5% per month, in the current amount of $368.60 and Claimant's contract
right to recover costs of collection, including attorneys' fees, in the amount of $14, 141, which is
current through December 31, 2011.
13. Claimant provided the following additional information and documents that it
believes may be necessary and helpful for the just determination of its claim.

The penalty for presenting a fraudulent claim is a fine of not more
than Five Thousand J)ollars ($5,000) or bnprisonment for no more
than five (5) yean, or both. 18 U.S.C. 152.
