NIAGARA FALLS ZONING BOARD OF APPEALS CITY OF NIAGARA FALLS, NEW YORK

A hearing of the Niagara Falls Zoning Board of Appeals will be held on Tuesday, June 18, 2013 at 5:30 p.m., in Council Chambers, First Floor, City Hall. APPLICANT OR REPRESENTATIVE MUST BE PRESENT A-3948 Brian Veihdeffer, as owner of property located at 7810 Lindbergh Avenue. Applicant is proposing to erect a detached garage in the rear yard. The maximum allowed in area is 1000 square feet. The applicant is requesting 1080 square feet; therefore, requesting a variance of 80 square feet. The maximum coverage allowed is 30% of the rear yard which equals 612 square feet. The applicant is proposing 1080 square feet of coverage; therefore, requesting a variance of 468 square feet of coverage. Maximum height of garage shall be no higher than 16 from finished grade to peak. The applicant is proposing a height of 18 from finished grade to peak; therefore, 2 in height variance. A-3949 Sheikh R. Elahi, as applicant of property located at 452 3rd Street. The applicant is proposing to convert an existing commercial building into a hotel. The Zoning Ordinance requires 9 parking spaces. The applicant is proposing 6 parking spaces; therefore, requesting a variance for three parking spaces. U-3950 Faisel Haruna, as applicant of property located at 424 24th Street. The applicant is requesting to open a convenience store. A retail store is not allowed in a R3-B zoning district. Therefore, the applicant is requesting a use variance to open a retail store in this zoning district. A-3951 Carmine Bianco, as owner of property located at 9348 Champlain Avenue. The applicant is proposing to erect a 6 fence in the rear yard which is the front yard of a neighboring house. The part of applicants rear yard that abuts the front yard of the neighboring property allows only a maximum of 4 high fence. The applicant is proposing a 6 high fence, therefore, requesting a 2 in height variance. A-3952 Norampac Industries, Inc. Greenpac Mill LLC, as owner of property located at 4001 Packard Road and 4400 Royal Avenue. The Zoning Ordinance requires the firefighting, police and emergency vehicles access road shall be a minimum of 24 in width. The applicant is proposing said road to be 20 in width, therefore, requesting a 4 in width variance.

A-3953 Peter Nigro, as applicant for property located at 2619 Highland Avenue. Applicant is proposing to open a minor motor vehicle repair shop. The Zoning Ordinance does not allow a minor motor vehicle repair shop in a C1-A zoning district. Therefore, the applicant is requesting a use variance to open a minor motor vehicle repair shop.
