APPLICATION FOR ARREST WARRANT

TO: A Judge of the Superior Court

The undersigned hereby applies for a warrant for the arrest of the above-named accused on the basis of the facts

The undersigned affiant, being duly sworn, deposes and says:


I am a duly sworn officer of the Hartford Police Department and have been since 9/22/06. I currently hold
the rank of Police Officer and have been trained to investigate theft of utility service and larceny complaints.

On February 5, 2009 I was dispatched to 153 Adams Street, 3rd floor, on a larceny complaint. When I
arrived to the location with Officer Cornell, we spoke with Complainants Timothy Manson and Lisa
Schweitzer. Manson stated that their electric bill from Connecticut Light & Power for their 3rd floor
apartment at 153 Adams Street has been regularly $58.67 prior to 10/19/05. Manson stated that over the past
three and a half years their electric bill for their home has increased to between $60.00 and $291.30 per
month. Manson and Schweitzer stated that they were confused as to the increase in their bill balances but
thought that there may have been electronics left on in their apartment through out the day.

As the bills continued to increase, Manson questioned their landlord and the homeowner, Accused Gregory
Simon, about which electric box metered the electricity being used in their apartment and if there was
something wrong with it. Accused Simon stated to Manson that the electrical switch box in their apartment i*
what controlled their electricity and that there was nothing wrong "nth it.

The bills eventually increased to the point that Manson and Schweitzer were unable to make payments to
CL&P, causing their electricity to be turned off for a total of two months. Manson stated that they had to
change the name on their CL&P account twice due to their credit being so negatively affected and they were
unable to keep up with the payments for the payment plan CL&P put them on as their monthly electric bills
continued to increase.

AFFIDAVIT
The undersigned affiant, being duly sworn, deposes and says:

Manson stated that after years of having no access to the basement of 153 Adams Street, where the electric
meters are located for all three apartments, Manson gained access. The first floor tenants unlocked the
basement door for Manson to enter a couple of days prior to Manson calling the police. Manson observed for
electric boxes and meters on the wall of the basement. Each box was clearly marked 1, 2, 3 and homeowners.
Manson took three pictures of the wiring coming from the box marked with a "3" (standing for the third floor
apartment). These three pictures were secured, tagged and given to the Hartford Police Property Room for
safekeeping. The pictures clearly show wiring between the second and third boxes that should not be.

Schweitzer asked Manson to try switching off the power for the third floor to see what happened. When
Manson turned off the third floor box, Schweitzer stood outside and observed that all the electricity for the
third floor, the second floor and all exterior lighting went out. The next day, Manson and Schweitzer
confronted Accused Simon about the electrically wiring of their box. Accused Simon stated to them that he
had just needed the electricity for a couple days and that he would pay them back. Manson and Schweitzer
contacted the police when they realized Accused Simon had been the cause of their high electrical bills and
Accused Simon had not been using their electricity for a couple days, but for 49 months.

Manson provided me with three statements from Connecticut Light & Power which state how much
electricity was used and the amount billed to the complainants each month from KV19/05 to 1/30/09. The
total amount of additional charges made to the 3rd floors electric bill by Accused Simon was $3,422.61. This
total was come to by adding all the monthly bills together from 10/19/05 to 1/30/09 ($6297.44) and
subtracting the total average normal bill amount $58.67 multiplied by the 49 monthly bills ($2,874.83).

After speaking with the complainants, Officer Cornell and I went to the second floor of 153 Adams Street
where Accused Simon was doing extensive renovation work with several other workers. Accused Gregory
Simon identified himself to us as the homeowner and landlord of this address. When Accused Simon was
asked about the rewiring of the electrical boxes in the basement and the use of the third floors electricity
without permission, Accused Simon admitted that he had rewired the electrical boxes as he has an electrician
license. Accused Simon stated that he had started taking the electricity because the second floor apartment
had been vacant since September 2008 and in November 2008 as the weather became cooler he feared that the
pipes might freeze. Accused Simon stated that he did not think this would "be a big deal" and that he intended
to pay Manson back for the cost between November 2008 and January 2009. When asked why he did not use
the Homeowner/Landlord electric box which was active, Accused Simon stated that he had been getting a
divorce and needed relief on his bills.

AFFIDAVIT
The undersigned affiant, being duly sworn, deposes and says:

When I explained to Accused Simon in detail the problems and stresses that his actions had caused this
family, Accused Simon attempted to make excuses as to why his behavior was okay. Accused Simon stated
that he had asked the family if he could use their electricity and that they had said no. Accused Simon stated
that he had been going through a tough divorce and thought it couldn't hurt anyone to use "just a little bit of
electricity." Accused Simon admitted to using the third floors electricity while renovating the second floor.

Once I finished explaining to Accused Simon that copies of the third floor tenants electric bills would be
collected and pictures of his rewiring of the boxes had been taken, Accused Simon stated that he never
realized that the bills had been so high or that the third floor had lived without electricity for two months due
to his actions.

Accused Simon clearly and admittingly engaged in tampering with the equipment supplying 153 Adams
Street, 3rd floor, with electricity from Connecticut Light & Power, of which could not have properly metered
measurements in part. Accused Simon profited from this act as he did not have to pay for any electricity used
at this address for 49 months. The total monetary amount of electricity which he stole and cost Manson and
Schweitzer is $3,422.61.

Based on the above facts, statements and observations I respectfully request that a warrant be issued for the
arrest of Accused Gregory Simon for the violations of the Connecticut General Statutes 53a-127c, Theft of
Utility Services; and 53a-124, Larceny in the 3rd.
