RENTAL LEASE

TENANT______________________________________________________________ ADDRESS_____________________________________________________________ TERM______________BEGINNING_____________AND ENDING______________ Tenant shall give Owner 30 day written notice of intent to vacate premises prior to the termination date above written or secure a Lease extension from Owner. FAILURE TO GIVE LANDLORD 30 DAY WRITTEN NOTICE MAY RESULT IN TENANT'S LOSS OF DEPOSIT. SAID LOSS OF DEPOSIT SHALL NOT PREJUDICE ANY OTHER REMEDIES ALLOWED BY LAW TO COLLECT RENTS UNPAID UNDER BALANCE OF TERMS OF LEASE. RENT____________________________________DOLLARS($_____________) per month, which Tenant agrees to pay in advance at such place as Owner directs ON THE 1st DAY OF EACH MONTH during the term of this lease. RENT SHALL INCREASE annually Three (3%) percent of the amount of rent paid per month ($____________) beginning thirteenth month that Tenant occupies said premises. OWNER RESERVES THE RIGHT TO LEVY, AND TENANT AGREES TO PAY A LATE CHARGE OF TWENTY-FIVE ($25.00) DOLLARS PLUS THREE ($3.00) PER DAY FOR ANY PAYMENT NOT RECEIVED BY LANDLORD ON OR BEFORE THE 6TH DAY OF THE MONTH. (PAYMENTS SHALL BE MAILED SO THAT THEY ARE RECEIVED, NOT POSTMARKED, BY THE DUE DATE.) RETURNED CHECKS: We will gladly accept your check for payment of rent; HOWEVER, ANY CHECK RETURNED TO OWNER FROM BANK FOR INSUFFICIENT FUNDS WILL RESULT IN A $25.00 CHARGE TO TENANT AND WILL IN THE FUTURE REQUIRE TENANT TO PAY BY MONEY ORDER OR CASH. MAIL RENTS TO: _______________________________________________ DEPOSIT: Tenant shall deposit the sum of $__________ to insure that upon the termination of tenancy (at end of lease), the premises and items therein let are in as good condition as when delivered to Tenant, (ordinary wear excepted )and that all terms of the Lease have been met by Tenant. Tenant shall not apply or deduct any portion of the deposit from the last months rent or use or apply deposit at any time in lieu of payment of rent. Tenant shall be responsible for any and all damages to rental. Upon termination of this Lease, the deposit may be applied to any cleaning, damage charges, or loss of rent the Landlord may have suffered by reason of Tenants non-compliance with the Rental Lease. If expenses incurred exceed deposit, balance shall be paid by Tenant to Landlord immediately. OCCUPANCY: It is agreed that no other person or persons except those named in the Lease will occupy the premises at any time without the written consent of Landlord. RIGHT OF ENTRY BY LANDLORD: It is understood that Landlord and/or his agent maintain right of entry at reasonable times with 24 hour notice (or tenants instructions) for normal maintenance, requested repairs, inspections and during the final 30 days of tenancy to show the property to prospective tenants. Landlord reserves right of entry without notice in the event of an emergency such as water leaks, fire, etc. OBLIGATION OF TENANT: (1) Tenant shall permit no noise or nuisance whatsoever in or on said premises to the disturbance of others. (2) Tenant shall dispose from premises (both interior and exterior) all trash and waste in a neat and sanitary manner (plastic trash bags) and place in dumpsters. Place trash containers at curb on trash day only. TRASH DAY is _________________________. (3) Blockage to drains and sewage lines due to obstruction, and not caused by defects of the plumbing, will be corrected at Tenant expense. CONTACT LANDLORD before arranging repairs.

(4) Tenant shall not conduct any business on property. (5) Tenant will notify Landlord of any damage, leaks or drips in sinks, toilets, or tub/showers immediately. (6)Tenant shall not make any alterations or additions to the house without Landlord consent. Including: NO screws, books, or stick-ons of any kind to be attached to woodwork, formica, doors, ceilings or cabinets. Small picture hook nails or straight pins in sheetrock are acceptable. NO REPAINTING OR WALLPAPERING. When vacating, leave all nails in wall; Landlord will remove nails, fill holes and repaint. (7) Tenant shall keep all trash picked up in yard. Any items placed on grassed area are to be moved by Tenant for mowing. Landlord does not provide mowing. Landlord does not provide snow removal. (8) NO vehicle/car/motorcycle/boat/truck/trailer/moving van is to driven/kept/stored in yard. (9) Parking of recreational or commercial vehicles/motorcycles/boats/truck/trailers not in running order, not licensed or regularly used are prohibited from the premises. (See #8 above.) (10) Tenant assumes all duties and responsibilities relating to normal insect control (except termites) on the described premises. (11) Tenant shall comply with terms of the Lease and/or any common usage rules that Landlord may adopt. (12) Tenant is responsible for maintaining working batteries in smoke detector, and/or notifying Landlord if detector does not work and needs replaced. PETS: NO pets are allowed in/around/on/or about the premises at any time. TERMINATION OF LEASE: Landlord may terminate this lease for Tenants failure to pay rent when due as set forth in the Rental Agreement or if Tenant fails to abide by any one or more of the terms of this lease, as acknowledged and agreed by Tenant herein. The fact that the Landlord may elect not be terminate the lease in the event of one or more failures by Tenant to comply with the terms of the lease shall not serve as a waiver of Landlords right to assert its rights at a later date with regard to such failure to perform and shall not serve as a waiver with regard to any term of the lease. SUBLETTING/ASSIGNMENT OF LEASE: Tenant may not sublet or assign lease to any person without written consent of Landlord. NOTICE OF INTENT TO VACATE: Tenant shall notify Landlord of intent to vacate thirty (30) days prior to lease expiration. If Tenant is on a month to month basis, 30 day notice shall also apply to notifications requirement. (Failure by Tenant to give notice may result in loss of deposit.) At this time Tenant should request cleaning list, detailing cleaning required to return rental to condition in which it was leased to Tenant. Utilities must be on for final inspection. Contact Landlord at least 24 hours in advance of time requested for inspection. Deposit shall be refunded within 15 days after vacancy, unless repairs are necessary and additional time is needed to determine costs to make said repairs. CLEANING: Tenant is required to do all cleaning of rental necessary to bring rental back to clean, movein condition for next tenant. PROFESSIONAL CLEANING of carpeting will be arranged by Landlord and deducted from deposit - approximate cost of $100.00. Any cleaning left undone by Tenant will be completed at Tenant expense and withheld from deposit. ORDINARY WEAR AND TEAR ARE EXCEPTED, HOWEVER, IF RENTAL REQUIRES COMPLETE REPAINT AT END OF FIRST YEAR TERM, (NOT CONSIDERED NORMAL WEAR AND TEAR) IT SHALL BE AT TENANTS EXPENSE. RECEIPT OF A COPY OF THIS AGREEMENT IS HEREBY ACKNOWLEDGED.
