Plaintiff Emeco Industries, Inc. (Plaintiff), and Defendants Restoration Hardware, Inc. and Gary Friedman (Defendants) hereby stipulate through their respective attorneys as follows: WHEREAS, Plaintiff filed a motion for a preliminary injunction on October 10, 2012, Dkt. No. 10; Defendants filed a response to the motion for a preliminary injunction on November 16, 2012, Dkt. No. 26; Plaintiff filed a reply on November 30, 2012, Dkt. Nos. 37, 38, 39; and Defendants filed a motion for leave to file a surreply on December 7, 2012, Dkt. No. 42; WHEREAS, Plaintiff intends to file an opposition and/or response to Defendants motion for leave to file a surreply; WHEREAS, the hearing date on Plaintiffs motion for a preliminary injunction is currently set for December 14, 2012 at 9 a.m.; WHEREAS, the parties are presently in settlement discussions in an attempt to resolve their dispute without the Courts intervention; WHEREAS, the parties jointly request a short continuance of the hearing date on Plaintiffs motion for a preliminary injunction to allow the parties to continue their settlement discussions; WHEREAS, the parties are aware that the typical day for civil law and motion hearings for the Court is Friday, but counsel for Defendants has a child scheduled for surgery on Friday, December 21, 2012; and WHEREAS, the parties respectfully request that the hearing be on Thursday, December 20, 2012 at 9 a.m. or at a time thereafter that is convenient for the Court, or another date during that week that is convenient for the Court besides Friday, December 21, 2012. I, Jonathan H. Blavin, hereby declare: 1. I am an attorney with the law firm Munger, Tolles & Olson LLP, counsel

of record for Emeco Industries, Inc. (Plaintiff) in the above-entitled action. I am licensed in the State of California and admitted to practice before this Court. I make this declaration based on my personal knowledge, and, if called upon as a witness, I could and would testify competently as to the matters set forth below. I submit this declaration in support of the parties joint stipulation to continue the hearing on Plaintiffs motion for a preliminary injunction until December 20, 2012. 2. Plaintiff filed a motion for a preliminary injunction on October 10, 2012,

Dkt. No. 10; Defendants filed a response to the motion for a preliminary injunction on November 16, 2012, Dkt. No. 26; Plaintiff filed a reply on November 30, 2012, Dkt. Nos. 37, 38, 39; and Defendants filed a motion for leave to file a surreply on December 7, 2012, Dkt. No. 42. Plaintiff intends to file an opposition and/or response to Defendants motion for leave to file a surreply. 3. The parties are presently in settlement discussions in an attempt to resolve

their dispute without the Courts intervention. Accordingly, the parties jointly request that the court continue the hearing on the motion for a preliminary injunction until the week of December 17, 2012 to give the parties additional time to engage in settlement talks. 4. Defendants counsel has informed me that one of their attorneys is

unavailable on Friday, December 21, 2012, as her son is scheduled for surgery that day. While Fridays are typically days for civil law and motion hearings, the parties respectfully request that a hearing be rescheduled on Thursday, December 20, 2012, or a prior day during the week of December 17, to accommodate defense counsels schedule. 5. The parties previously entered into a stipulation regarding the briefing

schedule for Plaintiffs motion for a preliminary injunction and hearing date, Dkt. No. 17, and a stipulation regarding a continuance of the initial case management conference, which the court granted on November 20, 2012. Dkt. No. 30.
