The Nanny Nest Terms and Conditions as an employment agency for your home and child care provider.

Terms: Family client must accept one of three options for contracting a care provider. Family may pay a one time referral fee, at which time both parties will be released from the no competition clause and family will then hire the care provider as a household employee. ($150) Family may use management services for a term of 10 weeks at which time they have the option of cancelling management and hiring the care provider as a household employee. ($15 week) Family may use management services for the life of the contract (cancelled or renewed annually). In this situation the care provider will remain a contracted employee of The Nanny Nest and all negotiations limitations apply. ($25 per pay period) Management terms shall be evaluated and optionally renewed at 6 months and annually thereafter. Guidelines: Family Client must outline care requirements and expectations in writing with The Nanny Nest, at which time a care contract will be drafted to be signed by both care provider and family. Contract shall continue as written for the specified term, or until such time amendments must be made due to change in familys care needs, at which time one or both parties should contact the Administrator for amendments to be drafted for new signatures. Family clients should make all care payments to The Nanny Nest. Care provider will be paid by The Nanny Nest a rate as determined by The Nanny Nest. Negotiations Limitations: In the instance care provider is contracted under managed care services, the care provider is not a personal employee of the family client, rather a contracted employee of The Nanny Nest. Both family client and care provider have signed and are bound to a No Competition Clause, subject to a $500 fine. See clause for complete terms and conditions. All payments and financial negotiations must be directed to The Nanny Nest Administrator and should not be discussed between family and care provider. Any major variation from care contract terms must be directed to the Administrator, for prior approval. Including but not limited to permanent change in hours, additional services rendered, and or change in compensation. Payments: Family client must make payments in full to The Nanny Nest on the due date indicated. Payments may be made in person at a payment drop off location, and or a check mailed to The Nanny Nest main office. Payments may not be given directly to the care provider. Late payments may cause interruption in care services, as you care provider may be asked to suspend services until account is brought current. Returned checks are subject to a $35 fee. Please note collection terms as indicated in your finders agreement. All payments are due on Monday, a late payment fee in the amount of $15 shall be added to your next invoice, for all late payments. Late Payment Applies to any payment Not received by Tuesday at 5:00pm following the end of your care providers pay period (per time sheet). In the event a payment is not received by Wednesday at 5:00pm, your care providers services may be suspended until your account is brought current, to prevent further loss to The Nanny Nest. This fee may be waived in the event of delay due to Holiday or slow postal process. The decision to waive this fee is solely the right of The Nanny Nest and is not guaranteed. Payments made through your online bill pay system are acceptable however this process is not guaranteed to be the most time effective method and payments may be delayed and you may incur late fees as a result of this payment method. Please call our office if you have a question or comment about your payment method. ***We will evaluate our pay scale and rate schedule periodically, with comparison with the child care industry in an effort to remain competitive and adjustments will be made as needed. Discussion of Salary with other nannies and or family clients, may result in immediate dismissal of those involved in the discussion. We do not discuss salaries with anyone other than the Administrator. If you have any questions or comments regarding your pay rate please address your Administrator directly. Care Provider Selection Process Families will receive the cover letter for up to 3 available care providers. Family has the option to prescreen a provider candidate, however family interviewing is not required. Care may start within two weeks of contract signing. The Nanny Nest reserves the right to terminate the selection process at any time-see finders agreement.

The Nanny Nest Terms and Conditions as an employment agency for your home and child care provider. Sitter Services Family will be charged a $10 call fee per event for all sitter services that are provided outside of contract or packaged care. Payments for scheduled care must be submitted 7 days prior to scheduled care date. Dates scheduled less than 5 days in advance are subject to care provider availability. Dates may be cancelled or rescheduled, no less than 4 days prior to scheduled care date, for a full refund. Days or Events cancelled less than 4 days in advance will be charged one half of daily care rate. Days or Events cancelled less than 48 hours prior to event will not be refunded, and may be applied to a new care date if scheduled to be redeemed within 7 days of cancelled day. Packaged Care Payment Packaged care is defined as a package of sitter services to be used within a set term-monthly. Families will be charged a monthly fee based on the total number of days/hours included in their selected package. Monthly retainer is due no later than the 5th of each month, family may submit their selected care dates for the month at this time. Reminder Invoices will be mailed out on 6th of each month or the following business day. Family must schedule care dates no later than the 15th of each month. See Termination terms. Care Rates are not included in monthly retainer and are care calculated based on each familys care needs. Care dates must be scheduled a minimum of one week in advanced. Termination Terms Early Termination or failure to schedule contracted days by the 15th of the month, subject to a fee equal to $40 per remaining month. Change of Care Provider Family may request to change their care provider for just cause at any time. Requests for change of provider must be submitted in writing, and subject to replacement availability. In the event a replacement care provider is not available, Packaged care will be suspended up to 2 months. If a care provider is not available within two months or 60 days from date of change request family may elect to terminate Packaged care contract without being subject to early termination fee. Collections: I (we) do hereby authorize The Nanny Nest for the services indicated. I have read all contracts and service terms and fully understand its contents. I agree to full payment of all fees as written in this contract and that if for any reason, if I fail to uphold the terms of this agreement; I further hereby bind myself to pay the fees of any attorney-at-law or collection service who might be retained to recover the amount hereof, or any part hereof, in principal or in part, or to protect the interests of the holder hereof, or to enforce the pledge herein contained, or to compromise or to take other action with regard hereto. It is further understood that The Nanny Nest acts only as a referral source, having researched nanny candidates, limited to the information provided and cannot be held responsible for any false information, Each Nanny accepts the full responsibility for the content of all documents submitted to the family client and hereby releases The Nanny Nest from any responsibility for claims arising after a Nanny candidate has be selected and contracted. Upon signing of this agreement, agreement will continue at as written until notified in writing, at which time the agreement will be canceled. Signing of this contract constitutes mutual acceptance of agreement, in the event action is brought hereof, the prevailing party shall be entitled to recover from the other party the court costs and attorney fees determined and awarded by the court. If at any time collection process becomes necessary I/we agree to pay collections fees up to 40% on the balance owing. If legal action is deemed necessary, I agree to pay reasonable attorneys fees and court costs in addition to the above costs.
