Sergeant Diaz, please sir, could you read the affidavit into the record? THE WITNESS: Yes sir. I, Jose A. Diaz,

being first duly sworn hereby state that my name is Jose A. Diaz. I work at the

administrative division for Miami-Dade Schools Police Department. '63. My date of birth is 6-14 of I am

making the following statement to Sergeant Edward Torrens, who has identified himself as an internal affairs investigator for the Miami-Dade Schools Police Department, State of Florida, in connection with case number IA number 12-001, 002, 003, 004, 005, and 006. am of sound mind and I am not under the influence of drugs and/or alcohol at this time.

I understand that giving false information in this statement is in violation of Florida State Statute 873.05, false reports to law enforcement authority punishable as misdemeanor of the first degree, and 873.06, making false official statements punishable as a misdemeanor of the second degree. Okay, Sergeant Diaz, are you appearing

here today without any promises and without any threats or duress to provide information in an investigation being conducted by the Miami-Dade Schools Police Department? THE WITNESS: MR. TORRENS: Yes sir. Okay are you aware that your

conversation with me is being recorded? THE WITNESS: MR. TORRENS: Absolutely. Are you aware that anything

you say may or may not be used at a departmental hearing or in the court of law? THE WITNESS: Yes sir.

Rodak, possibly Monday or Tuesday, March 26 or March 27, one of the two days there was here at GIU possibly media requesting -- media and/or also an investigator from another agency or an outside agency requesting to view or get copies of or take pictures of the property surrounding reports over this T.M. He had some encounters with some

officers, there are some reports and there was some property impounded. I understand there may have If you can

I don't know exactly whether it was Monday

or Tuesday but I do recall that upon returning from lunch with Lieutenant Rodak, we encountered Ms. Gonzalez and Ms. Wilson out in the table in the outer property area and they informed the lieutenant and I, Rosh Lowe was waiting to get -- you know, to look at some possible evidenced or whatever, regarding T.M. And the lieutenant immediately

stated best to my recollection something like, "He ain't getting shit". Q A Okay, okay. And that he then proceeded to look for Mr.

Lowe in the building and I went and looked outside and I looked in the waiting area but he wasn't

around.

I then came in here and I heard the

lieutenant tell Ms. Gonzalez to go ahead and put the property away and she came and brought it inside here. Afterwards, Ms. Gonzalez and Yvette came in

here also because I was back working at my station and they asked something about oh, they said something to the effect that some investigator or detective from Miami-Dade may be coming by to get the -- to sign out the property. Q A Okay. And I told them I'm not releasing

anything, the lieutenant is not going to release anything so that's not going to happen. Q Okay, all right sir. Okay, and just for

clarity, both of you had returned from lunch -A Q Right. -- and you were informed by Ms. Gonzalez

and/or Ms. Yvette Wilson that reporter Rosh Lowe was here to view or whatever, take pictures of or get information on the property? A Q not -A Q Yes, he strongly affirmed it. He strongly affirmed that he was not -- he

Is there anything that I failed to

ask you that you would like to add to your statement? A Q No, that's about it. Okay, are there any other persons who are

witnesses to the alleged act? A Like I said, I don't know who might have I was just going

contacted prior to us returning. by what we were informed of.

We looked in the

building to make sure we would tell him basically go file a public information request if he wanted anything. Q A Okay sir. But I didn't see anybody else with him or
