another Latino man. She moved to the Sunset Apt in Justice in the spring of 2009. Just a short time prior to her murder she asked her father if she could move back home. Unfortunately she was found murdered shortly after making the request. My mother called and told me Lacey had been found murdered. It was a horrible shock. Lacey was a treasured daughter, a close sister, a tender mother, an unforgettable niece, a generous cousin, and a forever friend. She was unique, full of life and laughter, she had a spirit which could not be broken, it was a light she let shine brightly. She still shines ever brighter in our hearts and in Heaven. By Laceys cousin Adam Oestman Trust me when I tell you that my cousin Lacey was different from you and I. Most of us funnel through life operating every aspect our daily routine taking for granted the people we love. We usually never think, until its too late, that at any moment somebody we care about could be taken away from us. We tend to not always say whats in our hearts and we procrastinate because we naturally assume that we have all the time in the world. . . When I first heard the news that Lacey was killed my mind went blank. I didnt know what to think, how to react or how to feel. I was in shock. A short time later the reality of what had happened and the sadness in my heart was all to present. I immediately began to think of all the times I was supposed to call Lacey and didnt; the time I was supposed to take her to that concert and cancelled; the times I argued with her and never apologized. . .

This is my beloved niece Lacey Gaines. She was murdered just 6 days after her 20th birthday on Dec. 7, 2009 in her apartment in Justice, Il. She was strangled with a cord and her throat was cut with a 10 kitchen knife. No forced entry, no robbery, no sexual assault, no defensive wounds. Her murder left her infant son without a mother and her family in possible danger. There have been no arrests in her case. Lacey grew up among the cornfields of Grant Park, Il. She was a polite and kindhearted little girl with a sense of humor. She attended a Lutheran Day School and went to France as part of a student exchange program. She spoke fluent Spanish. When she was 15 yrs old (under the age of consent) she met and began a sexual relationship with a Latino man who was 10 years older than she. A baby was born and she lived with the father for a time. But then Lacey began calling me and telling me she was being abused. I advised her to go to the shelter and see a therapist, get an order of protection, and make police reports. She did all of these things. She met and began a relationship with

In memory of Patricia Gail Clendenin
The Victims Voice and Citizens Against Homicide have lost a friend in the death of Gail. Gail was devoted to her family, yet found time to be involved in her community. Gail and Jacque met through sorrow when Gails parents were murdered. She worked tirelessly to keep their story in the public arena. Gail was also a guest on Jacques show The Victims Voice. Jacque believed and felt it a great honor to know Gail and be her friend. In Jacques words Gail was a lovely, modest, friendly, and extremely vivacious woman who will be deeply missed by all who knew her. Jacque and CAH and The Victims Voice will not allow the public to forget her parents until their case is solved. Just a few words of thanks for everyone that worked and played in the 17th annual CAH Golf Tournament that was held on Friday the 13th of August. Usually in the issue of our Newsletter we have photos and all the winners listed. However this month the NL is especially filled with the greater than usual requests for paroles. One that did not have time to go into the NL but has been posted on our website along with the ones featured in this months NL. There is also an open letter to the Governor of California regarding a request that the Governor not sign the release for a murderer. The letter speaks for itself thus I will not repeat the details here. What I will say here about that case is that again we have a Judge, Judge Goethais making decisions from the bench and TELLING the Board of Parole Hearings to vacate their decision. The Judge is Thomas M. Goethais, Orange County Superior Court Judge. As of this writing we were not able to gather any specific information about this Judge. If anyone has details about him we certainly would like to know. By this ruling he is not a friend of victims or the laws that we currently have in place. He supports murderers. Someone we should NOT have sitting on the bench. Next month we will have all the details of fun and fund raising that went on at the tournament.

OMICIDE

The majority of the board members of Citizens Against Homicide have had a family member murdered. They are surviving the devastating loss of a loved one and still suffer the continued emotional trauma of coping with our criminal justice system. We have joined together to create a voice for the survivors and friends of murder victims.

CAH Objectives
Assist families through the complicated criminal justice system. Provide trial and courtroom support to victims. Accompany victims to parole hearings in their endeavor to keep the convicted murderer in prison. Provide information on pending crime legislation.

Protecting Your Own Interests


You cant prepare for the event that makes you a victim. You can only react. You need to know how to deal with the subsequent trial, sentencing and unavoidable parole hearings. CAH helps you take action to protect your own interests. If you have friends or family who may be in need of our assistance, please pass along the information regarding our organization.

We hold monthly meetings on the second Sunday of each month at 302 4th Street, San Rafael, CA The monthly meeting starts at 10:00 a.m. We encourage anyone interested to attend meetings.

OPEN LETTER TO GOVERNOR SCHWARZENEGGER


RE: GARY ECCHER PAROLE RELEASE
On August 10, 1985, Gary Eccher murdered Lianne Lando. He bludgeoned her, strangled her, submerged her in bath water, and electrocuted her. Per the Orange County Probation Officers report, Gary Eccher stated, a spur of the moment physical altercation ensued and that escalated into the death of my girlfriend. Deputy District Attorney, Rebecca Olivieris statement objecting to parole (page 32, line 13-15), demonstrates a lack of remorse and insight by Gary Eccher into the murder of Lianne Lando. Note that Gary Eccher indicated that this crime is simply an isolated incident between a couple who was living together. Governor Schwarzenegger, murder is NOT a simple isolated incident. Gary Ecchers decision to murder Lianne Lando has changed lives forever . . . that words cannot describe. Do these statements reflect insight into the commitment offense? Gary Eccher refers to his murder of Lianne as an incident that just so happened to be a spur of the moment physical altercation that escalated into the death of my girlfriend. Gary Eccher murdered Lianne Lando and he cannot come remotely close to using the word murder. He just doesnt get it. There is no remorse or insight into what he chose to do . . . Murder Lianne. On July 15, 2009, Gary Eccher, CDC# D-36746 appeared before the California Board of Hearings Panel for a Life Term Parole Consideration Hearing. The Panel concluded that he was not yet suitable for parole, because he posed a present and unreasonable risk of danger to society, or a threat to public safety if released from prison. Considered were (3) three disciplinary actions and the commitment offense continued to be a factor that influenced the Panels decision of unsuitability. The Panel noted and conceded that the commitment offense no longer weighed heavily against suitability, but it was a consideration for the panel. The Panel noted that the offense was committed in an especially heinous, atrocious and cruel manner. It was carried out in a calculated manner that demonstrated an exceptionally callous disregard for human suffering and the motive certainly was trivial. The Panel mentioned that subsequent to Lianne Lando being murdered by Gary Eccher, he showered, took property from the residence and fled to Mexico. The Panel noted their concern about Gary Ecchers issue of being self-absorbed and self-centered. He failed to adhere to some direction when cautioned by the Panel about his perceived personal agenda. He ignored the warning and kept going. Only after a second reminder did he divert his course of action. The Panel was also concerned about his flawed judgement when confronted with issues of dealing with right versus wrong. On March 11, 2010, Thomas M. Goethais, Orange County Superior Court Judge, granted Gary Ecchers petition for Writ of Habeas Corpus. He ordered the Board of Parole Hearings (BPH) to vacate its July 2009 decision finding Gary Eccher unsuitable for parole and directed the BPH to conduct a new parole suitability hearing. He directed that the BPH find Gary Eccher suitable for parole unless either previously undiscovered evidence or new evidence subsequent to Gary Ecchers July 2009 hearing regarding his conduct, circumstances or change in his mental state supports a determination that he currently poses an unreasonable risk of danger to society if released from parole. Judge Goethais notes in his order, that private counsel (appointed by the court) contends there is no evidence to support the BPH conclusion that Gary Eccher would currently present a danger to society on release. Counsel requested that the court order the BPH to vacate its decision denying parole and to hold another hearing at which, it is to find Gary Eccher suitable for parole. Gary Ecchers murder of Lianne Lando is described by Judge Goethais as occurring 24 years ago. Also, that the crime is both temporally remote and mitigated by circumstances indicating the conduct is unlikely to recur. Therefore, the BPH may not continue to rely solely on the commitment offense to deny parole, because the circumstances of the crime alone no longer support the conclusion that Gary Eccher remain a current threat to public safety. How careless for a presiding Superior Court Judge to insinuate that Liannes murder is temporal; Liannes death is forever a far cry from being temporary and not eternal. Shame on Judge Goethais for discounting the life of Lianne Lando. Judge Gothais, in his decision to grant Gary Ecchers Writ of Habeas Corpus and order for a new parole

hearing is flawed, as he failed to recognize the considerations the July 2009 BPH Panel made in reaching their decision to deny Gary Eccher parole. The July 2009 BPH Panel did not rely solely on the commitment offense in their decision to deny parole, as Judge Goethais states in his order of March 11, 2010 (page 4, paragraph 2). On July 8, 2010, Gary Eccher appeared before the California Board of Parole Panel in compliance with a court order issued by Judge Thomas Goethais. The Panel concluded that Gary Eccher is suitable for parole. The Panel based its decision for parole suitability on several accomplishments as listed on page 46. However. the Panel also noted for the record, on page 45, the fact that they really could not assess, you chose not to talk to us and we certainly did not hold that against you. We certainly understand that you have a right not to talk to us and exercised that right. But we really didnt have a lot. And you really didnt talk with clinicians, so we really didnt have a lot to go on today. So, we couldnt do a really good gauge one way or the other. But we did understand what the court order said and we have absolutely no new information from the last hearing that would prevent you from getting a grant, like we were instructed by the judge. Presiding Board of Parole Hearing Commissioner John Peck provides an extensive narrative, which clearly delineates information that justifies denial of a parole date. He provides a brief reference to the issue of opposition for suitability. It would appear that together, Commissioner Pecks narrative and the voices of opposition, are sufficient enough to justify a decision that Gary Eccher is not suitable for parole. However, he must have been intimidated by Judge Goethais order. Additionally, I find it disturbing to read that private counsel appointed by the court actually requested that the court order the PBH to vacate its decision denying parole and to hold another hearing, at which it is to find Gary Eccher suitable for parole. We believe that language used in Judge Goethais order and request made of the court by private counsel intimidated the July 8, 2010 Panel to render their ill-advised decision to grant Gary Eccher parole. Governor Schwarzenegger, please focus your attention to pages 34, 35 and 36 of the BPH, dated July 8, 2010. Clearly, Gary Eccher has yet to fully examine his complicity in the murder of Lianne Lando. Commissioner John Peck states in his decision to grant parole, the positive aspects of your case outweigh the other considerations. Proponents for parole and opponents of parole have submitted written documents and gave testimony in regard to parole consideration for Gary Eccher. Speaking from those with experience, it is common knowledge that Laudatory Chronos are handed out like candy on Halloween night. Gary Eccher was found suitable for parole and a decision review at the Board of Parole Hearings is now pending. The case will go to your office sometime in early November 2010. You will then have approximately 30 days to make your decision. Our projection is that by early December 2010, your decision should be rendered. Governor Schwarzenegger, Citizens Against Homicide and its entire membership asks that you NOT approve the decision of the BPH Panel of July 8, 2010 to grant parole to Gary Eccher. Lianne Lando was the victim of murder by Gary Eccher leaving her family devastated and victimized.. To approve a parole would, again, victimize Lianne Landos family and reward her murderer. Lacey, on the other hand, always seemed to say what was on her mind. She was a REAL person. If Lacey liked you, you knew it. She was not afraid to be herself and I loved that about her. I remember the first time Lacey met my wife. We were dating at the time and the first thing Lacey said to her was, . . .that is my cousin Adam, you better not do anything to hurt him! Here is my little cousin 7 years younger than me, being protective of me. It made me laugh but in my heart I admired her ability to be so honest. For a moment, I found myself looking up to her. The truth is Lacey was just joking but that memory always stuck with me and it certainly made an impression on my wife. Lacey had a tremendous heart, and an infectious smile. She put everyone around her before herself and often times neglected her own needs to help the people she loved. She had the ability to live her life with more sincerity than most of us ever will. She was true to herself, true to her family and true to her faith. I dont think about my regrets anymore because I know Lacey wouldnt want me to. I just remember the friend that I lost for who she was. I pray for justice and peace for my family. I know that Lacey has that peace where she is now. Lacey had the ability to bring joy to my heart and a smile to my face. She still does . . . CANDLELIGHT VIGIL FOR LACY MARIE FERGUSON


On Tuesday, August 24, 2010, Gene, our daughter, Eryn and I attended a beautiful expression of love, honor and remembrance for Lacy Marie Ferguson in Modesto, California. Lacy is the daughter of Boni Driskill, a Victim Advocate with Wings of Protection. The evening was symbolic . . as the warm winds reminded her family that Lacy was actually there, blowing soft kisses to them all. And, of no coincidence, a gorgeous soft yellow swallowtail butterfly floated throughout the entire candlelight vigil ceremony. Lacys life was cut short on August 23, 2003, as she and her boyfriend made a quick trip to a local convenience store. As they were preparing to return home, Lacy and her boyfriend were caught in the middle of a rival gang shooting; her boyfriend was shot in the arm . . . and Lacy was shot in the head. An innocent bystander, a beautiful life; a loving daughter and young mother . . . snatched away by gang violence. Someone knows the details of what happened that night on August 23, 2003 in Modesto California. The family is still desperately seeking answers and justice. Denise Poer had devised what she thought was a very clever story to get away with the perfect murder. This was a crime of convenience, as Lloyd Maddox was simply an obstacle in this murderers way. Cheryl had been introduced to Mahoney on the last night that she was seen alive. Her death was an act of extreme brutality by a man that had no reason to harm her.
