Primaryobjectiveofaregulationistoprotectconsumerinterest.MigrationtoDASistotally dependentontheacceptanceandinterestofthegeneralpublicandtheMarket.Thereisno doubtthatdigitalizationofcableTVnetworkswillusherinaneweraofconvergenceinthe countrybuttheprocessmuststartfromwheretheindustryisatpresent. Notechnologypush,butMarketPullisrequiredtointroducethenewtechnology.Regulations mustbemadeaccordingtothemarketsituationandeconomicconditionsofthecountry existingatpresentratherthantosatisfythedemandsofafewlargecompanies,whichisamply showninthepresentconsultation. Answersgivenbymanybroadcasters,theirDTHventures,Channelaggregators,distributorsand theirsupportingindustrybodiesareinsyncwithwhatlogicTRAIhasrelieduponintheir ConsultationPaperandframedthesequestionsinsuchawaysoastosatisfytheirneedsrather thanneedsofmillionsofconsumers,thousandsofsmallcableoperatorsandwhohavebeen servingtheindustrysincelast25years. ThepresentconsultationpaperonimplementationofDAShas20questionsoutofthe27, posedinamannertobenefitBroadcasters.

b) Whyprovisionofbroadbandtripleplayservicesthroughcableoperators,whichisthe mostimportantissueatpresent,notaddressedintheconsultation? c) WhyCAMbasedheadendsarenottalkedaboutintheconsultation?Thesecompact headendsaretentimescheaperincostgivingabetterqualityofdigitalsignalandare usedallovertheworldincludingEuropeandUSandmanysmallcableoperatorscan affordthem. d) LargeMSOsarepresentinTAMcitiesonly,tobringmoreadrevenuetobroadcasters whoown/supporttheseMSOs.IndiaismuchmorethantheTAMcities.The consultationpaperdoesnotshowanyconcernfortheCableOperatorsinnonTAM cities. e) Only20percentofLCOsmaybejoinedwiththelargeMSOs.Manyofthemmayliketo retaintheirindependentbusinessinvestingontheirownratherthanbeapartofthe largeMSOswhomtheyjoinedoutofcompulsionbecausetheMSOsaresupportedby BroadcastGroupstoultimatelycapturetheirbusinessthroughexploitativemethods. Theseoperatorsareexpectingthegovernment/theregulatortohelpthemretaintheir businessandemploymentoflacsofpeopleworkingforthembymakingsupportive regulations.Nosuchconcernisvisiblefromthepresentconsultationwhereasthiswas themainconcernofmanyMPs,expressedduringdiscussionsinboththehousesof Parliament.HonourableMinisterofInformationandBroadcastinghadassuredthem thattherewillbenounemploymentduetoDASandsmalloperatorsconcernswillbe lookedafter. Ourresponseindetailhasalreadybeensubmittedbutwewishtocountersomeoftheanswers whichmanybroadcasters,DTHoperators,ChannelAggregatorDistributorsandIndustry Associationshavegivenintheirresponse.Beforeexpressingourviewsontheissues,wewishto knowwhatdoesTRAIwanttoachievefromtheseRegulations? InvolvethefragmentedCableTVindustrytobecomebroadband infrastructureastheprimaryobjectiveoftheseregulationsortoclosedownall smallnetworksearningtheirlivelihoodformanyyearsandblackoutmillions ofpoorsubscribersbymakingverytoughconditionsforthemtocontinue further. Dotheywanttoempowerthemasseswithaffordableentertainment andinformationserviceormakelargemediagroupsmakehugeprofitsfrom sellingtheircontenttovulnerableconsumers,whomtheyhavemade accustomedtotheircontent,providingitfreeinnonaddressablesystemsfor thelast20years? PrerequisitestoDigitalisationnotmetbythegovernment TRAIinitsrecommendationsdated05August2012,hadrecommendedsomemeasurestohelp implementdigitalizationexpeditiously.Theseare:

BasicServiceTierfortheDigitalAddressableCableTVSystems 1.Whatshouldbetheminimumnumberoffreetoair(FTA)channelsthatacable Operatorshouldofferinthebasicservicetier(BST)?Shouldthisnumberbedifferent? COFICounterComments ThereisnoAdequateCompetitionasthereisnoLevelPlayingField Thereisnocompetitioninthemarketatlowerlevelfortheconsumers.Thisisafalsestatement madetofavourlargeMediagroupstryingtomonopolizethemarketwiththeirDTHoperation andMSOoperations. AlthoughthereisenoughcompetitionamongthesixDTHplayers,cableoperatorsareinno positiontocompetewiththemconsideringtheirscaleofworking.AlsothereisnoIPTVtogive competitiontoDTH. Nootheroperation(DTH,IPTVorMobileTV)caterstothepoorsegmentofIndiansociety exceptCableTV.Morethan70%ofIndiaispoorand63.5%populationisunderfoodsecurity. AllfinancialinvestmentsareopentothebigplayersbutcableTVhasnone. AllIndustryAssociationslikeFICCI,CII,CASBAAandMPAlobbyfortheBigCorporatebutnoone fightsforthesmallscalebusinessenterprisesofcableoperationorthepoorconsumers. DTHoperationisregulatedbyGuidelineswhicharenotstatutory,butcableTVbusinesshas beenregulatedwithrestrictivelawssince1994.

DTHhasflourishedonlybyviolatingallguidelineslikemandatoryinteroperability,mandatory alacarteetc,overlookedbytheGovernmentandRegulator. EventhebroadcastershaveverylightregulationsthroughGuidelinesandselfregulations. a) DTHOperationisverydifferentinnaturefromCableTV ItiscompletelyunfairandirrationaltocompareDTHoperatorswithasmallcable operatorworkingindependentlyinasmallareaorinruralIndia. AccordingtoTRAI,averagesubscriberofanLCOisabout1000andtherearethousands ofsuchoperators,somehavingonly300500subscribers.WhereaseachDTHoperator hasmillionsofIndianhouseholdsastheirsubscribers,thuscantakefulladvantageof economyofscalenotavailabletosmalloperators. DTHoperationhasbeenstartedbyBroadcasterswhorefusetoprovidecontenttosmall operators. DTHhasbeengrowingsincelastsevenyearsasadigitaladdressableservicewithoutany competitionfromanyotherdigitalserviceafterCablesadvancementwashaltedbythe governmentdeferringCASimplementation.CableDAShasnotevenstartedbutisfacing thecompetition.ThefirstgovernmentadmakingpublicawareofDAShasbeen counteredbysomeDTHcompaniesinthesamenationalnewspapercallingitasan inferiorservice(Dabba)on5thFebruary2012.Wonderhowdidtheysynchronized theiradwiththeI&BMinistryonthesameday! ThereisapricefreezeoncableretailTVratesbutnosuchfreezeonDTHserviceexcept Rs150limitontheirbasicpackage. b) DTHTariffcannotbeappliedonCable CableSubscriberisverymuchdifferentfromDTHsubscriber.DTHsubscriberstaysin mostlycabledryareasandknowsthathewillhavetopayfortheSTBandpaychannel packageswhereascablesubscriberinNonCASareasdonotknowthattheyarebeing forcedtobuytheSTBandpaymoretowatchwhattheyhavebeenwatchingforthelast 25years.TheyalsodonotknowthatincasetheycannotaffordtheDASservice,they shouldstopwatchingcabletelevision. Duetoeconomicdisparity,presentcablesubscribermaynotoptforanypaychannel becauseofthecostsinvolved,evenifhehadbeenwatchingthesechannelsformany yearsservedbycableoperatorsasasinglepackage.ThishashappenedinChennaiand willhappenalloverIndia. DTHsubscriberpaysRs100150forbasicpackagewhereastherearecablesubscribers payingonlyRs50orevenlessoncable. c) DDDirectPlusisnotanalternativetoCableservice

DDDirectPlusisnotaddressablewhereasinDAS,allchannelsareaddressable. DDDirectPlusdoesnotcareforCONSUMERCHOICE/preferences.Theytakehighestbid amounttoplaceachannelbyeauctioning. DDDirectPlusdoesnotcatertoconsumerinterest. FTABSTshouldnotbecomparedwithDDDirectPluswhichishavingonly58channelsat present. CompositionofDDDirectPlusisfixedforallIndiaandwillnotcatertotheneedsof consumersofeveryregion.EvenwhenDDDirectPlusbeams200channels,thereare about600FTAchannelswhichtheycannotbroadcastduetononavailabilityof transponders. DDDirectplusSTBishalfthepriceofDASSTB.AddingprivatechannelsonDDDirect PlusthatwasstartedasonlyaDDchannelserviceposesanunfaircompetitiontoCable. DDDirectpluswasnevermeanttobeacompetitiontocable.Itisapublicsectorproject andcannotbecomparedwithaprivatebusiness. . d) MonopolyofBECILforTechnicalAuditFavoursBigCompaniesonly BECIL,appointedbyTRAI,hasamonopolyinthetechnicalauditbusinessbecauseTRAI hasnottriedtoappointanyotheragencytilldatethattheyrecommendedin2010. BECILchargesRs5lakhtoauditbothanMSOheadendhavingconnectionsinmillions andasmallindependentMSOoraCableOperatorhavingjustafewhundredor thousandconnections. BECILwillobviouslyfavorlargeplayersbecausebeingacommercialventure,they expectmorebroadcastingbusinessfromthemratherthanfromasmallplayerhaving limitedbusiness. NoBECILauditismandatoryforDTHnetworks,IPTV,MobileTV,broadcaststationsor uplinkcenters. CONTENTSisnotgivenbyBroadcastersevenaftertakingBECILcertificate.Hehastogo toTDSATtogetthat(ICCPuneCase). RetailTarifffortheDigitalAddressableCableTVSystems 5.ShouldtheretailtariffbedeterminedbyTRAIorlefttothemarketforces?Ifitistobe determinedbyTRAI,howshoulditbedetermined? a) Shouldthealacartechannelpriceattheretailbelinkedtoitswholesaleprice?Ifyes, whatshouldbetherelationbetweenthetwopricesandtherationaleforthesame? b) Shouldtherebeacommonceilingacrossallgenresforthepaychannelsordifferent ceilingsfordifferentgenres?Whatshouldbetheceilingsineachcaseandthereasons thereof?

ThereshouldbenoforebearanceinRetailMarketforthenextfiveyearsasthereis verticalmonopolyofBroadcasters.DuringtransitionperiodfromAnalogtoDigital, MSO/LCOshavetospendlargeamountofmoneyandrequirelotoftimetoaligntheir networksandneedprotectionthroughregulations. ThereisnomarketforceforPaychannels.Ideallytoprotecttherevenueofpay channelbroadcastersandaddresstheirconcerns,allpaychannelsbemandatedtogo throughaddressablesystemsandFTAchannelsthatdonotdependonsubscription revenues,bedistributeddigitally,withoutaddressability.Thereisnoaddressability requiredforFTAchannels.ButthiskindofmarketdoesnotexistinIndiawhere subscribersinanalogmarketdonotevenknowwhatisaPaychannel?Majorityof Indiacanhardlyaffordsuchaluxuryatthismoment. Consideringaffordabilityofconsumersofalleconomicstrataandteethingproblems facedbyMSO/LCOinimplementingtotaldigitaladdressability,Tariffshavetobe protectedbyTRAIalongwithprotectionfromunfaircompetition.AnalogMarketisnot preparedformigrationtoatariffregimeofPaychannels.Hence,TRAImustfixthe tariffforaminimumperiodofnextfiveyearstoletthemarketbecomestable.Only afterthatforbearancemaybeintroducedafterareview. ThelargeMSOshavingsupportofBigBroadcastingGroupsandFDIinvestorscaninany case,investinDigitaladdressabilityworkingonalargescale.Buttheydonotcontrol morethan20%ofthemarket.Smallcableoperatorsservingtherestof80%market, comprisingoflowerandmiddleclassIndiaandwhoalsoneedtimetoconsolidatetobe abletoavailscalesofoperationfordigitalservices,needprotectionfromthe governmentinespeciallytransitionperiodwhichshouldbeoffiveyears.

PRICINGOFCONTENT. Itisnotdifficulttopricethecontentasyearlyaccountsofbroadcasterscanrevealall thecostsandtheiraccountbookscanshowhowmuchtheyhavespentoncreating/ acquiringcontent. AdvertisementonthechannelinternationallyandwithinIndia. Samecontentdubbedindifferentlanguagesandsoldindifferentmarkets. ContentproducedinIndiabutdistributedallovertheworldtoearnforsubscription,ads andotherincomeinforeigncountries. AllIntellectualPropertiescanbepriced.Theevaluationsaredoneevenwhen broadcastrightsorcopyrightsaresold.

DTHTariffnotapplicabletoCable. TariffOrderdated21July2010meantforDTHandotheraddressablesystemsprimarily dealwithDTHandotheraddressablesystemsthatcoverthewholecountrycateringto millionsofsubscribers.TheTariffOrderdoesnotcovertheCableTVdistribution businessdonethroughthousandsofsmalloperators,takingfeedsfromMSOsor generatingtheirownsignalsthroughsmallheadends.Tariffissuesandbusiness dynamicsaretotallydifferentintheircaseastheyworkondiagonallyoppositescales ofoperation. Therearemorenumberofstakeholderstosharetherevenueincable,whereasinDTH itisallinthehouse,asbroadcasterswhoprovidecontentalsoowntheDTHoperations. Allnetworkswhoonlyinstalldigitalheadendsbutcannotaffordaddressability,canat leastcontinuetheirbusinesswithFTAchannelsindigitalmodedeployinglowcost digitalheadendsthatcosttentimesless. FixationofAlaCarterates:Somestakeholdershavecommentedthatthereshouldbe nofixationofalacarteratesbyTRAI.SomearticlesfromtheUSNewspapershavebeen giveninsupport.ThesearenothingbutamethodoflobbyingbysomeUSbased broadcasters.Actually,itwasprovedthatalacartechoiceisbestforconsumersand FCChadchangedtheirmindonlyafterathoroughresearch.Ratesmustbefixed otherwiseweareleavingtheIndiansubscribersatthemercyofthesepowerful broadcastersforexploitation.PleasefindtheoriginaldocumentsfromFCCandsome pressarticlesfromConsumerOrganisationsattachedasfollows: i) FCCFurtherReportOnthePackagingandSaleofVideoProgrammingServicesTo thePublic. ii) ConsumersUnionLaunchesCampaigntoOverturnFCCRuleChanges:Statementof GeneKimmelman,ConsumersUnionontheFCCdecisiononMediaOwnership.

LockinPeriod:Shouldbeonlyonemonthtogivesubscribersfreedomofchoosingtheevent theywishtowatch.Else,channelsmaychargeaspayperviewbasisforspecialevents. Audit&Penalties:Powertoauditshouldbevestedwithagovernmentappointedagencyand notbroadcaster.Thereare800broadcastersatpresentandcableoperatorscannotbeleftto thewhimsandfanciesofthebroadcasters.Broadcastersshouldnotforcetheirbusiness conditionsonMSO/MSOI/CableOperators. TherearethousandsofcablenetworksinIndiaandauditingthemisnotasimpletask.A certificatetothiseffectatthetimeofregistrationandrenewalshouldsuffice,otherwiseitwill leadtocorruptionandfavoritism. AntiPiracy:Broadcastershavevoicedthispointonlytokeeptheirmonopoliesintactby blamingcableoperatorswhowishtooperateindependently,whenevertheyincreasetheir connectivityanddemandhigherratesarbitrarily.Toprotecttheirproduct,theymustkeeptheir ownchecksandbalancesandnotbediscriminatoryintheirapproach. FingerPrinting:EveryMSOhashisfingerprintingintheCASsystemandfollowsthe internationalnormsasIndianstandardsdonotexist.Passingtheoriginalfingerprintingof broadcastershouldbeoptional.Thiswillspeeduptheprocessofdigitalizationtoagreatextent aseventhesmallCableoperatorswillbeabletoinstallCAMbasedheadendsthatcostten timescheaper.Within1520lakhs,theycaninstallaheadendof160channels. Ifbroadcastersdonothavediscriminatorypoliciesinprovidingtheirsignals,mostofthe problemsofsocalledpiracywillgo.

ThereisnoneedforTRAItomakeitmandatorytopassfingerprintingofBroadcastersonthe cablenetwork.Unnecessaryputtingsuchrestrictionsoncablenetworksmeansmakingit difficultforsmallplayerstoimplementdigitalizationsothatthesmallerplayersareforcedto eitherjointhelargeMSOswhoareownedbythebroadcastersorgetaDTHconnection, whichwillhelptoincreasetheirmonopoly.Sucharegulationwillbediscriminatoryforsmall operatorswhostillwishtocontinuetodotheirbusiness. SMSReports:ThereportgiventobroadcastersmaybebasedupontheSTBIDnumberandnot adetailedsubscriberreportasdesiredbysomebroadcastersgivingdetailsofcustomer telephonenumber,emailetc.However,thedetailedreportcanbemadeavailabletoanyaudit authoritydeputedbythegovernmentattheofficeoftheoperator.
