Chair of the Constitution, Law, and Justice Committee David Rotem was initially asked to establish a Parliamentary Investigation Committee regarding allegation of corruption in the Office of the Clerk of the Supreme Court, following events surrounding the death of former Chief Clerk of the Supreme Court in 2002 under suspicious circumstances. Chair Rotem responded that he was confident that the Israel Police would perform it duties on the best side on related complaints, which had been filed in the same matter. In a follow up request, Chair Rotem is asked to at least establish, whether Chief Clerk Sarah Lifschitz, who occupies the office of Chief Clerk of the Supreme Court for over a decade, holds a lawful appointment record. Dear MK Rotem: According to the Committee's web site, its purview includes court procedures. Therefore, the Committee is an appropriate authority in this matter. Regardless, it is unreasonable in a civilized state, that existence or lack thereof, of a Chief Clerk in the Supreme Court would be kept secret from the public. I again request a response by the Constitution, Law, and Justice Committee: Is there a lawfully appointed Chief Clerk in the Supreme Court of the State of Israel? Dear MK Rotem: Thank you for the expedient response, copied below, pertaining to Request for establishing whether Chief Clerk of the Israeli Supreme Court holds a lawful appointment record. I would like to correct your response: a. There are no complaints, only one complaint (158921/2012) against Ms Sarah Lifschitz. b. The above complaint was filed with the Israel Police over a year ago, but to this date I have heard nothing at all from Israel Police regarding investigation of the complaint. Therefore, the conduct of Israel Police in this matter is inconsistent with your assumption that he appropriate authorities would perform their duties on the best side. I would add that the UN Human Rights Council Report (2013) states: Lack of integrity in the electronic records of the Supreme Court... in Israel (paragraph 25, Professional Staff Report). The report was based on data filed by Human Rights Alert (NGO), which showed numerous decision records of the Supreme Court under the purported tenure of Sarah Lifschitz, which were purportedly certified by Chief Clerk Shamaryahu Cohen up to five (!) years after his death. Academic papers, pertaining to lack of integrity in the electronic records of the Supreme Court were also presented and published in international computer science conferences, subject to anonymous peer-review. Furthermore, as detailed in the correspondence below, both the executive branch (Israel Police) and the judicial branch (Administration of Courts) refuse to answer on this matter. Therefore, addressing the question to the Knesset's Constitution, Law and Justice Committee is a last resort in this matter. Under such circumstances, it is unreasonable to deny the public access to information, which should have been public in the first place, and which is essential for the rule of law in the State of Israel: Is there a lawfully appointed Chief Clerk in the Supreme Court of the State of Israel? Therefore, please accept a repeat request for establishing whether Chief Clerk of the Israeli Supreme Court holds a lawful appointment record. Dear MK Rotem: Thank you for your response, copied below, regarding Request for the immediate establishment of a Parliamentary Investigation Committee regarding corruption in the Office of the Clerk of the Supreme Court, following events surrounding the death of Chief Clerk Shmaryahu Cohen in 2002. Following up on your response, I would be grateful if the office of Chair of the Constitution, Law, and Justice Committee could provide a clear answer on at least one aspect of the matter: Does Ms Lifschitz occupy the office of Chief Clerk of the Supreme Court pursuant to a lawful appointment record?
There is no doubt that such matter falls under the purview of the Committee, as a matter of Court procedures, and there is no doubt either, that the Committee is able to easily provide a clear answer on such simple question. Although a complaint, pertaining to this particular aspect (accompanied by indisputable evidence) was filed with the Israel Police over a year ago, [1] no response was received regarding progress in investigation of the complaint to this date. Therefore, regardless of your confidence that the appropriate authorities would perform their duties on the best side, there is a reasonable foundation to suspect that such is not the case at all in this sensitive matter. There is no doubt either, that such particular matter is funereal to the rule of law in the State of Israel. Therefore, I would be grateful if the offices of the Chair of the Knesset's Constitution, Law, and Justice Committee could help in ascertaining the lawful appointment, if any, of Ms Sarah Lifschitz as Chief Clerk of the Supreme Court.

To this date no confirmation of receipt was received, as requested. On the other hand, confirmations of receipt were received from the offices of other Mks, both members and non-members of the Constitution, Law, and Justice Committee. Events in the Supreme Court in 2002 should be seen as second in significance only to the murder of Prime Minister Yitzhaq Rabin in 1995, relative to the nature of the regime in the State of Israel today.
