Search Report

This search report is given at the instance of Mr. Kartikeyan Vishwanathan Aiyyar R/at Suyog apartment near Kirti Hospital Pimpri Waghere Pune 17. I have investigated the title of the flat property which is more particularly described in the Schedule of Property written hereunder. & I have pursued the available title deeds. In the office of Sub Registrar Haveli. That during the search of the records I have came across the following transactions which are as under:History of the property
I) Survey no .309/5/4, City Survey no 745 Pimpri Waghere .

1. That said property was owned by Shri Nathu Maruti Ghumatkar

who expired on 13/10/1990. And left behind his wife, three sons and one daughter as his legal heirs and accordingly their names that is Shri Shankar Nathu Ghumatkar, Shri Manohar Nathu Ghumatkar, Shri Pradeep Nathu Ghumatkar, Smt. Savitribai Chhabubai and Sau Kamla baban Shinde were mutated in the 7/12 extract as owners vide Mutation Entry No 5131.

2. That Shri Manohar Nathu Ghumatkar and others entered into

Development Agreement and registered Power Of Attorney with Shri Ramesh Harjasmal Dakhneja.

3. That Shri Ramesh Harjasmal Dakhneja with the consent of owner

assigned his development rights to M/s Prasoon Constructions on 29/04/1995 and authorized him to carry on development work.

II)

Survey no .309/5/5, City Survey no 743 Pimpri Waghere .

1. That

said property was owned by Shri Laxman Krishna Gawandalkar who sold it to Shri Tukaram Rajaram Sawant and then his name was recorded as owner in the 7/12 extract as owners vide mutation entry no 4909.

2. That on 31/5/1995 Shri Tukaram Rajaram Sawant conferred his

development rights to M/s Prasoon Constructions on 29/04/1995 and authorized him to carry on development work.

III) Survey no .309/5/1, City Survey no 744 Pimpri Waghere .

1. That said property was owned by Shri Vithal Punaji Desai and

others.

2. That said property was given for development Shri Vithal Punaji

Desai and others. To M/s Prasoon Constructions on 31/05/1995

and authorized him to carry on development work and dispose of the tenements as per his will and wish to purchasers on ownership basis.

IV)

That M/s Prasoon construction preferred joint building plan for all the three properties aforesaid, after amalgamation and got joint plan sanctioned from P.C.M.C vide commencement certificate bearing no BP/PIMPRI/71/1995 on 19/08/1995 which was subsequently revised by no BP/PIMPRI/48/96 on 20/06/1996.

V)

That Mr. Shashikant Vithoba Patil had purchased flat no 1 in C wing of area admeasuring 1260 sq.ft. with terrace area of 300 sq.ft. for total consideration of Rs 7,00,000/- and got Articles Of Agreement registered in the office of Sub Registrar Haveli No. 5 Vide Document No. 16/1998.and his name was recorded in Municipal corporation.

VI)

That thereafter Mr. Shashikant Vithoba Patil had sold said flat due to financial problem to Mr. Uday Bhausaheb Waghere and had received part payment against said flat and thereafter he could not arrange for remaining amount so Mr. Shashikant Vithoba Patil decided to sell the said flat to Mr. Kartikeyan Vishwanathan Aiyyar vide Deed Of Assignment registered in the office of Sub Registrar Haveli No 5 bearing Document No 782/2012 which was registered on 20/1/2012. And received full and final consideration of Rs 27, 00,000/- (Twenty Seven Lakh only).

VII)

That Mr. Shashikant Vithoba Patil had obtained Home Loan from Canara Bank vide A/c no. 031677310961 which was closed by Prospective buyer Mr. Kartikeyan Vishwanathan Aiyyar on 7/1/2012.

VIII)

That thereafter Mr. Kartikeyan Vishwanathan Aiyyar vide Deed Of Assignment registered in the office of Sub Registrar Haveli No 5 bearing Document No 966/2012 which was registered on 24/1/2012. Got released every right of Mr. Uday Bhausaheb Waghere. And returned him his money paid as earnest towards said flat.

IX)

That thereafter Mr. Kartikeyan Vishwanathan Aiyyar became the absolute owner of the said flat and acquired peaceful and vacant possession from Mr. Shashikant Vithoba Patil.

X)

That thereafter Mr. Kartikeyan Vishwanathan Aiyyar has entered into Agreement to sale with Mr. Ganesh Prabhakar Wani and got it registered in front of Notory Public on 26/10/2012 and Received Rs. 5,00,000/- in cash as earnest and granted permission to issue public notice for title verification.

OPINION

1. That I have perused Search Report given by Sr. Advocate Ajay K

Dixit in which he has considered the documents in the respect of the lands having survey no 309/5/4,309/5/1 and 309/5/5 bearing city survey no 743,744 and 745 of the Pimpri Waghere Taluka Haveli Dist Pune i.e. agreements property cards and 7/12 extracts and maps prepared by City Survey Officer.

2. That, I have gone through documents i.e. Development Agreements

Power of Attorneys and Sale Deeds , necessary Mutation entry and taken the search with Sub Registrar office for the last 15 years and therefore through all the records provided and available in proper condition in offices of Sub Registrar office, some of record were available and other were in torn condition some of them were out for binding based upon this , According to my opinion Mr. kartikeyan Vishwanathan Aiyyar is having Clean Clear and Marketable title and

sufficient interest in the light of records available for Search of below mentioned property.

Schedule of Property

All that Flat No1 in C Wing of Project Name PRASOON PALACE Bldg, on 1st Floor, having Carpet area admeasuring about 1260 Square Feet i.e. 117 sq.mtr, along with terrace admeasuring 300 sq.ft that is 27.88 sq.mtr etc. situated Pimpri Waghere In the building constructed on aforementioned properties.
