Press Statement of Stop Lynas Coalition (SLC) 22nd November 2012


Today Stop Lynas Coalition (SLC) notifies the Public and the Media of our anti-Lynas campaign on our Appeal Submission to the Federal Court Putrajaya, Results of our Court of Public Opinion based on Law of Conscience, our Support for The Green Walk by Himpunan Hijau and a Public Petition to Dissolve Atomic Energy Licensing Board (AELB). The Federal Court Putrajaya had fixed the date of mention of our legal case on 8th of November 2012 for the exchange of affidavits among all parties. However, the 1st & 2nd respondents (AELB and DOE) lawyers were not present and the 3rd respondents (Lynas) lawyer requested for more time to reply to our affidavit. The registrar then fixed the next date of mention to be on the 17th of January 2013 in the Federal Court Putrajaya. SLC launched a Children Exchange Programme on 24th September 2012 between Gebeng children and the children/grandchildren of Pro-Lynas Crusaders. To-date, nobody has responded nor signed up for this homestay experience. We are so disappointed! Once again, pro-Lynas crusaders have failed abysmally to prove that Lynas is safe for all children - children of anti-Lynas citizens & pro-Lynas crusaders. Their children/grandchildren have missed this golden opportunity to witness the historic arrival of Lynas shipment of rare earth on to our pristine shore. SLC has also launched a nation-wide campaign to boycott Lynas Corporation in Kuantan and Australian goods in Malaysia. Kudos/terima kasih to house-owners, housing agents, transport operators & service providers who have refused to engage in business transactions with Lynas. Kudos/terima kasih to all consumers who have refused to buy Australian goods. On paper, Lynas is the safest rare earth plant in the world. On inspection, it is an Australia weapon of mass-destruction. We are the Palestinians of the East. We call on all Malaysians with a conscience to boycott Lynas Corporation and Australian goods. SLC is committed with our efforts to Stop Lynas from operating, as such we are currently embarking into the 3rd Phase by getting the people to support A government that will listen to the voices of the people and take good care of the environment as well as the health of the people. Our 1st Phase of discussions, creating awareness, sending memorandums and negotiations, and 2nd Phase through the legal framework, have all been carried out and exhausted. It seems that the peoples concerns and voices have not been heard by the authorities. Page 1 of 5

Therefore, we are supporting The Green Walk from Kuantan to Parliament in Kuala Lumpur, lead by Mr Wong Tack, Chairman of Himpunan Hijau. We sincerely urge all concern citizens to be in Dataran Merdeka on the 25th November 2012 (Sunday) at 4pm to meet & greet the people who have completed The Green Walk. And will continue to walk with them the next day to the Parliament House on 26th November 2012 (Monday). We encourage all concern citizens who want to Stop Lynas as well as protecting the environmental injustice to join The Green Walk. SLC will provide bus transports from Kuantan and Balok to Dataran Merdeka Kuala Lumpur on 25th November 2012 (Sunday). Concern citizens who wish to support The Green Walk may contact Mr Loo at 016-9862308 and Encik Mahmud at 012-9571497 respectively for seats reservations. The support will spearhead the momentum towards environmental justice. After going through several statements made by the AELB, we found there were many misleading information being given to the public to justify the operation of Lynas plant. We cited an example of Lynas had committed to send back their radioactive wastes to Australia (ref. link dated 4/Jul/2012 http://www.aelb.gov.my/aelb/malay/dokumen/lynas/faq/FAQ%20Lynas%2004072012%20Eng.pdf,) whereas Australian Government has not received any application from Lynas then (ref. link dated 14/Sep/2012 http://www.themalaysianinsider.com/malaysia/article/lynas-seeks-to-send-toxic-waste-to-australia-despite-noimport-policy,). AELB statements were as if they are Lynas spokesperson. Thus, SLC will embark to send a petition of loss of Confidence towards AELB and to request the body to be revamped. Public Petition to Dissolve Atomic Energy Licensing Board (AELB)


The concerned citizens of Malaysia make a petition to dissolve AELB. Another board of professional radiation regulators should be formed. Representatives from both the ruling party and opposition should sit on the select committee. We cast a vote of non - confidence on the present AELB because of its notorious track record of acting as if it was above the law. On the 6 Feb 1987, disregarding the Ipoh High Court injunction to Asian Rare Earth (ARE) to stop operations, AELB granted a licence to ARE to operate. The then executive secretary, Kasbun Kamat, denied that the issuance of the licence had violated the Ipoh High Court injuction with "They are 2 different matters. The injuction concerns the plaintiffs, the Bukit Merah residents, and the respondent, ARE. We are not involved." We are terrified that the present AELB may continue this arbitrary, high - handed tradition of granting unilateral licences to controversial projects. We cast a vote of non - confidence on the present AELB because its director - general Datuk Raja Abdul Aziz Raja Adnan seems to be suffering from a severe attack of forgetfulness. On 8th September 2012, he was reported telling the New Straits Times reporters (as per attached) that "Lynas commitment to ship out all of its waste from its rare earth processing plant is non - binding to its TOL. It was never a condition of the licence. When Lynas made the commitment, we took note of the commitment and the board decided to issue the licence, Datuk Raja Aziz said. Asked why AELB only relied on Lynas unilateral commitment with-out putting it in black and white, he explained that the agency was limited by laws and regulations. On 9th September 2012, he was reported telling the New Straits Times reporters (as per attached) that claims that the removal of residue was non binding for Lynas should not arise as it was legally binding and AELB would enforce. Members of such an important regulatory body which oversees the biggest rare earth plant in the world should not befogg an other - wise straight foward environmental issue with contradictory statements. We the undersigned petition that AELB be dissolved and TOL to Lynas be suspended pending the formation of a new radiation regulatory body.
