REQUEST FOR PAYMENT OF ADMINISTRATIVE CLAIM Pursuant to the Notice of Effective Date of First Amended Joint Plan of Collins & Aikman Corporation and Its Debtor Subsidiaries and Related Deadlines, Notice of Administrative Claims Bar Date and Deadline for Final Fee Application dated October 12, 2007 and Sections 365(d)(3) and 503(b)(1) of the United States Bankruptcy Code (the Bankruptcy Code), 16 Industrial Park, LLC (the Creditor), by and through its attorneys, hereby files this Request for Payment of Administrative Expense Claim (the Claim). In support hereof, Creditor respectfully states as follows: 1. On September 16, 2004, the Creditor and Collins & Aikman Automotive

Interiors, Inc. (the Debtor) entered into a lease agreement (the Lease) regarding the property commonly known as 16 Industrial Park Drive, Dover, New Hampshire 03820 (the Leased Premises). 2. The Lease provided for, inter alia, payment of basic rent (as defined in paragraph

6 of the Lease); additional rent (as defined in paragraph 7 of the Lease); unpaid real estate taxes, insurance, water bills, utilities, and similar items (as provided for in paragraph 9 of the Lease);

and recoverable costs of maintaining the premises, including attorneys fees (as provided for in paragraphs 10, 15, 20 and 21 of the Lease). 3. The Leased Premises, together with two other related sites in New Hampshire

belonging to the same Creditor and used by the Debtor, are the subject of ongoing environmental remediation and costs resulting from the use of the Leased Premises by the Debtor. 4. On May 17, 2005, the Debtor filed a voluntary case under Chapter 11 of the

Bankruptcy Code. 5. The Debtor rejected the Lease on August 7, 2007. The Debtor continued to use

the Leased Premises up until after that time. 6. Costs incurred under the Lease from May 17, 2005 to August 7, 2007 include:
Real estate taxes (4/1/07 - 8/7/07): City of Dover water: Public Service of NH (electric): NH DES: Environmental costs: Legal costs: Total: $10,772.531 $169 $900 $2,160 $1,655 $42,355.682 $58,012.21

The City of Dover bills for real estate taxes in arrears. The bill for 4/1/07 through 9/30/07 represents a period of 183 days and is for $15,281.96. The Debtor is responsible for its proportionate share of this bill, and the calculations are as follows: 4/1/07 through 8/7/07 (129 days); 129/183 x $15,281.96 = $10,772.53. The total legal costs in connection with environmental remediation and other costs arising under lease in connection with the leased properties at 16 Industrial Park Drive LLC, 74 Industrial Park Drive LLC and 85 Industrial Park Drive LLC, Dover, NH, for the period of 5/17/05 - 8/7/07, is $241,068.18. Because the three entities were all leased from the same debtor, the legal bills, for the purposes of these calculations, were apportioned to each property based upon its square footage. The amount of these bills apportioned for 16 Industrial Park, LLC is 17.57%, and the calculations are as follows: .1757 x $241,068.18 = $42,355.68.

WHEREFORE Creditor respectfully requests that the Court enter an order directing the Debtor to pay the Creditor as an administrative expense pursuant to Sections 365(d)(3) and/or 503(b)(1)(A) of the Bankruptcy Code the sum of $58,012.21, plus attorneys fees and other expenses incurred by Creditor in connection with this request, and granting Creditor such other and further relief as may be just and necessary.
