RECOMMENDATION(S):
That Council give first, second and third readings to the 3 Avenue, 8 Avenue and 202 Street
Water Local Area Service Tax Bylaw 2009 No. 4732; and

That Council give first, second and third readings to the 8 Avenue – West of 200 Street Water
Local Area Service Tax Bylaw 2009 No. 4733; and

That Council give first, second and third readings to the 28 Avenue; 201 Street to 204 Street
Water Local Area Service Tax Bylaw 2009 No. 4734; and further

That Council give first, second and third readings to the Trinity Western University – Phase 1
Water Local Area Service Tax Bylaw 2009 No. 4736.

EXECUTIVE SUMMARY:
Pursuant to the Local Area Service (3 Avenue, 8 Avenue and 202 Street Water Main)
Construction Bylaw 2007 No. 4587, construction of a water system for 3 Avenue, 8 Avenue and
202 Street was undertaken and completed in 2009. The Construction Bylaw 2007 No. 4587
provides that the portion of works to be specifically charged against parcels benefiting from or
abutting the work shall be calculated at a fixed rate per taxable meter.

Pursuant to the Local Area Service (8 Avenue – West of 200 Street Water Main) Construction
Bylaw 2007 No. 4629, construction of a water system for 8 Avenue – West of 200 Street was
undertaken and completed in 2009. The Construction Bylaw 2007 No. 4629 provides that the
portion of works to be specifically charged against parcels benefiting from or abutting the work
shall be calculated at a fixed rate per taxable meter.

Pursuant to the Local Area Service (28 Avenue; 201 Street to 204 Street Water Main)
Construction Bylaw 2007 No. 4630, construction of a water system for 28 Avenue; 201 Street to
204 Street was undertaken and completed in 2009. The Construction Bylaw 2007 No. 4630
provides that the portion of works to be specifically charged against parcels benefiting from or
abutting the work shall be calculated at a fixed rate per taxable meter.

Pursuant to the Local Area Service (Trinity Western University – Phase 1 Water Main)
Construction Bylaw 2007 No. 4607, construction of a water system for Trinity Western
University – Phase 1 was undertaken and completed in 2009. The Construction Bylaw 2007
No. 4607 provides that the portion of works to be specifically charged against the parcel
benefiting from or abutting the work shall be calculated at a fixed rate per taxable parcel.

The Parcel Tax Review panel authenticated the 2009 Parcel Tax Roll for the taxable and actual
frontages related to these local area services on March 23, 2009.

• 3 Avenue, 8 Avenue and 202 Street Water Local Area Service Tax Bylaw 2009 No. 4732
being brought forward will collect $856,415 from 36 (thirty-six) properties over the next
20 years.
• 8 Avenue – West of 200 Street Water Local Area Service Tax Bylaw 2009 No. 4733
being brought forward will collect $249,463 from 19 (nineteen) properties over the next
20 years.
• 28 Avenue; 201 Street to 204 Street Water Local Area Service Tax Bylaw 2009 No.
4734 being brought forward will collect $263,388 from 22 (twenty-two) properties over
the next 20 years.
• Trinity Western University – Phase 1 Water Local Area Service Tax Bylaw 2009 No.
4736 being brought forward will collect $279,562 from 1 (one) property over the next 20
years.

PURPOSE:
The purpose of the report is to bring forward Local Area Service Taxing Bylaw No. 4732, 4733,
4734 and 4736 for the first three readings.

EXPLANATORY NOTE

Bylaw No. 4732 provides for the imposition of a local area service tax for those properties on
3 Avenue, 8 Avenue and 202 Street affected by a water system service extension local area
service. During 2007, a local area service project for the installation of a water main was
undertaken and completed pursuant to “Local Area Service (3 Avenue, 8 Avenue and 202
Street Water Main) Construction Bylaw 2007 No. 4587.

TAX BYLAW 2009 No. 4732

WHEREAS PURSUANT TO Section 210 of the Community Charter the costs of local area
service works shall be charged against parcels benefiting or abutting the work, payable by a
parcel tax levied by year for the requisite number of years;

AND WHEREAS pursuant to the “Local Area Service (3 Avenue, 8 Avenue and 202 Street
Water Main) Construction Bylaw 2007 No. 4587” work has been constructed as a local area
service;

NOW THEREFORE, the Municipal Council of the Corporation of the Township of Langley, in
Open Meeting Assembled, ENACTS AS FOLLOWS:

1. This Bylaw may be cited for all purposes as “3 Avenue, 8 Avenue and 202 Street
Water Local Area Service Tax Bylaw 2009 No. 4732”.

2. In this Bylaw the definitions, equations and intent are the same as those set out in
Local Area Service Policy No. 05-0740 as approved by Township Council initially on
September 21st, 1998 and subsequently amended.

3. A local area service tax is hereby imposed and shall be levied for each of the years
2009 through to and including 2028 (twenty years) upon the parcels of land as listed
and described in Schedule “A”, attached hereto and forming a part of this Bylaw.

4. The local area service tax levied under this Bylaw on each parcel of land is the
product of the taxable frontage and the annual rate.

5. a) The annual rate in any year unless commuted is $25.3570 per taxable meter.

b) The actual frontage for 2009 under this bylaw is 2,946.03 meters.

c) The total taxable frontage for 2009 under this bylaw is 2,573.36 meters.

d) Commutation of the local area service tax shall be permitted after confirmation
and authentication of the local area service tax by the parcel tax review panel.

NOW THEREFORE, the Municipal Council of the Corporation of the Township of Langley, in
Open Meeting Assembled, ENACTS AS FOLLOWS:

1. This Bylaw may be cited for all purposes as “8 Avenue – West of 200 Street Water
Local Area Service Tax Bylaw 2009 No. 4733”.

2. In this Bylaw the definitions, equations and intent are the same as those set out in
Local Area Service Policy No. 05-0740 as approved by Township Council initially on
September 21st, 1998 and subsequently amended.

3. A local area service tax is hereby imposed and shall be levied for each of the years
2009 through to and including 2028 (twenty years) upon the parcels of land as listed
and described in Schedule “A”, attached hereto and forming a part of this Bylaw.

4. The local area service tax levied under this Bylaw on each parcel of land is the
product of the taxable frontage and the annual rate.

5. a) The annual rate in any year unless commuted is $14.0849 per taxable meter.

b) The actual frontage for 2009 under this bylaw is 1,717.47 meters.

c) The total taxable frontage for 2009 under this bylaw is 1,402.18 meters.

d) Commutation of the local area service tax shall be permitted after confirmation
and authentication of the local area service tax by the parcel tax review panel.

product of the taxable frontage and the annual rate.

5. a) The annual rate in any year unless commuted is $21.0273 per taxable meter.

b) The actual frontage for 2009 under this bylaw is 1,037.04 meters.

c) The total taxable frontage for 2009 under this bylaw is 991.66 meters.

d) Commutation of the local area service tax shall be permitted after confirmation
and authentication of the local area service tax by the parcel tax review panel.

4. The local area service tax levied under this Bylaw on each parcel of land is the
product of the taxable frontage and the annual rate.

5. a) The annual rate in any year unless commuted is $23,180.79 per taxable parcel.

b) The actual frontage for 2009 under this bylaw is 1 parcel.

c) The total taxable frontage for 2009 under this bylaw is 1 parcel.

d) Commutation of the local area service tax shall be permitted after confirmation
and authentication of the local area service tax by the parcel tax review panel.
