Acceptance Letter
Dear Valued Client, Congratulations! We would like to take this opportunity to welcome you to the Payless Financial Group. We want to take a moment to thank you for choosing PFG and applaud you on your first step towards becoming debt free. Our courteous and knowledgeable staff is here to help you during every phase of your program. Thank youfor taking a few moments to read through this acceptance package. We have received your completed contract and related information and accepted you into our Debt Restructuring Program. It is extremely important for you to understand that the program will not work without your patience and full cooperation. One of the first steps you need to take is to go straight to your bank and give them the bank letter included here. This letter is designed to get your bank to cooperate and work with you to put a stop on future drafts on your account being made by your payday lenders. There is no guarantee that the bank will stop all drafts, but this letter informs them that you have an attorney who is assisting you in verifying if these debts are valid, the correct amount owed, and assisting in restructuring future payments to them. Tell the bank you are relying on them to help you get these accounts straightened out and that placing a hold on any future debits is the first step. This will allow YOU to take back control of your bank account and not have your lenders control your account. Also attached is a list of frequently asked questions regarding your individualized Debt Restructuring Program as well as a complete discussion of the Fair Debt Collections and Practices Act and how we will help you if your rights have been violated. Some collection agencies can be very hard to locate once they have violated this federal law, so we need your help early in the process to ensure we have valid contact information on your lenders. Simply inform the caller that you are experiencing some financial difficulties and will send them money as soon as possible. Politely ask them for their name, their phone number, their fax number, and email address, and then end the call quickly but politely. You will have a better chance of getting them to give you this contact information if you simply tell them you will need it to send them money in the future. How the Payday Debt Reduction Program Works What to Expect


Payless Financial Group thanks you for allowing us to help you achieve a lifestyle that is free from the pressures of having too many payday loans or cash advances. We recognize that you had to make a choice in selecting our firm and we will not stopassisting you until your payday loans are paid off or your lenders have agreed to stop pursuing you. The process of achieving this debt-free lifestyle does take some time and will not happen overnight. It is a very achievable goal and well worth the time and effort we both commit to it. Once your payday loan debts are a thing of your past, you will find yourself in a position to begin working toward true financial independence. You have taken the first step to accomplish all of this! We have already begun working on how we will best assist you in settling these payday loan balances. Each and every client enrolled has their own unique financial circumstances and their own unique debt portfolio. You have already been assigned a personal team of professionals who reviewed your debt portfolio and are beginning to develop a personal payday loan settlement program just for you. Your program may change over time as circumstances change, but you will always be able to speak with a knowledgeable customer service representative regarding your program. Some additional information from you is needed to help us create the most viable and manageable debt settlement plan possible. Your Payless Welcome Kit contains some very important forms that will you need in order to begin the next steps in the program. They are as follows: 1. Bank Letter. This letter can be very important in getting your bank to work with you to put a stop to automatic bank drafts which will allow the time needed for the law firm to work with your creditors. We highly recommend you take this letter to your bank and ask to speak with the branch manager. They have the knowledge and training to help you regain control of your bank account. Validation of Debt Request. Payless Financial Group will be sending this document to each of your lenders in order to determine exactly how much the lender is saying you owe. We will also be requesting that the lender provide us with proof that they are legally licensed to lend in your state or to collect in your state if the debt is now with a collection company as well as to certify that any interest or fees being charged do not exceed state limits. The validation of request included here is a sample so that you know what will be sent out to each of your creditors. You will be receiving a copy of each of these validation requests as they are sent.

Creditor Information Sheet. In order for the payday debt reduction program to work efficiently we must have accurate contact information for your creditors. Sometimes this can be very difficult to collect as many creditors do not want to provide you with physical addresses, fax numbers, or email addresses. However Payless Financial Group needs some contact information to send the validation of debt requests to as well as future settlement offers. Please fill this out with all the information you currently have available. Its very important that you complete and return this form and fax it back to us at (877) 410-0031. If you do not have all the information available today we will send you reminders to get the information to us in the future. Creditor Call Log. Use this form to track and record creditor names, names of individuals, dates, time and frequency of creditors that attempt to contact you. Record a brief summary of the call. Information on this form may be invaluable if a collector is in violation of the Fair Debt Collection Practices Actdescribed below. A summary of the FDCPA rules is also included for your information. If you are receiving abusive phone calls as described in the Act, send in this information to Payless Financial Group so that a determination can be made as to whether or not to engage a third party to sue the violator. Letter of Representation. This letter will be provided to your creditor(s) in the event they request proof that Payless Financial Group has been hired to assist you with your payday debt problems. It is included here as a matter of reference to you and no action is required on your part. Fair Debt Collections Practices Act. The Fair Debt Collections Practices Act (FDCPA) is a federal law designed to protect all consumers against certain debt collection practices. It prohibits debt collectors from using dishonest and abusive methods of collecting monies owed by you. It is provided to you here as a reference of your rights and to know if they have been violated. Frequently Asked Questions. These are questions that arise in the course of the program and are provided to give you answers in a quick and timely manner. We do encourage you to call and speak with a customer service representative anytime you have a question that needs to be addressed.

Our client maintains the above referenced account at your institution. In connection with this account, they previously authorized your institution to electronically debit their account to make payments to one or more Payday Loan lenders. The extraordinary high interest rates associated with Payday Loans and other financial conditions facing our client have overwhelmed them. Given their financial circumstances, our firm has been retained to lend assistance. We need your help so that we can both best serve the interests of our mutual client. Based upon our analysis, we believe the Payday loans for which our mutual client gave authorization for electronic fund transfers from your institution were granted through unlicensed lenders or lenders charging an interest rate in excess of state usury laws. As you may be unaware, there are specific licensing requirements for Payday Loan activity in __________. Payday Loans made by unlicensed lenders may be illegal, voidable or invalid. In addition, we have reason to believe some of the provisions of the loan documentation for the Payday Loans where there is an authorization for electronic funds transfer from your institution may not comply with applicable laws. Accordingly, any authorization to debit the above referenced account could also be invalid. To help us determine the validity of the Payday Loans where there is an authorization for electronic funds transfer with your institution, and on behalf of our mutual client, we are requesting your institution to immediately stop all future debits from these lenders in accordance with Reg E Guidelines (discussion follows). You might also need to implement a hard hold, ACH block, deposit only, or any other procedure your institution follows in circumstances such as these to accomplish the same outcome. It is critical that these steps be taken immediately. Time is of the essence. The faster this is accomplished, the faster we will be able to make an assessment and help our mutual client. If your bank does not follow the rules contained in Reg E for stopping automatic pre-authorized drafts, please provide our client with a written response as to why you do not. Sec. 205.10 Preauthorized transfers.

(c) Consumers right to stop payment--(1) Notice. A consumer may stop payment of a preauthorized electronic fund transfer from the consumers account by notifying the financial institution orally or in writing at least three business days before the scheduled date of the transfer.

(2) Written confirmation. The financial institution may require the consumer to give written confirmation of a stop-payment order within 14 days of an oral notification. An institution that requires written confirmation shall inform the consumer of the requirement and provide the address where confirmation must be sent when the consumer gives the oral notification. An oral stop-payment order ceases to be binding after 14 days if the consumer fails to provide the required written confirmation.
