STATEMENTOFPROBABLECAUSE OnoraboutDecember15,2012atapproximately8:12pm,OfficersFosterandDavisweredispatchedto apropertydamagevehicleaccidentat29thStreetWestandLyndaleAvenueSouthinMinneapolis, MinnesotainHennepinCounty.Uponarrival,FosterandDavisobservedavehiclewithlicenseplateMN 058ETLthathadstruckaparkedvehiclewhichthenstrucktheparkedvehicleinfrontofit.Fosterand Davisthencontactedamale,lateridentifiedasCOREYANTONIODAY,Defendantherein,whostatedhe hadbeendrivingthevehicle.Defendantadmittedhehadhadafewglassesofwineandwascomingfrom aholidayparty.FosterandDavisobservedthatDefendant'seyeswerewateryandbloodshot. Defendantstatedthathewasdrivingstraightdowntheroadandthatsomeonehadjumpedoutathim causinghimtostriketheparkedvehicles.Defendantwasaskedtoperformfieldsobrietytests,whichhe failed.Defendantwasplacedunderarrest.DefendantwasreadtheMotorVehicleImpliedConsent Advisoryinthesquadcar.Defendantstatedhewishedtospeakwithanattorneyandwasalloweduseof hiscellphonetocontactanattorney.Afterusingthephone,Defendantstatedhedidnotwanttocontact anyoneelse.Defendantagreedtosubmittoaurinetest,whichresultedinanalcoholconcentrationof.19 at8:50pm.ChecksrevealedthatDefendantpledguiltyinHennepinCountytodrivingwhileunderthe influenceon10/21/09(27CR0942406)andthatDefendant'sprivilegestodrivewererevokedforthe sameincidenton10/17/09.
