Three on rape and robbery charges

Three unemployed 19 year olds have been charged with one count of rape each and one count of robbery. Josai Nabou, Waisale Naimokonino and Daniel Varo Smith appeared before magistrate Thurshara Rajasinghe at the Nadi magistrates court yesterday. The court heard that on April 6 the victim, a 27 year old resort worker was returning home from work when she was allegedly robbed and raped by the suspects. The court heard that the victim was allegedly pulled to a bush behind K Natali building Nadi and threatened with a knife. It was also alleged that the victim sustained injuries to her face as a result of the punch. It was alleged in court that the three suspects took turns in raping her. The court heard that the victims purse was allegedly stolen by the suspects. It contained a digital camera, mobile phone and cash all valued at a $700. Naimokonino and Smith, both of Sabeto Nadi, and Nabou of Nadi back road were arrested shortly afterward at their homes. The court also heard that the suspects were allegedly using the victims phone to make calls when they were apprehended. The case has been transferred to the High Court in Lautoka for the mention on May 22.No pleas have been taken. The suspects have been remanded in custody at the Nadi police station.

Introduction

a) Where and when did the incident happen? - The incident took place in India, in a place called Maldive. This incident happened on the 1st of March, 2013.

Summary This article is about a 15 year old girl who was raped repeatedly by her step father and then had consensual sex with another male partner which she later admitted. The law sentenced her to a 100 lashes (sharp blows with a whip), which she would receive upon her 18th birthday. She was also put under house arrest, meaning she wasnt allowed to go out of the house for about 8 months. The law of the Indian Ocean Nation stated that sex before marriage wasnt allowed. Her step father, if he was charged would receive 25 years in jail for raping her and for murdering the baby (which was born from the repeated rapes). The Rights movements were trying to reduce her punishment.

c) What is the issue of the article or why you chose it? The issue of this article or why I chose it, is because it deals with rape and how it has been affecting the younger generation and even small children. Also, how they cannot stand up for themselves because of being ignorant of the Law.

Ethical concern

1) The 15 year old was raped.

2) A baby was murdered.

3) The male partner/lover was not punished right away.

Justification
1) The woman was raped 1.1) In Article 3 of the Universal Declaration of Human Rights, it states that, and I quote, everyone has the right to life, liberty and security of person. She has the right to feel secure about herself and to live knowing that she wouldnt be harmed. 2) She was robbed 2.1) In Article 3 & 5, it states clearly how we as humans need to be treated and how to treat others. We have the right to speak up when we are going through these types of ill treatment.

3) The teenagers threatened the woman with a knife and injured the woman on her face (by punching her) 3.1 Article 1 is a great example of how the teenagers needed to act. They were accountable for their own wrongs because although they were unemployed, it does not give them the right to torture/punish someone else because of their situation. They have a conscience and should learn to use it wisely.

Consequences
a) How is the victim affected? The victim is affected in several ways, one of which, she will never feel safe/secure about herself and she will always have that memory which hinder her progress socially and professionally as well.

b) How has the incident affected in the scenes? i) Because of their wrong doings, the boys would face their sentence when the ruling from the court came. It would always remain on their record when they would later look for work. ii) If they were put in prison, they would remain there for more several years and would miss out on life. iii) For their families, they would be ashamed and their reputation would not be good. They would also miss the presence of their loved ones.

Resolution
a) What were the right things to do

The right things to do in this situation would be not to involve themselves in rape and robbery. Violence is not the answer to our problems. The boys should have gotten a better education, so that they would have better job/gotten a job. They shouldnt have watched rated movies or pornography that would lead them to feel the need to rape the woman.

b) What is the way forward? How can you stop such things from happening in the future There needs to be workshops dealing with these types of problems. Students need to be taught while at school about the laws that govern our country and the consequences that they will meet if they break it.
