RESPONSE IN OPPOSITION TO CLAIMANT DANIEL DETKOWSKIS AMENDED MOTION FOR TEMPORARY RELIEF FROM PERMANENT INJUNCTION TO PERMIT PROSECUTION OF PENDING PERSONAL INJURY ACTION The Collins & Aikman Litigation Trust (the Trust) responds as follows to Claimant Daniel Detkowskis (Claimant) Amended Motion for Temporary Relief from Permanent Injunction and to Permit Prosecution of Pending Personal Injury Action: 1. On November 7, 2008, this Court referred Claimants claim to the United States

District Court for the Eastern District of Michigan for a determination on the appropriate venue to try Claimants claim. [Dckt. #10183.] Claimant stipulated to this relief. [Dckt. #10155.]

On November 20, 2008, Claimant filed the instant Motion requesting that this

Court lift the stay on pending actions so that Claimant can be permitted to proceed with its action against the Debtor. [Dckt. #10214.] Claimant did not limit the relief it requested, but in the body of its Motion Claimant indicates that it wishes to temporarily lift the permanent injunction in order to obtain pertinent discovery and liquidate its claim against Debtor. [Dckt. #10214 at 11.] 3. The relief requested is unlimited in its scope. Claimant is therefore asking the

Court to allow litigation to proceed in Shiawassee County without allowing the parties to present their arguments for maintaining the action in the United States District Court for the Eastern District of Michigan. This Court has already concluded, pursuant to 28 U.S.C. 157, that it does not have the authority to decide where this action should proceed. 4. The Trust does not object to limited discovery on this matter. The Trust offered

to stipulate to a plan of discovery, similar to what is required by Rule 26(f) of the Federal Rules of Civil Procedure and Rule 7026 of the Federal Rules of Bankruptcy Procedure, but Claimant refused. Despite the fact that this claim is still under the jurisdiction of the Federal Courts, Claimants counsel indicated that she is not really interested in limiting the scope of discovery, and rejected the Trusts offer. (Ex. A.) 5. Unlimited discovery has a serious potential for abuse. The Trust is willing to

participate in discovery provided that Claimant agrees to a plan for discovery prior to initiating discovery (as every federal action and adversary proceeding requires). Without such an

agreement, Claimant could proceed under the Michigan Court Rules, which have a much broader scope such as unlimited interrogatories. Given that the claim in question appears quite limited (one instance of alleged injury arising from a single purported transaction), the only conclusion

that can be reached by Claimants refusal to limit discovery is that Claimant does not intend to use discovery to actually uncover the facts of this case, but Claimant intends to use discovery to harass the Trust in hopes of obtaining a larger liquidated value on the Claim than Claimant would otherwise be entitled to.
