Pilot Car Escort Service for an over-width boat (non-divisible load) for the Colville Tribes Fish & Wildlife Departments Salmon Harvest Program

The Colville Confederated Tribes Fish & Wildlife Department are requesting bids from individuals or contractors who have proven experience in providing Pilot Car Escort Service for the moving of the Dream Catcher, an oversize boat (non-divisible load) for the selective harvest / purse seine fishing program. Two pilot cars are needed each time the boat is moved. The boat is moved from Omak to Brewster (seasonal round trip), but has in the past included mid-season moves to Osoyoos, B.C. and may include a move to Chelan Falls, WA. Based on previous fishing seasons, the following dates are anticipated for moving the boat: The second or third week of June The end of July and or the first week of August (maybe) End of September or beginning of October Other dates as needed Contractor will carry workers compensation and general liability insurance and provide proof. Indian Preference and Tribal Ordinances: It is the Contractors responsibility to contact the person and/or office listed in this special provision to determine whether any tribal laws or taxes apply. If the tribal laws and taxes do apply, the Contractor shall comply with them in accordance with Section 1.07.1. Tribal Employment Rights Ordinances (TERO) may utilize a variety of tools to encourage Indian employment. These tools may include, but are not limited to, TERO fees, Indian hiring preference, Indian-owned business subcontracting preference and /or an Indian training requirement. Other requirements may be a Tribal business license, a required compliance plan and/or employee registration requirements. Every tribe is different and each may be willing to work cooperatively with the Contractor to develop a strategy that works for both parties. Box 150 Nespelem, WA 99155-0150 (509) 634-2716 The state recognizes the sovereign authority of the Tribes, supports the tribes efforts to enforce its

rightful and legal ordinances and expects the Contractor to comply and cooperate with the tribe. The costs related to such compliance shall be borne solely by the Contractor, who is advised to contact the tribal representative listed above, prior to submitting a bid, to assess the impact of compliance on the project. Although Indian preference cannot be compelled or mandated by the Contracting Agency, there is no limitation whereby voluntary Contractor or Sub-contractor initiated preferences are given, if otherwise lawful. 41 CFR 60-1.5(a) 6 provides as follows: Work on or near Indian reservations It shall not be a violation of the equal opportunity clause for a construction or non-construction Contractor to extend a publicly announced preference in employment to Indians living on or near an Indian reservation in connection with employment opportunities on or near an Indian reservation. The use of the work near would include all that area where a person seeking employment could reasonably be expected to commute to and from in the course of a work day. Contractors or subcontractors extending such a preference shall not, however, discriminate among Indians on the basis of religion, sex, or tribal affiliation, and the use of such a preference shall not excuse the contractor from complying with the other requirements as contained in the August 25, 1981 Department of Labor, Office of Federal contract Compliance Programs, Government Contractors Affirmative Action Requirements. (NRC, March 3, 2003) The contractor is advised that Title 10 of the Colville Tribal Code of the Colville Confederated Tribes of the Colville Reservation requires a fee to be paid for contract work performed within the tribal boundaries. The Contractor may be subject to assessment of these fees. The Contractor shall include all cost related to these fees in the bid for the various items in the Contract. No further compensation shall be made. Selection Process: An award to one or more respondents for the services specified herein will be made following a procedure using competitive sealed proposals. Respondents will be asked to submit proposals, including monetary proposals, by the close of business (4:00 p.m.) on March 8, 2013. Proposals will be opened publicly to identify the names of the Respondents, and the monetary proposals. Other contents of the proposals will be afforded security sufficient to preclude disclosure of the contents of the proposal prior to award. Within 7 days after the date of opening the proposals, The Colville Confederated Tribes will evaluate and rank each proposal. After opening and ranking, an award may be made on the basis of the proposals initially submitted, without discussion, clarification or modification, or, the Colville Confederated Tribes may discuss with the selected Respondent offers for cost reduction and other elements of the Respondents proposal. If the Colville Confederated Tribes determines that it is unable to reach a contract satisfactory to the Colville Confederated Tribes with the selected Respondent, then the Colville Tribe will terminate discussions with the selected Respondent and proceed to the next Respondent in order of selection ranking until a contract is reached or The Colville Tribe has rejected all proposals. The Colville Confederated Tribes may not disclose any information derived from the proposals submitted from competing offers in conducting such discussions. The Colville Confederated Tribes reserves the right to award a Contract for all or any portion of the requirements proposed by reason of this request, award multiple Contracts, or to reject any and all proposals if deemed to be in the best interests of the Colville Confederated Tribes and to re-solicit for proposals, or to reject any and all proposals if deemed to be in the best interests of the Colville Confederated Tribes and to temporarily or permanently abandon the procurement. If the Colville Confederated Tribes award a contract, it will award the contract to the offer or offers whose proposal is the most advantageous to the Colville Confederated Tribes and offers the best value, considering price and the evaluation factors set forth in the RFP. The contract file must state in writing the basis upon which the award is made. The Colville Confederated Tribes may discuss or negotiate all elements of the proposal with

Respondents in ranking order as described above. The Colville Confederated Tribes may not disclose any information derived from the proposals submitted from competing offers in conducting such discussions.
