NOTICE OF PRESENTMENT OF FIRST AND FINAL FEE APPLICATION OF NEWMARK & COMPANY REAL ESTATE, INC., REAL ESTATE BROKER FOR THE CHRISTIAN BROTHERS INSTITUTE, DEBTOR-IN-POSSESSION, FOR SERVICES RENDERED PURSUANT TO SECTIONS 328 AND 330 OF THE BANKRUPTCY CODE PLEASE TAKE NOTICE, that The Christian Brothers Institute, debtor and debtor-inpossession (the Debtor), through its undersigned counsel, will present the annexed Final Fee Application dated April 23, 2012 (ECF No. 293), requesting entry of an order awarding Newmark & Company Real Estate, Inc., $390,000 in brokerage commissions with respect to the sale of the real property known as and located at 74 West 124th Street, New York, New York, to the Honorable Robert D. Drain, United States Bankruptcy Judge at his chambers located at the United States Bankruptcy Court for the Southern District of New York, 300 Quarropas Street, White Plains, New York on the 21st day of May, 2012 at 10:00 a.m. (the "Presentment Date"). The Final Fee Application is annexed hereto.

PLEASE TAKE FURTHER NOTICE, that objections, if any, to the Final Fee Application must be in writing and must be served upon the undersigned attorneys for the Debtor with a copy to the Chambers of the Honorable Robert D. Drain, so as to be received at least one (1) week prior to the Presentment Date and filed with the Clerk of the Bankruptcy Court. PLEASE TAKE FURTHER NOTICE, that if objections to the Final Fee Application are timely served and filed, the Court shall schedule a hearing on notice to consider the Final Fee Application and any objections thereto.
