Advocates optimistic as
Senate hears testimony

ANNAPOLIS, Md. A Maryland state
Senate committee this week held a hearing
on a bill that would ban anti-transgender
discrimination in housing, employment
and public accommodations.
Many of the most vulnerable people
in the LGBT community are left with no
legal protections in our state laws, said
state Sen. Rich Madaleno (D-Montgomery
County,) who introduced Senate Bill 449
or the Fairness for All Marylanders Act
of 2013 late last month with state Sen.
Jamie Raskin (D-Montgomery County).
He noted lawmakers in 2001 added
sexual orientation, but not gender
identity and expression to Marylands anti-
discrimination law. I come before you
today as the sponsor of Senate Bill 449
with my good friend from Montgomery
County and ask you to x this omission
and ensure that all Marylanders, including
my transgender sisters and brothers,
are afforded protection under our anti-
discrimination laws.
Carrie Evans, executive director of
Equality Maryland, agreed.
The protections in Senate Bill 449 are
needed in real peoples lives, she said.
Former Montgomery County Council
member Duchy Trachtenberg, David
Rocah of the American Civil Liberties
Union and Liz Seaton of the National
Center for Lesbian Rights are among the
more than two-dozen SB 449 proponents
who testied.
It is difcult to see your child
struggle through life because they are
transgender, Millie Jean Byrd said as she
spoke about her trans daughter who also
testied in support of SB 449.
Caroline Temmermand said her credit
card company lowered her credit limit
from $5,500 to $200 after she legally
changed her name.
When you talk about transgender
folks, we have families, she said. You
discriminate against us, you discriminate
against my family.
Alex Hickcox of Hyattsville spoke
about the fear he said he experiences at
work because of his gender identity and
expression.
Everyone in Maryland deserves a safe
work environment free from potential
harassment or actual harassment and
discrimination, he said. Everyone in this
great state deserves to feel like they have
a voice and they dont have to be silent.
Baltimore City, along with Baltimore
and Howard and Montgomery Counties
have already adopted trans-inclusive non-
discrimination laws.
Sixteen states and D.C. ban anti-trans
discrimination, but SB 449 opponents
maintain the bill is unnecessary.
This bill will force the state and private
actors employers, landlords and others
who provide public services to ofcially
and legally afrm the very delusion that
puts these suffering individuals at odds
with reality, said Peter Sprigg, senior
fellow for policy studies at the Family
Research Council. Not only will it not
makes their lives better, but it will prevent
them from getting the very help they do
need to make their lives better.
Elaine McDermott and Ruth Jacobs
of Maryland Citizens for a Responsible
Government are among those who also
testied against the measure. Rev. Derek
McCoy of the Maryland Marriage Alliance,
which opposed the same-sex marriage
law Gov. Martin OMalley signed last year,
attended a portion of the hearing.
The state House of Delegates in 2011
passed a trans rights bill, but a similar measure
died in a Senate committee last year.
OMalley, who signed Baltimore
Citys trans rights ordinance into law in
2002 when he was mayor there, told
the Washington Blade on Monday he
is absolutely reaching out to state
lawmakers to encourage them to support
SB 449. Senate President Thomas V.
Mike Miller (D-Prince Georges and
Calvert Counties) also backs the proposal.
A spokesperson for state Sen. James
Brochin (D-Baltimore County) told the
Blade on Tuesday he hasnt made up his
mind on the issue. State Sens. C. Anthony
Muse (D-Prince Georges County) and
Norman Stone, Jr., (D-Baltimore County)
also remain undecided.
Dana Beyer, executive director of
Gender Rights Maryland, and other
advocates remain optimistic SB 449 has
enough votes in committee to send it to
the full Senate. Madaleno said members
of the LGBT legislative caucus meet
regularly with the whole coalition in
anticipation of the bill going to the House
of Delegates.
Theyve managed to get it passed
before, he said. Its a matter of laying the
groundwork, keeping everyone up to date.
State Del. Bonnie Cullison
(D-Montgomery County) told the Blade
on Monday she feels the passage of
last Novembers same-sex marriage
referendum laid what she described as
a foundation for understanding of civil
rights for all Marylanders.
You can make the case that
everyone whos different deserves all
the same opportunities and rights and
responsibilities of our society, she said.
That was the case we made for marriage
and were continuing to make it for our
transgender friends.
Madaleno and state Del. Luke
Clippinger (D-Baltimore City) were
the only LGBT members of the state
legislature who attended a rally in
support of SB 449 at Lawyers Mall on
Feb. 18. Gay state Del. Peter Murphy
(D-Calvert County) testied in support of
the measure during the hearing.
All people are asking is each person
in this state, every one in this state, all of
our constituents are entitled to the same
rights and privileges that everybody else
has, he said.
Beyer said during her testimony she
remains more optimistic about the bills
chances this year, in part, because voters
last November upheld the states same-sex
marriage law. She also cited the American
Psychiatric Associations decision late last
year to remove Gender Identity Disorder
from its list of mental disorders as additional
progress on trans rights.
This year is different, Beyer said. This
year the arc of the moral universe will bring
justice to Maryland.
The committee is expected to vote on
whether to send SB 449 to the full Senate
by next Thursday.
Meanwhile, the measures supporters
maintain they hopeful lawmakers will
support the proposal.
Ultimately we are all united in our drive
to achieve fairness for trans Marylanders,
Keith Thirion of the Maryland Coalition
for Trans Equality told the Blade after the
hearing ended. We dont let go of that.
Montgomery County police probe vandalism
Montgomery County police continue to investigate an incident of anti-gay
vandalism against one of its cruisers.
The department said in a press release that ofcers responded to a report of
vandalism on Melody Lane in Bethesda around 3:15 a.m. on Feb. 17. They found
a vehicle with profanity and images of male genitalia that had been spray
painted onto it.
The ofcers also found a swastika and anti-gay comments spray painted onto a
Montgomery County Police Department K-9 vehicle.
The department said ofcers responded to two other vandalism incidents
including a landscaping rock that had been painted with a swastika later on
Feb. 17 on Wahly Drive.
A Montgomery County Police Department spokesperson told the Washington
Blade there is no update at this time on the investigation. The MCPD is offering
up to a $2,000 reward for information that leads to an arrest in the case.

The D.C. Council voted 11 to 2 on
Monday to reprimand gay Council
member Jim Graham (D-Ward 1) on
grounds that he violated a Council ethics
rule in 2008 by improperly intervening in a
contract approval process.
In a separate action, the Council
voted 10 to 2, with one member voting
present, to strip Graham of his
committee responsibilities over the citys
alcoholic beverage regulatory agency and
liquor law policy.
The reprimand and sanction against
Grahams committee responsibilities
were approved in the form of separate
resolutions introduced by Council Chair
Phil Mendelson (D-At-Large). Mendelson
argued that action against Graham was
needed to maintain the condence of the
public in the integrity of the Council and
the city government.
It is time to move on, Graham said
in a statement released after the Council
session adjourned.
I have very important responsibilities
as chairman of the human services
committee and all the responsibility of
representing Ward 1, he said. Going
forward, I will continue to represent the
people who elected me to serve with the
same passion and fervor as I have from my
rst day in ofce.
Graham and Council member Marion
Barry (D-Ward 8) were the only two of
the 13 Council members to vote against
the two resolutions. Council member
Vincent Orange (D-At-Large) voted for the
reprimand resolution but voted present,
which is considered a form of abstention,
on the resolution taking away Grahams
committee duties on liquor law matters.
Rick Rosendall, president of the Gay and
Lesbian Activists Alliance, who attended
Mondays Council session, said he is
uncertain whether the Councils action
and the ethics board opinion that Graham
violated city ethics rules would have a
harmful impact on Grahams longtime
support from LGBT voters.
This is not about LGBT issues,
Rosendall said. Jim has been a strong
and committed ally on that.
Rosendall, as did Mendelson, noted
that the ethics-related allegations against
Graham do not involve a breach in the
citys criminal laws and no one has accused
Graham of such.
Some political observers note that
Council member David Grosso (I-At-
Large), who defeated incumbent Council
member Michael Brown (I-At-Large) last
November following a campaign that
attacked Brown on ethics-related issues,
won in nearly all of the citys precincts with
large numbers of LGBT residents.
At Mondays Council session, Grosso
said he would favor more stringent
sanctions against Graham, noting that
large numbers of his constituents urged
him to push for a censure rather than a
reprimand against Graham.
The Councils vote for the reprimand
and committee sanction came after a
40-minute debate in which Barry, a former
D.C. mayor, was the only member to speak
against the two resolutions.
Im arguing that Jim Graham has not
been given due process, Barry said,
adding that he believes Graham was
denied his constitutional right of due
process under the law because both the
Council and the D.C. Board of Ethics and
Government Accountability didnt hold
hearings to allow Graham to dispute the
allegations against him.
Mendelson and Council member Mary
Cheh (D-Ward 3), a law professor at George
Washington University Law School, disputed
Barrys argument, saying Graham was given
an opportunity to present his case against
the allegations during deliberations of three
separate entities that have investigated the
allegations.
Mendelson said he was prompted to
introduce the reprimand and committee
sanction resolutions after the ethics
board issued an opinion saying it found
a substantial body of evidence that
Graham violated the code of conduct for
a city employee or ofcial in connection
with the contracting matter.
He noted that the ethics board, an
investigation conducted by a private law
rm on behalf of the Metro Transit board,
and the citys Inspector General each
looked into the matter.
All three entities concluded that Graham
acted improperly by allegedly attempting
to pressure businessman Warren Williams
into withdrawing a bid for a Metro land
development contract in exchange for
Grahams support for Williams receiving a
D.C. lottery contract.
Graham has denied interfering with the
contract approval process.
Through his attorneys, Graham last
week led a lawsuit against the ethics
board on grounds that it violated the city
law that created it by issuing an opinion on
Grahams case without holding a hearing
in which Graham had the opportunity to
contest the allegations and evidence used
against him.
Although he declined Mendelsons offer to
allow him to speak on the reprimand resolution
before the Council voted on it, Graham spoke
at considerable length on the resolution calling
for taking away his committee responsibilities
on liquor law matters.
There is no relationship between my
reprimand and the role I play on these
committee issues, he said.
Mendelson told the Blade after the
Council session ended that there was no
question that the decision to strip Graham
of his liquor law responsibilities was a form
of punishment linked to the reprimand.
Its a diminishment of his committee
responsibilities and goes with the
reprimand, he said. Thats why they
were both on the agenda today.
Gay minister installed as pastor in Frederick
In what is believed to be a rst in Western Maryland, an openly gay minister
who is married to his partner was installed on Feb. 17 as pastor of Grace United
Church of Christ in Frederick, Md.
Rev. Dr. Rob Apgar-Taylor said he believes the LGBT supportive church took its
commitment to equality to a new level last November when its leaders selected
him as the new pastor, becoming the rst church in the area to take that step.
I rst came to know the people of Grace Church three years ago after being
asked to preach when their interim pastor was on vacation, Apgar-Taylor said. I was
immediately struck by their graciousness and warmth and acceptance, he said.
He said he was later invited to preside over a same-gender wedding renewal for
a gay male couple who attended the church and who were legally married in D.C.
Apgar-Taylor has been a minister for 24 years. He received his Masters of
Divinity from Wesley Theological Seminary in D.C. and his Doctorate of Ministry
in Spiritual Theology from Princeton Theological Seminary.
He and his husband, Rob Apgar, were married in Massachusetts in 2004.

McAuliffe endorses marriage equality
Virginia gubernatorial candidate Terry McAuliffe on Friday publicly backed
marriage rights for same-sex couples for the rst time.
I believe everyone should be treated fairly, the former Democratic National
Committee chair said in response to a question on the subject during a Google
chat. I personally favor civil marriage for committed couples of the same-sex.
McAuliffes comments come a week after Attorney General Ken Cuccinelli,
whom he will likely face in the commonwealths gubernatorial election later
this year, reafrmed his opposition to nuptials for gays and lesbians during an
appearance on News Talk with Bruce DePuyt.

Illinois gay marriage bill advances
SPRINGFIELD, Ill. The Illinois House Executive Committee on Tuesday
approved a bill that would allow same-sex couples to marry in the state.
The 6-5 vote came less than two weeks after the state Senate approved the measure.
The momentum we are seeing on this legislation is truly inspiring, said gay
state Rep. Greg Harris (D-Chicago,) who sponsored the bill in the House. Illinois
is very close to treating all of its families equally under the law. I look forward to
bringing this to a full vote in the House.
Nine states and D.C. currently allow gays and lesbians to legally marry.
Lawmakers in Rhode Island, New Jersey, Delaware and Minnesota are expected
to debate the issue in the coming days and weeks.
Gov. Pat Quinn has repeatedly said he would sign the same-sex marriage bill if
it were to reach his desk.
Trans girl barred from bathroom
FOUNTAIN, Colo. A transgender advocacy group on Tuesday led a
complaint on behalf of a 6-year-old girl whose elementary school prevented her
from using the girls bathroom.
The Transgender Legal Defense and Education Fund said the Fountain-Fort
Carson School District 8 told Coy Mathis parents late last year she would have
to use a boys, staff or nurses restroom after winter break. Mathis has expressed
herself as a girl since she was a toddler.
Her school should not be singling her out for mistreatment just because she is
transgender, Coy Mathis mother, Kathryn Mathis, said.
Katie Couric interviewed the Mathis family during a segment of her talk show
that aired on Tuesday.
Student sues Florida high school
ARCADIA, Fla. Lambda Legal on Tuesday led a lawsuit in federal court on
behalf of a lesbian teenager who said school ofcials punished her for taking part
in an anti-LGBT bullying event.
Amber Hatcher, 16, planned to observe the National Day of Silence last April.
DeSoto County High School Principal Shannon Fusco and DeSoto County School
Superintendent Adrian Cline reportedly discouraged her from taking part in the
annual event.
The lawsuit further alleges administrators suspended Hatcher for the day after
she arrived to school wearing a red T-shirt that read DOS April 20, 2012: Shhhhh.
I wish my school would help me create an accepting environment for LGBT
kids, not single me out for punishment, Hatcher said.
Puerto Rico governor opposes adoption ruling
WASHINGTON Puerto Rico Gov. Alejandro Garca Padilla told a local
newspaper on Monday that sexual orientation should not determine who is
eligible to adopt a child in the American commonwealth.
The governors comments, which he made while in D.C. for the annual National
Governors Association meeting, come less than a week after the Puerto Rico
Supreme Court narrowly upheld the islands gay adoption ban. Gay singer Ricky
Martin and LGBT rights advocate Pedro Julio Serrano are among those who
blasted the decision.

Manti Teos sexual orientation persist going into the National Football Leagues
Scouting Combine.
Teams want to know if Manti Teo is gay, NFL commentator Mike Florio said
on the Dan Patrick Show on Monday. I dont think anyone knows how to solve
this dilemma yet.
Ronaiah Tuiasosopo last month confessed he convinced him he was a woman named
Lennay Kekua with whom the linebacker carried a virtual long-distance relationship for
three years. He said he convinced Teo last September that Kekua had died.
The Notre Dame linebacker told Katie Couric after the hoax became public that
he is not gay.
ADAP, funding to
combat hate crimes
on the chopping block

Federal programs serving people with
HIV/AIDS and others relevant to the LGBT
community will be among those feeling
the crunch on Friday once the sequester
of government funds takes effect.
The sequester approved by Congress
and signed into law by President Obama
in 2011 as part of an agreement to raise
the nations debt ceiling would institute
$1.2 trillion in cuts for U.S. government
programs across the board starting this
year over the course of 10 years.
The cuts were designed to be so
onerous that Congress would come to an
agreement on a more balanced approach
to decit reduction as opposed to letting
the sequester take effect. Although
lawmakers and Obama delayed the date
on which the sequester would take effect
until Friday as part of the scal cliff deal at
the beginning of the year, they so far have
been unable to agree to an alternative.
An estimated 8.2 percent in the rst
year would be cut from the budgets of
discretionary federal programs, including
HIV/AIDS and LGBT-related programs.
Crosby Burns, research associate on
LGBT issues for the Center for American
Progress, said the institution of these cuts
on Friday would be a tragedy because
minority communities take the biggest
hit when policy makers issue across-the-
board cuts to government programs.
Politicians are literally playing games
with peoples lives, Burns said. If the
sequester happens, AIDS patients will
lose access to life-saving drugs, programs
that combat hate crimes and domestic
violence in the LGBT community will be
slashed, LGBT homeless youth will have
to remain if homeless shelters receive
less funding, and LGBT workers who have
been discriminated against will see their
cases go uninvestigated.
During a White House news brieng
on Wednesday, Education Secretary Arne
Duncan told the Washington Blade there
would be no upside regarding how
sequestration would impact administrative
efforts to combat school bullying because
the focus would instead move to getting
by with fewer resources.
Were not even having that conversation
today, its all about going in the opposite
direction, Duncan said. So creating safe
communities, creating climates in which
children live free of fear, thinking about what
were doing in the curriculum, afterschool
clubs all the things we should be doing
whether its around reducing bullying, or
whether its around the arts or robotics,
or whatever it might be, were not even
having that conversation, which is, again,
crazy to me.
Hope persists that Congress will come
to an agreement to undo the sequester
before March 27, when the continuing
resolution expires that has provided funds
for the U.S. government under scal year
2013 levels. At that time, funding will need
to be renewed or the federal government
will shut down. That date is just before
worst purported consequences of
the sequester such as furloughs of
government employees are set to take
effect on April 4.
But HIV/AIDS programs will be hit
especially hard on Friday. According to
a fact sheet issued by the White House
earlier this month, cuts to the AIDS Drug
Assistance Program could result in 7,400
fewer patients having access to life-saving
HIV medications. The White House also
says around 424,000 fewer HIV tests could
be conducted by Centers for Disease
Control State grantees, which could result
in increased HIV transmissions and costs
in health care.
Carl Schmid, deputy executive director
for the AIDS Institute, said he hopes that
lawmakers and Obama will come to an
agreement before the next set of ADAP
grants are issued in March or April because
they would be lower under the sequester.
We have had ADAP wait lists in the past,
and those are for new people coming on,
Schmid said. This is they wont have enough
to support the people that are currently on
drugs, and thats really, really dangerous.

steps down

Vatican ofcials this week denounced
reports in the Italian press that an
underground network of gay priests
assigned to the Vatican organized
meetings for sex and may have been
subjected to blackmail.
Criticism of the press reports by a high-
level Vatican spokesperson came less than
a week before yet another gay-related
scandal hit the Catholic Church this time
in Scotland.
British Cardinal Keith OBrien, who has
called same-sex marriage grotesque,
announced he decided to step down a
month ahead of previously announced
retirement plans after allegations surfaced
on Feb. 23 that he engaged in intimate
acts with priests in the 1980s.
OBrien denied the allegations but said on
Monday he cancelled his trip to Rome this
week, where he was expected to participate
in the selection of a new pope. He said he
didnt want the allegations against him to
overshadow the conclave of cardinals set to
convene within the next week.
The Vatican immediately accepted his
decision to step down from his church
duties, which it viewed as a resignation.
News of the alleged network of gay
priests at the Vatican surfaced last week
when the Italian newspaper La Repubblica
and the Italian news magazine Panorama
reported that Pope Benedict XVI
announced his resignation on the same
day he learned of the allegations.
In a development that created an uproar
at the Vatican, La Repubblica reported it
received detailed information about a 300-
page Vatican report prepared by three
cardinals who uncovered the network of
gay priests during a nine-month internal
Vatican investigation.
Among other things, the report says the
investigation discovered a faction within
the Vatican united by sexual orientation,
according to La Repubblica.
The newspaper said it had no
conrmation that Benedict based his
decision to resign solely on the explosive
ndings of the investigation. But it
reported sources as saying Benedict
planned to keep the ndings condential
and decided to leave it up to his successor
to determine how to address the matter.
It was on that day, with those papers
on his desk, that Benedict XVI took
the decision he had mulled over for so
long, La Repubblica reported in its Feb.
21 edition while discussing Benedicts
resignation.
Vatican ofcials have since conrmed
that the investigation took place but
have refused to comment on its ndings.
Vatican spokesperson Rev. Federico
Lombardi acknowledged the reports by
La Repubblica and Panorama that the
investigation was launched last May after
one of the popes butlers was arrested for
allegedly stealing papal correspondence
and leaking it to the media.
La Repubblica reported several other
ndings of the investigation, including
problems associated with the Vatican
bank. Vatican observers in Italy speculated
that various rival factions of cardinals
and other Vatican ofcials were likely
responsible for leaked information about
the investigative report.
Efforts to portray rivals in a negative
light are part of the great game of
the conclave, whose tools include
political attacks and efforts to condition
consensus, Vatican observer and author
Alberto Melloni of Bologna, Italy, told the
New York Times.
Other observers have said intrigue
and inghting that sometimes takes
place in the process of selecting a Pope
appears to be occurring at a greater
intensity this time, as conservative and
more progressive factions of cardinals
line up behind different candidates under
consideration for the papacy.
The Vaticans Secretariat of State, its
highest ofce, issued a statement on Feb.
23 denouncing the press accounts of the
contents of the investigative report or
dossier as unveried, unveriable or
completely false news stories.
In a separate statement, the Vatican
said Benedict dissolved the three-cardinal
investigative committee on Monday and
expressed satisfaction for the results of
this investigation, according to a report
by the Washington Post.
The Holy Father has decided that the
acts of this investigation, known only to
himself, remain solely at the disposition
of the new Pope, the Post quoted the
statement as saying.
La Repubblica reported that the
investigation uncovered an underground
network of gays working at the Vatican
who organized sexual meetings in
several locations, including a sauna in
Rome, a private villa just outside Rome,
and a beauty salon inside the Vatican.
The newspaper also reported the
investigation found some of the gay priests
may have been subjected to blackmail by
men not associated with the Vatican with
whom they had worldly relations.
When you have this culture of secrecy
and guilt and repression you have
conditions which foster the potential for
blackmail and for manipulation, said gay
British journalist and former priest Mark
Dowd in an interview with CNN.
The cardinals who headed the Vatican
investigation have been identied as
Julian Herranz of Spain; Jozef Tomko of
Slovakia; and Salvatore De Giorgi, the
former archbishop of Palermo.
The British newspaper The Guardian
broke the story about Cardinal OBriens
alleged gay scandal in a story in its Feb.
23 edition.
According to The Guardian, three
priests and a former priest, all from
Scotland, led a complaint against OBrien
with the Vaticans ambassador to Britain
one week before Benedict announced his
resignation.
One of the complainants, The Guardian
reports, charges that OBrien developed
an inappropriate relationship with
him, resulting in a need for long-term
psychological counseling.
Another, identied only as Priest A,
described being visited by OBrien and
inappropriate contact between the two
took place, the newspaper reported.
Priest B claims he was invited to spend
a week at the then archbishops residence,
where he encountered unwanted
behavior by the cardinal after a late-night
drinking session.
The Guardian said Priest C had
been seeing OBrien for counseling
over personal problems and alleges that
OBrien used night prayers as an excuse
for inappropriate contact.
The four who led the complaint called
on the Vatican ambassador to take steps
to prevent OBrien from going to Rome to
participate in the conclave to select a new
pope, saying the papal selection process
would be tainted if the cardinal was part of it.
OBrien, who announced he had
cancelled his trip to Rome the day after
The Observer published its story, said he
would obtain legal counsel to ght the
allegations, which his accusers say took
place in the 1980s.
The press reports about the alleged
network of gay priests at the Vatican
reportedly involved consenting adults,
and the allegations against OBrien
involved adult victims. But the revelations
of these developments prompted news
media outlets in the U.S. and Europe to
bring up longstanding allegations of the
sexual abuse of children by pedophile
priests that have plagued the Catholic
Church for more than two decades.
Organizations representing victims of
sexual abuse by priests have called on
the Vatican to bar cardinals in the U.S.
and elsewhere from participating in the
selection of a new pope if they knew about
priests that sexually abused juveniles but
did not act to stop the abuse.
Francis DeBernardo, executive director
of New Ways Ministry, a Maryland-based
group that advocates for LGBT equality
within the Catholic Church, told the Blade
the unfolding gay sex scandal, if true, is
due in part to the Vaticans harsh position
on homosexuality.
They have created a situation where
people cant express their sexuality in
healthy ways, he said. They cant even
deal with their sexuality in the open. So
it creates a climate of suspicion and a
climate of fear.
Jeannine Gramick is a Roman Catholic
nun who co-founded New Ways Ministry
and serves as national coordinator for
the National Coalition of American Nuns.
She told the Blade she is hopeful that
the scandal would nudge the church into
adopting a more tolerant position on gays.
I think the impact it should have is to
point out the hypocrisy of having a very
negative stance about homosexual activity
between loving persons and the private
secret condoning of activity that is not in
the context of a committed relationship,
she said.
So my hope is that it will bring about
a re-examination of the churchs approach
to sexuality to become more realistic and
honest, Gramick said.

Attorneys for New York lesbian widow
Edith Windsor are arguing that the
Supreme Court should strike down the
Defense of Marriage Act on the basis that
it violates her right to equal protection
under the U.S. Constitution.
In a 63-page brief led on Tuesday,
Windsors lawyers make their case against
DOMA saying it furthers no federal
interest in procreation or dual sovereignty
with the states and argue the law should
be subjected to heightened scrutiny, or a
greater assumption its unconstitutional.
DOMAs discriminatory treatment
of married gay couples violates Ms.
Windsors right to the equal protections
of the laws as guaranteed by the Fifth
Amendment, the brief states.
Signers of the brief include private
attorney Robbie Kaplan and attorneys
from the American Civil Liberties Union,
who led the lawsuit on behalf on Windsor.
The case pending before the Supreme
Court is known as Windsor v. United States
and challenges Section 3 of DOMA, which
prohibits federal recognition of same-
sex marriage. Windsor is suing the U.S.
government because in 2009 under the
law she had to pay $363,000 in estate taxes
upon the death of her spouse, Thea Spyer.
Married straight couples are exempt from
the estate tax under current law.
A substantial portion of the brief is
devoted to countering the arguments
of the House Republican-led Bipartisan
Legal Advisory Group, which led a
brief in favor of DOMA in late January.
Under the direction of House Speaker
John Boehner (R-Ohio), BLAG has taken
up defense of DOMA following the
Obama administrations announcement
in February 2011 that it would no longer
defend the law.
Windsors attorneys, for example, say
BLAGs argument that DOMA serves a
federal interest by preserving marriage
as one man, one woman to encourage
responsible procreation speaks volumes
about the lack of validity of the law.
This one difference cannot explain the
federal governments decision to impose a
sweeping disability on married gay couples
that excludes them from countless federal
programs and protections, and that only
harms their children, the brief states.
Because this distinction is based on the
one feature that distinguishes married gay
couples from married straight couples,
what BLAG is really arguing is that it is
acceptable to discriminate against married
gay couples simply because they are gay.
The brief from Windsors attorneys comes
on the heels of a similar brief led against
DOMA before the Supreme Court by the
Justice Department, which has assisted in
litigation against the law. Both briefs argue
that the court should apply heightened
scrutiny to its review of DOMA.
Windsors attorneys make the argument
that DOMA should be subjected to
heightened scrutiny because, like other
suspect classes, gay people have suffered
a long history of discrimination, sexual
orientation is a central part of a persons
identity, and gay people lack power in the
political process.
The brief also states that gay people
should be considered a suspect class
because sexual orientation has no bearing
on their ability to contribute to society.
Despite pervasive discrimination,
lesbians and gay men have served with
great distinction in virtually every facet
of American society, as artists, athletes,
academics, soldiers, scientists, lawyers,
judges, psychologists like Dr. Spyer, and
computer programmers like Ms. Windsor,
the brief states.
The U.S. Second Circuit Court of
Appeals applied heightened scrutiny
to DOMA in its ruling against the law. It
remains to be seen whether the Supreme
Court will do the same, but if it did, that
could have widespread implications on
laws affecting gay people.
DOJ weighs in
Meanwhile, the Obama administration
on Friday argued that DOMA should
be struck down by the Supreme Court
because it inicts a vast array ofsevere
harms on married same-sex couples.
In a 54-page legal brief, the Justice
Department lays out its case for why
it believes Section 3 of DOMA is
unconstitutional noting the harm the
law causes married same-sex couples and
the history of discrimination against gay
and lesbian people while arguing that
DOMA should be subjected to heightened
scrutiny, or a greater assumption its
unconstitutional.
The law denies to tens of thousands of
same-sex couples who are legally married
under state law an array of important
federal benets that are available to legally
married opposite-sex couples, the brief
states. Because this discrimination cannot
be justied as substantially furthering any
important governmental interest, Section
3 is unconstitutional.
The brief is signed by Solicitor General
Donald Verrilli as well as Stuart Delery,
the gay principal deputy attorney general
whos litigated against DOMA in oral
arguments in lower courts. The lawsuit
before the Supreme Court is known as
Windsor v. United States, which was led
by the American Civil Liberties Union.
The brief enumerates several benets
that are withheld from married same-sex
couples under DOMA, such as the denial
of certain housing benets for service
members, the lack of Social Security
survivor benets and the inability of gay
Americans to sponsor their foreign-born
same-sex spouses for residency in the
United States. It also notes that Windsor
was forced to pay $363,000 in estate taxes
upon the death of her spouse, Thea Spyer.
But the Justice Department also makes
the case that laws related to sexual
orientation should be subjected to
heightened scrutiny because gay people
have been subjected to a history of
discrimination, citing bias in employment
and immigration as well as vulnerability to
hate crimes and police harassment.
Additionally, the brief contends DOMA
merits heightened scrutiny because
sexual orientation bears no relation on an
individuals ability to contribute to society
and gays are a minority with limited
political power.
Historically, discrimination against gay
and lesbian people had nothing to do with
ability or performance, but rested instead
on the view that they are, for example,
sexual deviants, mentally ill, or immoral,
the brief states. Like gender, race, or
religion, sexual orientation bears no
inherent relation to a persons ability to
participate in or contribute to society.
Napolitano denounces law
In a related development, Secretary
of Homeland Security Janet Napolitano
said the Obama administration is unable
to place on hold marriage-based green
card applications for bi-national same-
sex couples as long as the Defense of
Marriage Act remains on the books.
When asked by the Washington Blade
this week during a White House news
conference, Napolitano asserted DHS
cant take such action, which could protect
bi-national gay couples from separation to
stop the deportation process in some
extreme cases.
The legal advice we have received
is that we cant put them in abeyance
because DOMA remains the law,
Napolitano said. Wed like to see that law
overturned. In practical terms, however,
most of those cases fall within very, very
low priority in terms of what weve done
over the last years, which is to build
priorities into immigration enforcement,
so were not seeing, in practicality, those
deportations occur.
In 2009, DHS took such action for the
widows of U.S. citizens when Napolitano
ordered U.S. Citizenship & Immigration
Services to grant deferred action to
widows who are foreign nationals and
suspend adjudication of their visa petitions
and adjustment applications.
Asked why her department couldnt
take similar action for bi-national same-
sex couples, Napolitano replied, Well,
because of DOMA.

Survives controversies
over Iran views,
anti-gay record

The U.S. Senate conrmed former Sen.
Chuck Hagel as defense secretary on
Tuesday following assurances that he would
work on behalf of LGBT military families and
controversy over his anti-gay past.
Senators approved the Nebraska
Republicans nomination by a 58-41 vote
late in the afternoon. That conrmation
vote took place more than four hours after
the Senate invoked cloture to end debate
on his nomination by a vote of 71-27.
In a statement, President Obama
commended the Senate for conrming
Hagel on a bipartisan vote although
it was the rst time a defense secretary
nominee was libustered and called
the new Pentagon chief the leader our
troops deserve.
I will be counting on Chucks judgment
and counsel as we end the war in
Afghanistan, bring our troops home, stay
ready to meet the threats of our time and
keep our military the nest ghting force
in the world, Obama said.
Last week, a vote in the Senate to
proceed with the Hagel conrmation
was 58-40, which was short of the
60-vote threshold needed to end a
libuster and move on to conrmation.
Hagel was conrmed on Tuesday as a
result of Republicans changing their
votes on whether to end debate on the
nomination.
Among those casting a vote in favor of
Hagel was lesbian Sen. Tammy Baldwin
(D-Wis.), who previously told Washington
Blade she had a very good conversation
with him and would support his
nomination. Last month, Baldwin said she
had tough questions about his view of
the post-Dont Ask, Dont Tell military.
Hagels nomination was controversial in
the LGBT community because of remarks
he made in 1998, when he said the U.S.
ambassador to Luxembourg, Jim Hormel,
shouldnt be conrmed to the post
because hes openly aggressively gay.
Hagel also had a dismal voting record on
LGBT issues during his tenure in the U.S.
Senate. Just prior to his nomination as
defense secretary, Hagel apologized for
the anti-gay remarks.
Since being nominated for the position
of defense secretary, Hagel has expressed
a commitment to gay service members,
saying he supports Dont Ask, Dont Tell
repeal and pledged as part of testimony
before the Senate to move expeditiously
to enact certain benets for troops with
same-sex partners that are allowed despite
the Defense of Marriage Act.
Earlier this month, outgoing Defense
Secretary Leon Panetta announced most
of these benets would be enacted
and set a goal for implementing them
by Aug. 31, but no later than Oct.
1. Hagel will be responsible for seeing
through their implementing them in
addition to other benets such as
health and pension benets that
may be awarded to gay troops with
same-sex partners if the Supreme Court
strikes down DOMA.
Allyson Robinson, executive director
of the LGBT military group OutServe-
SLDN, praised the Senate for conrming
Hagel, but urged him to go further in his
commitment to LGBT troops by instituting
non-discrimination protections for gay
service members.
It has been reassuring to see Sen.
Hagel show the kind of clear, unambiguous
leadership in support of our service
members and their families he has
demonstrated in recent months, Robinson
said. Now he has the opportunity to turn
his commitments into action, and we look
forward to working with him to ensure
our military embodies the same values of
fairness and equality it protects.
Currently, no recourse exists for gay service
members outside of their chain of command
if they feel theyve experienced discrimination
based on their sexual orientation.
However, in response to requests to
implement an explicit non-discrimination
policy, Pentagon ofcials reiterate the
current policy to treat everyone in the
military with fairness.
OutServe-SLDN had previously called
on President Obama to issue an executive
order instituting a non-discrimination
policy for LGBT service members.

death scene for Manon.
One of the greatest tests of an operatic
soprano is the titular role of Norma. Divas
from Rosa Ponselle to Maria Callas and Joan
Sutherland have made the Druid priestess
their calling card, and now, rising soprano
Angela Meade steps up to the plate for her
rst full production of this titanic role.
Audiences and critics have long been
anticipating this moment with a mixture
of hopeful curiosity and timidity. In
July of 2010, Meade sang the role in a
concert version, and while the reviews
were generally kind, many felt it was too
much too soon for the young soprano.
Cut to February 2012 when a more
seasoned Meade, on the heels of winning
the Beverly Sills Artist Award, received
glittering notices for her performance
at the Metropolitan Opera in Verdis
Ernani. Starting March 9, the soprano
makes another run at Norma in a new
production, directed by out theater and
opera director Anne Bogart.

This spring at Washington National
Opera, the fairer sex will be the talk of
the capitals operatic scene. From stars to
directors and the repertoire itself, women
rule the stage, with exciting company
debuts as part of the stable.
First out of the gate, opening Saturday,
is Manon Lescaut, starring Washington
favorite Patricia Racette in the title role.
Last seen on the Kennedy Centers opera
stage in 2011 for Iphigenie en Tauride
and Tosca, Racette (a lesbian) will be
tackling the role of Manon Lescaut for the
rst time in the revival of gay director John
Pascoes 2007 production.
Written by Giacomo Puccini and
premiered in 1893, Manon Lescaut was a
risky undertaking for the composer. Almost
a decade earlier, Frenchman Jules Massenet
had unveiled a wildly popular version of
the same story, simply titled Manon. Up
to this point in his career, Puccini hadnt
been particularly successful, but Manon
Lescaut put Puccini on the operatic map.
For many of his operas, Puccinis heroine
is the crux of the drama, and Manon
Lescaut set the bar for this winning
equation. At the operas start, the young
and achingly beautiful Manon is on her
way to a convent at her familys insistence.
Her carriage stops in a small town for
a rest, where she meets the young and
handsome Des Grieux. After he professes
his undying love for her, she decides to
run away with him, whether for love or a
convenient escape is up for debate.
At the start of the second act, time has
passed and Manon has cashed in her
chips for money and comfort instead of
love. Shes now the kept woman of an
older wealthy man, and although she has
everything she could ever dream of, she
pines for Des Grieux. Eventually, the young
pair manages to reconnect with disastrous

Country singer Chely Wright is the
headliner for Rehoboths Womens Fest

dropped in late January, we cant call it
a spring album release, but the hottest
queer disc out right now without a doubt
is Heartthrob from Canadian rock duo
(and twin lesbians) Tegan and Sara. After
years of working the indie circuit, they
came storming out of the gate this year
with a shockingly high U.S. debut (No. 3
on the Billboard 200), their highest chart
position to date and a more mainstream
pop sound thats earned them strong
reviews. Look for them on tour this
summer with Fun.
Mykki Blanco, a trans hip-hop artist whos
performing at Comet Ping Pong on March
27, is dropping his EP Betty Rubble: The
Initation at the end of March. A follow up
to last years mix tape Cosmic Angel, the
track Feeling Special has already been
leaked and Blanco has been described
as being aggressive as ever. Alter ego for
Michael David Quattlebaum Jr., Blanco is a
New York-based poet and hip-hop musician
who blends traditional rap genres while
also making reference to several hip-hop

David Bowie, straight but perhaps the
most androgynous mainstreamer in all of
rock, returns with all new material for his

band the Flaming Lips releases its 13th
studio album The Terror on April 2. The
album consists of nine original tracks that
take on an incredibly introspective and

of Toronto-based band The Cliks, returns
after a ve-year hiatus to release the
