RESIDENTIAL LEASE AGREEMENT BETWEEN SARAH WALLACE & MAGDALENE FLICKINGER

This lease is entered into on the 13


th
day of December, 2010 between Magdalene Flickinger, Lessor, and Sarah
Wallace, Lessee.
1. Premises &Terms: Lessor for the rents to be paid and the agreements to be performed by Lessor, does
hereby lease the Lessee and Lessee takes and holds as tenant for Lessor, a bedroom, closet, common space,
and garage space in 3666 Pinedale Street, Boulder, Colorado 80301, for a term beginning on the 1st day of
January 2011, and ending on the last day of July 201 1.
2. Payment Schedule: Lessee hereby agrees to pay monthly rent, in advance, of $650. Such rent shall be
payable to Maggie Flickinger at 3666 Pinedale Street Boulder, CO in cash or by check as follows:
a. $650.00 the first day of January, 2011, and
b. $650.00 by the first of each month for the terms of the lease defined above
c. There shall be a late fee of $20.00 pJr day in the event that the full amount of rent stipulated above
is not received by the 3

of each month. Lessor agrees to pay Lessee a fee of $50.00 for each
check returned to Lessor / Lessee from the bank for reason of insufficient funds or account closed.
3. Security Deposit: Lessee will deposit with Lessor, in conjunction with the signing of this agreement, the
sum of $650.00 as a fund to secure the full and timely performance by Lessee of all terms of this lease.
This fund may be used by the Lessor as described in Paragraph 4 below, and to pay for damage other than
reasonable &ordinary wear caused by the Lessee, or the Lessee's agents of invitees. Lessor will return to
Lessee, within 60 days following the termination or expiration of the lease term, that portion thereof not
being retained by the Lessor, together with an itemized statement of deductions or retention.
4. Performance &Termination: Lessee agrees to abide by every term of this lease and that any violation
will be treated as a material violation of this lease. If Lessee should for any cause whatsoever fail to make
complete and timely performance of each of the terms to be kept and performed, Lessor shall have the right
to make performances for the Lessee, using so much of the security deposit as necessary to compensate
Lessor for Lessee's default. If the Lessor makes performance for Lessee, using all or portion of the security
deposit to pay the cost thereof, or if Lessee agrees to replenish the security deposit to its original level
within 3 days after notification by Lessor of necessary amount, and it the security deposit is insufficient to
reimburse or compensate the Lessor for expenditure or harm, Lessee agrees to pay Lessor, at the time the
security deposit is to be replenished, such additional amounts as may be necessary and defined for
reimbursement or compensation. Failure to make such payments within 3 days of this notification will be
grounds for termination of this lease.
5. Resident's Rights: Resident shall have the right for exclusive occupation of the portion of the residence
defined in paragraph 1. Resident agrees not to assign, or sublet this lease, nor give accommodation to
boarders or lodgers without prior consent from Lessor. Resident further agrees not to use the dwelling for
any purpose other than as a private dwelling unit solely for resident. This provision does not exclude
reasonable accommodation for Resident guest / visitors. Resident agrees to abide by such necessary &
reasonable rules for the benefit &wellbeing of the Residents.
6. Lessor's Obligations: Lessor provides premises in safe &good working order, including heating,
electrical, plumbing, and ventilation, as well as appliances, outside of routine maintenance & repairs.
Lessor also provides water, sewer, and trash services, and pays all HOA dues.
7. Resident's Obligations: Lessee will maintain their portion of the residence in safe &sanitary condition;
will not lease or sublet the premises; to use in reasonable manner all facilities, furnishings & appliances
provided by Lessor; will pay reasonable charges (other than normal wear &tear) for the repair of damages to
the premises caused by the Resident or Resident's guests; not to alter the premises including painting
without advance consent of the Lessor; not to allow houseguests to occupy the leased premises for a period

longer than ten days without written consent from the Lessor; acknowledges their ability to purchase Renter's
Insurance for their belongings, at no cost to the landlord.
8. Pets: Lessee agrees to provide a non-refundable deposit of $150, in conjunction with the signing of this
agreement, in exchange for Lessor allowing one cat to be housed on the premises. This deposit is to be
used for carpet cleaning upon termination or expiration of lease and subsequent moveout. In addition,
Lessee agrees to payor reimburse to the Lessor the total cost of any damages to premises, including
furniture, caused by said pet.
9. Furnishings: The Lessee shall not abuse any furnishings present on the premises, including but not
limited to couches, chairs, tables, wall fixtures, cu rtains, blinds, carpets, etc. Lessee will be monetarily
responsible for any damages to furnishings caused by Lessee, pets of Lessee, or Lessee's guests, outside of
normal wear and tear.
10. Entry: Lessee agrees that at all reasonable times during the term of this lease, Lessor or its agents may
enter the premises I portion of residence for the purposes of maintenance or inspection, or to show to
prospective new tenants.
11. Utilities: Lessor is responsible for Xthe monthly electric I gas utility, and Xthe monthly internet utility,
the other Xof which the Lessee is responsible to pay the Lessor with their monthly rent.
12. Return of Premises: Lessee agrees not to cause damage to the premises and to return the premises at
the expiration or prior termination of this lease in as good a condition as when received, reasonable and
ordinary wear excepted. It is mutually agreed that prior to the expiration of the lease, Lessee shall be
required to provide a 30-day advance notice to Lessor indicating if they wish to continue occupying the
premises under a new lease. If such notice to vacate is not given, the Lessee shall be charged $150.00 to
cover the task of renting the house under short notice. Lessee agrees that said sum is reasonable and shall
not be considered as a penalty, and shall be in addition to the rent due for the Lessee's occupancy of the
premises.
13. Abandonment / Early Termination: If this lease shall be terminated by Lessor because of the breach of
Lessee of any terms or conditions of this lease, either voluntarily or involuntarily, Lessor shall remain
monetarily liable for any deficiency in rent for the duration of the original lease timeframe. If the Lessor
notifies the Lessee that they do not intend to occupy the premises for the entire duration of the lease
timeframe, the Lessor will endeavor to, without in any manner being required to do so, relet the premises. If
the Lessor is unable to relet the premises for any reason, the Lessee remains monetarily liable for any
deficiency in rent for the duration of the original lease timeframe. Lessor reserves the right to reject, for
any reason, possible relet tenants introduced by Lessee.
14. Mediation: In the event of a disagreement regarding the terms of this lease, or the terms of the
termination hereof, both parties agree to fully endeavor to solve the disagreement using personal
communication or professional mediation prior to entering a legal claim. Both parties waive trail by jury for
any matter pertaining to this agreement.
15. Illegality: If any part of this lease is found to be illegal, the remainder of the lease will be unaffected.
In witness whereof the said Lessor and Lessee have caused this lease to be executed, to be bound to the conditions
defined herein, and their respective names to be subscribed hereunto this 13
