NOTICE IS HEREBY GIVEN that an appeal was filed on August 31, 2007 from an order entered by Judge Steven W. Rhodes on July 18, 2007 (confirmation order) . This appeal has been assigned to Judge Gerald Rosen , and assigned a civil case number of 07cv13713 All subsequent pleadings regarding this appeal should have the bankruptcy court number, adversary number (if any) and the civil case number. Pleadings such as (1) Designation of Record, (2) Statement of Issues on Appeal, and (3) Motion for Stay Pending Appeal or other Relief shall be filed with the Bankruptcy Court. If the original motion for stay or other relief is not obtained in the Bankruptcy Court, the motion can then be filed with the District Court, but the motion must state why relief was not obtained in the Bankruptcy Court. Pursuant to Bankruptcy Rule 8006, within 10 days after the filing of the notice of appeal, entry of an order granting leave to appeal, or entry of an order disposing of the last timely motion outstanding of a type specified in Rule 8002(b), whichever is later, the appellant shall file with the Clerk of the Bankruptcy Court and serve on the appellee a designation of the items to be included in the record on appeal and a statement of issues to be presented. Any party designating items to be included in the record must provide copies of all the items to the Clerk of the Bankruptcy Court within 10 days from the date of this notice. If the party does not provide the copies, the Clerk will make the copies at the expense of the parties. Briefs of the appellant and appellee shall be filed with the Clerk of the District Court. If the record designated by any party includes a transcript of any proceeding or a part thereof, the party shall immediately after filing the designation deliver to the Clerk of the Bankruptcy Court a written request for the transcript in triplicate on the transcript order form available in the intake section of the Clerk's Office. Failure to comply with the filing of the designation of record and the statement of issues in the time prescribed by the rules and failure to comply with the transcript requirements may result in the dismissal of this appeal by the District Court pursuant to Bankruptcy Rule 8001(a).
