13-06-02 Suspected murder of Chief Clerk of the Israeli Supreme

Court in 2002 additional information filed with the Israel
Police.
In 2002 Chief Clerk Shmaryahu Cohen died under suspicious
circumstances in office, and a complaint was then filed by a
relative/acquaintance alleging murder. However, in 2002, family
and friends of Mr Cohen could not provide a plausible motive for
the murder. Today, additional information was filed with the Israel
Police by Joseph Zernik, PhD, of Human Rights Alert (NGO),
providing evidence that the motive was unlawful takeover of the
Israeli Supreme Court electronic record systems. As Chief Clerk,
Mr Cohen held the ultimate administrative authority for the
Supreme Court's servers, and probably held the relevant
passwords and access authorities. Following his death, numerous
decision records of the Israeli Supreme Court were falsified and
forged and today's electronic records, according to the 2013
United Nation's Human Rights Council report suffer from lack of
integrity. Since the death of Chief Clerk Shmaryahu Cohen, the
office is occupied by Ms Sarah Lifschitz with no lawful appointmnet
record, and her conduct should be deemed establishment of a
simulated Office of the Clerk.

relative to the death of Supreme Court Chief Clerk Shmaryahu Cohen,
and b) April 16, 2012 Complain No 158921/2012 filed by Joseph Zernik

Occupy Tel Aviv Encampment
The Complainant is not an attorney, and therefore he does not provide reference to
sections of the code, violations of which are subject of instant complaint. Only the
facts are described below.
The Complainant has no direct connection to events in 2002. The new evidence was
discovered through academic research of the electronic record systems of the courts of
the State of Israel. The findings from such research are crossed with:
a. March 27, 2002 Complaint filed in Yarkon District by Oholivah Peretz

Izescu, relative to the death of Supreme Court Chief Clerk Shmaryahu

Cohen (Appendix A) [1]
b. The 2010 State Ombudsman Report, regarding computerization of the courts
of the State of Israel. [2]

with a note referring to Lack of integrity of the electronic records of the

Supreme Court... of Israel. (Appendix C) [4]
e. Recent (2013) complaints filed by the Complainant with Presiding Justice of
the Supreme Court Asher Grunis, pertaining to false and deliberately
misleading registrations by the Office of the Clerk of the Supreme Court. [5]
Therefore, the Complainant asks that the Israel Police re-open investigation in
the following two interrelated matters:
a. Circumstances of the death of Mr Shmaryahu Cohen in 2002, and
b. Conduct of Ms Sarah Lifschitz as Chief Clerk since then.
The Complainant doubts that the Israel Police is able to address such
investigation, and in parallel will forward instant complaint to other authorities,
hoping that justice is made in this matter, which pertains to the foundation of
the regime of the State of Israel.

2. Suspects
The Complainant cannot identify those, who are suspects in causing the death of
Chief Clerk Shmaryahu Cohen in 2002. However, the Complainant holds that the
following individuals are able to assist in the investigation:
a. Mr Aharon Barak Presiding Justice of the Supreme Court in 2002;
b. Mr Boaz Okon Magistrate Judge of the Supreme Court in 2002.
c. Ms Sarah Lifschitz who occupies the office of the Chief Clerk with no lawful
appointment record since 2002.

3. Brief Summary of Events

a. According to media reports, on March 7, 2002, in the afternoon, Chief Clerk
Shmaryahu Cohen died of cardiac arrest in office after raising a toast for a retiring
employee of the Office of the Clerk.
b. Appendix A indicates that on March 27, 2002, Ms Oholivah Peretz Izescu filed
complaint with the Yarkon Police District, pertaining to the circumstances of the death
of Mr Cohen, which appeared to her and many other suspicious. Appendix A and
other sources indicate that the Complainants in 2002 had difficulty providing a
plausible motive for the killing.
c. Absent any detailed knowledge of the content of Ms Perez Izescu's filing in 2002,
instant Complainant offers the following information:
1. As Chief Clerk, Mr Cohen was custodian of the records of the Supreme Court of
the State of Israel, and in charge of certifying their integrity. Therefore, Mr
Cohen held the ultimate administrative authority for the servers of the electronic
records of the Supreme Court, including various passwords and access
authorities.

2. Academic studies by the Complainant and a report he submitted to the United

Nations Appendix C and which was incorporated into the official UN report
on Human Rights in Israel (2013) show that following the death of Mr Cohen,
integrity of the electronic records of the Supreme Court was seriously
compromised: each record today bears a disclaimer subject to editing and
phrasing changes, no record is certified by the Chief Clerk, and the Chief Clerk
and Office of the Clerk are not mentioned in the records. Additionally, current
Chief Clerk Sarah Lifschitz is not ready, willing, able to certify any decisions
of the Supreme Court True Copy of the Original. The Human Rights Alert
submission also recorded a large number of forged decision records of the
Supreme Court, which were purportedly certified by him years after his death.
3. In a case, documented in a previous Complaint with the Israel Police
(158921/2012) Appendix B Ms Lifschitz issued false and deliberately
misleading certification of Supreme Court decisions.
4. As detailed in the previous Complaint (158921/2012) Appendix B Ms
Lifschitz most likely does not hold a lawful appointment record as Chief Clerk
to this day.
5. The 2010 State Ombudsman's Report 60b, pertaining to computerization of the
courts of the State of Israel, indicates that in the process, which took place in
the preceding decade, the servers of the electronic records of the courts were
extracted from the custody of the chief clerks, in violation of the law of the
State of Israel, and transferred to the custody of an unnamed corporation.
6. Correspondence with the Presiding Justice of the Supreme Court in recent
months (2013) documents dishonest conduct in the Office of the Clerk of the
Supreme Court, including, but not limited to persistent false and deliberately
misleading registration of records filed with the Court.
Therefore, following the death of Shmaryahu Cohen in 2002, authority of the Office
of the Clerk was voided, and today a simulated Office of the Clerk is conducted under
Ms Sarah Lifschitz.
4. Conclusion
As Chief Clerk, Mr Shmaryahu Cohen was the lawful custodian of the records of the
Supreme Court of the State of Israel, including the electronic records. In 2002 he died
under suspicious circumstances. Following his death integrity of the Supreme Court
records was seriously compromised: many forged records were identified, and all
records are published in a patently void form. According to the State Ombudsman's
Report, concomitantly, the servers for the electronic records were extracted from the
custody of the chief clerks.
Since the death of Mr Shmaryahu Cohen, Ms Sarah Lifschitz occupies the same office
with no lawful appointment record. A previous complaint, filed with the Israel Police,
documented execution of false and deliberately misleading certification of Supreme
Court decision records by Ms Lifschitz.
Therefore, the Complainant offers that the motive for the killing of Mr Shmaryahu
Cohen was unlawful takeover of the the electronic records of the Supreme Court,
which were under his custody, and that conduct of Ms Lifschitz today as Chief
Clerk amounts to the establishment of a simulated Office of the Clerk in the Supreme
Court of the State of Israel.

the State of Israel
The complaint pertains to the issuance of false and deliberately misleading judicial records, misrepresented
as certified decisions of the Supreme Court. The complaint also notes that the nature of SARAH
LIFSCHITZs appointment remains unclear. Therefore, in case she holds a valid appointment as Chief Clerk,
her conduct should be deemed honest services fraud, and in case her appointment is invalid false pretense
in appearing as Chief Clerk.

Executive Summary
Jerusalem, April 16 - criminal complaint was filed with the Israel Police by Joseph Zernik, PhD, of

2. Complainant is not an attorney, neither is he represented by counsel in this
matter; Complainant has specialized in analysis of integrity, or lack thereof, of
government and banking electronic record systems.
Given that Complainant is not an attorney, special lenience is requested in review of the
complaint. No sections of the code were specifically referenced. Where errors were made in
reference to the legal definition of the alleged crimes, Complainant requests that such
references be disregarded. Instead - the facts alone should be reviewed, and the correct
sections of the code be applied by the investigators.
Over the past decade, Complainant specialized in analysis of integrity, or lack thereof, in large
government and banking electronic records systems. [i ]
3. Accused
Sarah Lifschitz []
Residence:
Unknown
Work:
Supreme Court of the State of Israel, Jerusalem
4. Allegations
Complainant alleges that SARAH LIFSCHITZ engaged in:
a) Fraud through Falsification of Court Records [ -;]
b) Undermining Legal Process [] , and
c) To the degree that SARAH LIFSCHITZ was duly appointed as Chief Clerk of the
Supreme Court Honest Services Fraud [ ;] alternatively, in case she
was not duly appointed as Chief Clerk False representation as Chief Clerk of the
Supreme Court [] .
The conduct of SARAH LIFSCHITZ, documented in instant complaint, undermines the
Rule of Law, and the Human Rights of all residents of the State of Israel.
5. Chronology
a) Background
Upon information and belief, sometime during 2003, SARAH LIFSCHITZ started
appearing as Chief Clerk of the Supreme Court of the State of Israel. However, the exact
nature of her position in the Supreme Court remains unknown (see below).
Complainant resided in the United States until April 2010, and has no direct knowledge
of conduct of SARAH LIFSCHITZ prior to his return to Israel.
Upon his return to Israel, Complainant initiated a study of the electronic records of the
courts of the State of Israel, including, but not limited to, the Supreme Court. [ ii ]
The study was based on data-mining of the online public electronic records of the
Supreme Court, as well as submission of papers in the Supreme Court, and analyzing
their registration and disposition. [ iii ]

2/7

Complainants study identified fundamental deficiencies in the integrity of the records

that are published in the online public access system of the Supreme Court. As a rule, all
online records, which have been published later than March 2002, appear void of any
legal validity. Such records are not signed by the justices of the Supreme Court, not
certified by the Chief Clerk, and bear a disclaimer, subject to editing and phrasing
changes.
Additionally, Complainants study documented that purported decisions of the Supreme
Court were not duly served, as required by the law of the State of Israel.
b) SARAH LIFSCHITZ issued false and deliberately misleading records and
misrepresenting them as certified decisions of the Supreme Court.
In order to ascertain the nature decisions, which were published and served in an invalid
form, Complainant attempted to have such decisions of the Supreme Court certified by
the Chief Clerk of the Supreme Court, pursuant to the Regulations of the Courts Office
of the Clerk (2004), Regulation 6a. [ iv ]
As part of his efforts to have the decisions certified, Complainant corresponded with
SARAH LIFSCHITZ.
In her February 29, 2012 letter SARAH LIFSCHITZ indicated that Complainant should
address such requests for certification directly to her. [ v ] (Exhibit 1)
On or about March 12, 2012, and March 25, 2012, Complainant forwarded requests for
certification to the attention of SARAH LIFSCHITZ. [ vi , vii ] (Exhibit 2, 3)
In response, Complainant received the March 29, 2012 letter from SARAH LIFSCHITZ.
Attached to the letter were copies of three purportedly certified decisions of the Supreme
Court. [ viii ] (Exhibit 4)
Upon examination of the purportedly certified decisions, Complainant concluded that the
records provided under the signature of SARAH LIFSCHITZ, as Chief Clerk of the
Supreme Court, were false and deliberately misleading court records, for the following
reasons (Figures 1,2):
i. If valid original judicial records had existed for any of the three decisions,
they would have been the records signed by the respective justices/judges.
The records at hand are not signed by the justices/judges.
ii. Valid, certified court records cannot possibly be subject to editing and
phrasing changes, as indicated in the disclaimer on the records at hand.
iii. The certification statement used by the Chief Clerk on the records at hand is
invalid:
o The Regulations of the Courts - Office of the Clerk (2004), Regulation 6a,
explicitly states, that the certification statement, which the Chief Clerk is
permitted to execute is Copy Corresponds to the Original [
] .
o The March 29, 2012 cover letter of the records, signed by Chief Clerk
SARAH LIFSCHITZ, also purports the same: that the attached records
bear the certification statement, Copy Corresponds to the Original.
o In contrast, the attached records are stamped Copying Corresponds to the
Original [] .
iv. The records were misleadingly stamped with the Seal of the Supreme Court.

3/7

Figure 1

Figure 2

Excerpt from one of the three records, recently provided by Chief Clerk SARAH LIFSCHITZ, Supreme Court
of the State of Israel. The excerpt says: "Issued today, September 21, 2011", then shows spaces for the
signatures of three justices. The footnote says, "copy subject to editing and phrasing changes", then shows
the Seal of the Court, and the invalid, false certification stamp, "Copying Corresponds to the Original," with
the hand signature of the Chief Clerk and the date of March 29, 2012.

On or about April 4, 2012, Complainant forwarded to SARAH LIFSCHITZ a request for

new certification of the three records, correcting the deficiencies found in the records at
hand. [ ix ] (Exhibit 5)
No response on the request has been received to this date.
Therefore, SARAH LIFSCHITZ issued false and deliberately misleading court records
and misrepresented them as certified decisions of the Supreme Court. Complainant
alleges that in doing so, SARAH LIFSCHITZ engaged in Fraud and Deceit through the
Falsification of Court Records [ -] , and
Undermined Legal Process [] .
c) The nature of SARAH LIFSCHITZs appointment in the Supreme Court
remains vague and ambiguous.

4/7

The findings, pertaining to the records, provided by SARAH LIFSCHITZ as certified

decisions of the Supreme Court, were not unique. Other findings also raised doubts
relative to the nature of SARAH LIFSCHITZs appointment in the Supreme Court. [ x ]
On or about March 2, 2012, Complainant filed a request with the office of Administration
of Courts, pursuant to the Freedom of Information Act (1988) (the Act), seeking the legal
public record, which is the appointment record of SARAH LIFSCHITZ as Chief Clerk of
the Supreme Court. [ xi ]
The March 6, 2012 response by the office of Administration of Courts denied the request.
The response claimed that the requested record was exempt from the Act, as a record of
internal deliberation. [ xii ]
On or about March 28, 2012, Complainant filed a request for reconsideration with the
office of Administration of Courts. Complainant claimed that it was inherent to Due
Process/Fair Hearings rights to unequivocally ascertain the identity of the person, who
lawfully held the authority of Chief Clerk of the Supreme Court. [ xiii ]
Complainant has not received to this date a response on his request for reconsideration.
On or about March 29, 2012, Complainant also forwarded a request to SARAH
LIFSCHITZ, to clarify the nature of her appointment by providing a copy of her
appointment record as Chief Clerk of the Supreme Court. [ xiv ] (Exhibit 6)
Complainant has not received to this date a response from SARAH LIFSCHITZ on his
request.
Therefore, the nature of SARAH LIFSCHITZs appointment in the Supreme Court
remains vague and ambiguous. Complainant alleges that in providing the false and
deliberately misleading records (Figures 1, 2) SARAH LIFSCHITZ engaged Honest
Services Fraud [ ] in case she was duly appointed as Chief Clerk of the
Supreme Court; alternatively, in case SARAH LIFSCHITZ was not duly appointed as
Chief Clerk, she engaged in Falsely Representation as Chief Clerk of the Supreme Court
[] .
6. The conduct, documented in instant complaint undermines the fundamentals of
Due Process/Fair Hearings, the Rule of Law, and the Human Rights of all
residents of the State of Israel.
The conduct of SARAH LIFSCHITZ, documented in instant complaint undermines the
integrity of the Supreme Court of the State of Israel, and with it, the Rule of Law, and the
Human Rights of all residents of the State of Israel.
7. Request for due process in acceptance, acknowledgement, review, and informing
Complainant of the outcome of instant complaint.
Complainant requests that the Israel Police acknowledge receipt of instant complaint, enter
valid registration of the complaint, subject the complaint to honest and expedient review, and
duly inform Complainant of the outcome of such review.
8. Additional evidence and records are provided in the attached exhibits, in records
linked below, and in respective Supreme Court files
For the sake of brevity, only the critical evidence was summarized above.

5/7

Additional evidence and records are provided in the attached exhibits, in records linked
below, and in respective Supreme Court files. Please consider such records, as integral
part of instant complaint.
If any additional records, pertinent to instant complaint are received by Complainant, he
would promptly forward copies to the Israel Police.
Please do not hesitate to contact Dr Zernik for additional information in this matter.

RE: Your letter (undated) in re: Electronic record systems of the Supreme Court
Dear Chief Clerk Lifschitz:
Thanks for the letter, referenced above. In part the letter says:
Any party interested in getting a stamped certification on a decision of the court may call
or write the court and request to receive such certification and that will be provided.

I have previously visited the Office of the Clerk of the Supreme Court and asked in
person for the certification of three decisions of the Court. My request was denied, and
the staff of your office instructed me that certification was provided only upon explicit
order of the Supreme Court. Therefore, I was instructed to file motions under the
respective cases, requesting the certification.
Consequently, I filed such motions, as instructed. [i-v] No decision of the Court on any
of the motions was received to this date.
Separately, I have previously filed two requests for apostille certification of public
records of the Supreme Court, which were intended for international review, with the
office of Courts Administration. [vi-viii] Neither records was apostille certified to this
date.
Following your letter, I ask that you deem the requests, [i-viii] as addressed to you.
In case the certification of any of these records cannot be provided by your office, I
would be grateful if you could provide the reference in the law of the State of Israel for
that.
Truly,

in re: Electronic record systems of the Supreme Court -- Request for certification of
the December 4, 2011 Decision in Dr Joseph Zernik v Office of the Clerk of the
Supreme Court (8835/11)
Dear Chief Clerk Lifschitz:
In continuance of my letter, dated March 12, 2012, in which I requested the certification of
certain records of the Supreme Court, I request to add the following record to the list:
1) December 4, 2011 Decision in Dr Joseph Zernik v Office of the Clerk of the Supreme
Court (8835/11)
I recently noticed that the above referenced decision is published online, although I had never
received a copy of it from the Office of the Clerk at all. Under the same caption and case
number, no record is published as filed by Dr Joseph Zernik, and therefore, it remains unclear
what the decision is originating in.
In case your office is not ready, willing, able to certificate the above referenced decision, I would
be grateful if you state so in writing in response to this request.
Truly,

12-03-29 Chief Clerk Sarah Lifschitzs letter and copies of three unsigned decisions of
the Supreme Court, bearing false clerks certifications (Eng + Heb)
The certification statement is not the one authorized by law, neither the name and authority of the Chief
Clerk, nor the true date appear in the certifications. The fact that such stamp exists, and that Chief Clerk
Sarah Lifschitz uses it, must raise serious concerns. Since all three decisions are claimed to be simulated,
illegal public records, the false certifications should also be deemed deliberately misleading.

Brief Overview:
All three decisions originated in challenged by Dr Zernik regarding integrity of the records of the Supreme
Court of the State of Israel.
The cover letter states that it responds to letters by Dr Zernik, received on March 13, 2012 and March 25,
2012, which requested certification of decisions and records of the Supreme Court. [1-2]

Copy Corresponds to the Original

Copying Corresponds to the Original
b.

a. Certification statement, as authorized by the Regulations, b. Certification statements on the stamp used by Chief Clerk Lifschitz.

All three certifications are deemed defective, for the following reasons:
The Regulations of the Court Office of the Clerk (2004), Regulation 6a (amended 2005) explicitly states,
that the certification, which the Chief Clerk may issue is Copy Corresponds to the Original (Heeteq
Matim la-Maqor). [3]
The March 29, 2012 Chief Clerk Sarah Lifschitz cover letter also purports that the attached records bear
the stamp Copy Corresponds to the Original (Heeteq Matim la-Maqor).
The individual copies of the decisions (which were not signed by the issuing judges), were stamped
Copying Corresponds to the Original (Haataqah Matimah la-Maqor).

z Page 2/3

April 4, 2012

The certification stamp fails to show the name and authority of the signer (e.g. Sarah Lifschitz, Chief
Clerk)
Since the original legal records in this case should have been decisions records, signed by the issuing
judges, it remains vague and ambiguous, why the Chief Clerk certified unsigned copies of the decisions.
The Chief Clerk refused to certify other decisions/records, with no foundation in the law.
On March 4, 2012, request was forwarded to the Chief Clerk, for correction of the certifications of all three
decisions. [4]

Dear Sir:
Receipt of your letters, received by the Office of the Clerk on March 13, 2012 and March 25, 2012, is
gratefully acknowledged.
At your request, attached are three decisions, corresponding to proceedings in which you were a party
stamped copy corresponds to the original.
Decisions, where you were not a party, are available for your inspection in the web site of the
Supreme Court.
Regarding your request for Apostille certification of the Ethics Rules for Judges [by Presiding Justice

Regretfully, I was unable to figure out other requests, detailed in your letters.

RE: Request for corrected certification of copies of three (3) decisions of the
Supreme Court, provided with your letter dated March 29, 2012.
Dear Chief Clerk Lifschitz:
Thank you for your letter, dated March 29, 2012, and the attached copies of the following three
(3) decisions: [1]
1. 11-12-04 Decision in Zernik v Office of the Clerk of the Supreme Court (8835/11)
2. 11-09-12 Decision in Katzav v State of Israel (3372/11)
3. 11-09-07 Decision in Zernik v State of Israel (6041/11)
The certifications of all three decisions are deemed deficient, for the following reasons:
The original legal records in this case are the decisions records, which were signed by
the issuing judges and are presumably maintained in your office, not the unsigned
copies, which were provided.
The Regulations of the Court Office of the Clerk (2004), Regulation 6a (amended
2005) prescribes, that the certification, which the Chief Clerk may issue is, Copy
Corresponds to the Original (Heeteq Matim la-Maqor). The stamp, used in the
certification of the decisions, referenced above, states, Copying Corresponds to the
Original (Haataqah Matimah la-Maqor).

Therefore, I would be grateful if you could kindly provide certified copies of the same
three (3) decisions, as outlined above.

RE: Request for comments in re: Appointment of the Chief Clerk of the Supreme
Court and certification procedures of its electronic records.
Dear Chief Clerk Lifschitz:
Linked below are communications with the office of Administration of Courts, in re:
Freedom of Information Request (P29-2012), pertaining to the appointment records of the
Chief Clerk of the Supreme Court and certification procedures of its electronic records.
The denial letter claimed exemption for the records under a clause for internal
deliberations. [1-3]
The most plausible explanation for this exchange is by accepting the response of the
Administration of Courts verbatim: Both the appointment of Chief Clerk Sarah Lifschitz
and the certification procedures of electronic records of the Supreme Court have been left
in "deliberations" for years.
Also linked below is the draft Executive Summary and Short Report, part of Human
Right Alerts submission for the 2012 Universal Periodic Review (UPR) of Human
Rights in the State of Israel by the Human Rights Council of the United Nations. [4] The
submission is narrowly focused on conditions of the electronic record systems in the
courts, particularly in the Supreme Court. The submission alleges that current conditions
in the Office of the Clerk of the Supreme Court undermine the integrity of the justice
system of the State of Israel and amount to serious violations of the Human Rights of all
who reside in the State of Israel.
Therefore, I would be grateful for any response by you, regarding the nature of your
current appointment as Chief Clerk of the Supreme Court and the certification procedures
of the electronic records of the Court.
