Appendix to Tender
Schedule of Adjustment Data [In Tables A, B, and C, below, the Bidder shall (a) indicate its amount of local currency payment, (b) indicate its proposed source and base values of indices for the different foreign currency elements of cost, (c) derive its proposed weightings for local and foreign currency payment, and (d) list the exchange rates used in the currency conversion. In the case of very large and/or complex works contracts, it may be necessary to specify several families of price adjustment formulae corresponding to the different works involved.] Note 1: Sources of cost price adjustment indices shall be from recognized relevant Organizations and shall be acceptable to the Employer. Note 2: The Base Values of indices shall be those prevailing at the date 28 days prior to the latest date for submission of Bids and shall be substantiated by Bidders by appending copies of the relevant publication. having been notified of the acceptance of its Bid by the Employer during the period of bid validity, (i) fails or refuses to execute the Contract Agreement or (ii) fails or refuses to furnish the performance security, in accordance with the ITB. This guarantee will expire: (a) if the Bidder is the successful Bidder, upon our receipt of copies of the contract signed by the Bidder and the performance security issued to you upon the instruction of the Bidder; and (b) if the Bidder is not the successful Bidder, upon the earlier of (i) our receipt of a copy your notification to the Bidder of the name of the successful Bidder; or (ii) twenty-eight days after the expiration of the Bidders bid. BILL OF QUANTITIES
Preamble to the Bill of Quantities This Preamble shall be deemed to amplify but in no way limit or contradict the Conditions of Contract, Technical Specifications and Drawings. 1. 1.1 General Instructions for Measurements and Pricing The Conditions of Contract together with the Technical Specifications and the Drawings are to be read in conjunction with the Bill of Quantities and in so far as they have any bearing they must be referred to for details of the description, quality and strength of material to be used and the workmanship, conditions, obligations, liabilities and instructions generally which have to be complied with in carrying out this Contract. The cost of complying with all conditions, obligations and liabilities described in the Contract including all overhead charges and profit and carrying out the work as shown on the Drawings will be deemed to be spread over and included in the prices or sums stated by the Contractor in the Bill of Quantities. Each item shall be priced and extended to the 'Amount' column by the Contractor with the exception of the items which already have provisional sums affixed thereto or items which have 'Rate Only' already inserted in the 'Amount' column. Rates and lump sums (except those printed) shall be inserted in the appropriate columns. If the Contractor omits to price any items in the Bill of Quantities then the cost of the work of such items will be held to be spread over and included in the prices given for other items of work.

The Bill of Quantities has been divided into separate Bills. Notwithstanding such division for convenience of pricing and re-measurement thereof nothing contained therein shall in any way relieve nor be deemed to relieve the Contractor of his responsibilities. The rates and sums of money quoted in the Bill of Quantities shall be in Ethiopian Birr (ETB).
1.3 1.4 The unit prices shall be held to be inclusive of the supply of materials, services and everything necessary for the proper completion of the Works. In the event of any variations during the performance of the Contract, the alteration shall be valued on the basis of the appropriate unit prices laid down in the Bill of Quantities and the Contract shall be adjusted accordingly. The Contractor's attention is drawn to the fact that the quantities in the Bill of Quantities are estimated quantities and they are not to be considered as limiting nor as extending the amount of work to be done by the Contractor. The work as completed shall be measured and paid for as described in the Contract. The Engineer may vary the works as he may consider necessary and at the discretion of the Engineer, works under any provisional item shall be expended in whole or in part or may not be implemented. All measurements for payment shall, unless otherwise specified in the following Technical Notes for Measurement and Pricing or in the Specifications, be the net quantities required by the Drawings and/or the Specifications and actually executed. Unless a separate item has been included for the purpose in the Bill, the cost of any work which may have to be executed in excess of the net or minimum requirements of the Drawings in order to provide the net or minimum requirements of the Drawings and/or the Specifications shall be included in the pricing of the item concerned. Wherever reference is made to the Engineer such reference shall equally apply to the Engineer's Representative as well as a responsible member of the staff of the Engineer's Representative if the context of the reference so implies. The Contractor shall be deemed to have provided in his rates, inter alia, for the following: (a) Any costs incurred in the acquisition of any land for the use of the Contractor in addition to that made available by the Employer; (b) All charges or costs relating to site clearance, topsoil stripping and stockpiling, construction of accesses and reinstatement associated with borrow pits/quarries;

(c) All charges and/or transport costs relating to extraction, preparation and haulage of materials to any distance of the road; (d) Protection of the works from water from any source; (e) Setting out and verification of all survey data and dimensions; (f) Provision and preservation of survey beacons; (g) Provision of all samples and test certificates; (h) Provision of all water supply and services including electricity; (i) Environmental protection measures including health and safety measures, appropriate maintenance of plant and equipment; (j) Maintenance of works, etc. 1.9 The units quoted in the Bill of Quantities are as shown hereunder, with their respective abbreviations: Abbreviation mm m km m2 ha l m3 m3 km No. LS PS g kg t hr mth incl. % ETB RCP 2. 2.1 Technical Notes for Measuring and Pricing Rate only items Against an item in the Bill of Quantities where no quantity is given but a rate only is required, the Contractor shall fill in a rate or amount which will constitute payment for work which may be done in terms of this item. Such rate only item is used where it is estimated that little or no work will be required under the item, or where the item is to be considered as an alternative for another item where a quantity is given, or for variations in rates of application or mix proportions. Work under rate only items will be paid for only if it has been executed in terms of a written instruction by the Engineer. 3. 3.1 Dayworks General Reference shall be made to the Conditions of Contract. Work shall not be executed on a Daywork basis except by written order of the Engineer. Bidders shall enter basic rates for Daywork items in the Schedules, which rates shall apply to any quantity of Daywork ordered by the Engineer. Nominal quantities have been indicated against each item of Daywork, and the extended total for Dayworks

shall be carried forward as a Provisional Sum to the Summary. Unless otherwise adjusted, payments for Dayworks shall be subject to price adjustment in accordance with the provisions in the Conditions of Contract. 3.2 Daywork Labour In calculating payments due to the Contractor for the execution of Dayworks, the hours for labour will be reckoned from the time labour arrives at the job site to execute the particular item of Daywork until arrival at the original place of departure, but excluding meal breaks and rest periods. Only the time of classes of labour directly doing work ordered by the Engineer and for which they are competent to perform will be measured. The time for Charge Hands actually doing work with the gangs will also be measured but not the time for Foremen or other supervisory personnel. The Contractor shall be entitled to payment in respect of the total time that labour is employed on Daywork, calculated at the basic rates entered by him in the "Schedule of Daywork Rates, Labour", together with an additional percentage payment on basic rates representing the Contractor's profit, overheads, etc., as described below: (a) The basic rates for labour shall cover all direct costs to the Contractor, including (but not limited to) the amount of wages paid to such labour, transportation time, overtime, subsistence allowances, and any sums paid to or on behalf of such labour for social benefits in accordance with the laws of the country of the Employer. (b) The additional percentage payment to be quoted by the Bidder to be applied to costs incurred under (a) above shall be deemed to cover the Contractor's profit on costs, superintendence, liabilities and insurances and other allowances to labour, time-keeping, clerical and office work, the use of consumable stores, water, lighting and power; the use and repair of stagings, scaffolding, workshops and stores, portable power tools, manual plant and tools, supervision by the Contractor's staff, foremen and walking gangers (other than charge hands working with the gang); and other charges incidental to the foregoing. Payments under this item shall be made in the currencies and in the proportions as stated in the Summary. 3.3 Daywork Materials The Contractor shall be entitled to payment in respect of materials used for daywork (except for materials for which the cost is included in the percentage addition to labour costs as detailed heretofore), at the basic rates entered by him in the Schedule of Daywork Rates, Materials, together with an additional percentage payment on the basic rates to cover overhead charges and profit, as follows: (a) The basic rates for materials shall be calculated on the basis of the invoiced price, freight, insurance, handling expenses, damage, losses, etc., and shall provide for delivery to store for stockpiling at the Site. The basic rates shall be stated in national currency, but payment will be made in the currency or currencies expended upon presentation of supporting documentation. (b) The additional percentage payment to be quoted by the Bidder to be applied to costs incurred under (a) above shall be deemed to cover the Contractor's profit on costs, superintendence, liabilities and insurances and other charges incidental to the foregoing. Payments under this item shall be made in the currencies and in the proportions as stated in the Summary. 3.4 Daywork Plant The Contractor shall be entitled to payments in respect of Contractors Plant already on Site and employed on daywork at the basic rental rates entered by him in the Schedule of Daywork Rates, Plant. Said rates shall be deemed to include due and complete allowance for depreciation, interest, indemnity, insurance, repairs, maintenance, supplies, fuel, lubricants, other consumables, all overhead, profit and administrative costs related to the use of such plant. The cost of drivers, operators, and assistants will be paid for separately as described under the section on Daywork Labour. In calculating the payment due to the Contractor for Contractors Plant employed on daywork, only the actual number of working hours will be eligible for payment, except that where applicable and agreed with the Engineer, the travelling time from the part of the Site where the Contractors Plant was located when ordered by the Engineer to be employed on daywork and the time for return journey thereto shall be included for payment. Payments under this item shall be made in the currencies and in the proportions as stated in the Summary.
