On 9/30/07 I was working in uniform and driving a marked patrol vehicle. At approximately 0300hrs I responded to 1200 W University Ave in reference to a shooting incident. The incident occurred at approximately 0220hrs. Witnesses described seeing a black male suspect wearing a green shirt step to the curb on the north side of 1200 W University Ave. The suspect then pulled out a handgun and fired 4-5 shots into a white Crown Victoria which was facing west in the outside lane and stopped in traffic at W 13th St. The suspect then ran north on foot from the scene through the parking lot of 1250 W University Ave (Holiday Inn). Witnesses advised that after the shots were fired, the driver and back seat passenger of the Crown Victoria exited the vehicle yelling at the shooter. At least one witness stated that the driver exited the vehicle with a handgun and "racked" the action as he exited. The driver and rear seat passenger both re-entered the vehicle and left the scene driving south on SW 13th St. Victim Justin Glass (b/m 7/16/88) was the driver of the Crown Victoria and sustained a non-life threatening gunshot in his right arm. Victim Corey Smith (b/m 11/18/78) was the front seat passenger and sustained a life threatening gunshot to the back of his head. Witness Randal Cason (b/m 4/7/87) was the back seat passenger on the right side and was not injured. Glass drove from the scene directly to Shands UF. Officers arrived on scene and set a perimeter. Officer Byrd located four shell casings in the outside westbound lane at 1200 W University Ave. Sgt Kayes and Officer Byrd cordoned off the crime scene which encompassed a portion of the sidewalk on the north side and the outside westbound lane of 1200 W University Ave. Officer Byrd started a crime scene log. Officer Hallett located an additional shell casing in the Crown Victoria at Shands UF. Cason advised me that when the suspect stepped up to the Crown Victoria and started to shoot, there was another black male with him. Cason stated that the second suspect`s name was Reggie Nelson. Cason advised that after the shots were fired both suspects ran north through the west side parking lot of the Holiday Inn. Cason advised that the incident was part of an ongoing dispute between the suspects and Cason`s brother. Cason advised that there had been a confrontation with the suspects earlier that night at a club downtown. Cason advised that he believed that she suspects had been driving Nelson`s black GMC Tahoe (FL tag GTP3R). Multiple Officers and detectives responded to the scene and Shands UF to interview witnesses. See all supplements. K9 Officer Hope responded to the scene and attempted a track but no suspects were located. Officer Hallett completed a tow sheet for the Crown Victoria and had it placed into secure storage. She also collected the shell casing.

On 09-30-07, at approximately 0230hrs, I responded to 1600 SW Archer Rd, Shands ER, reference to possible gunshot victims arriving at the hospital. Upon arrival, I observed several black males standing around a white Ford Crown Victoria with medical staff and other officers already on scene. I was to stand by with the vehicle as it was involved in a shooting incident downtown. A very emotional black male, identified as Randall Cason, was screaming, "This is my fault!" Cason explained to me that he and another black male, identified by Cason as Reggie Nelson, had gotten into an altercation downtown. Per Cason, the shooting was retaliation from that altercation. Cason later explained that a black Chevy Tahoe had been behind their white Ford Crown Victoria as they were stopped at a red light, located at 1300 West University Ave. Reggie Nelson and a "Hawaiian" male,or possibly a hispanic male, approached the passenger side of the white Ford Crown Victoria. The "Hawaiian" male fired approximately 5 shots into the open front passenger window of the vehicle. Nelson and the other male then fled northbound towards the McDonalds, located at 501 NW 13th st. I collected Cason`s information, and stood by with the vehicle until forensics arrived. I completed a tow sheet for Ofc. Hallet #585. The tow sheet was turned into the midnight patrol tray. Cason stated the "Hawaiian" male was wearing a green shirt and was possibly a UF student and football player.

On 09/30/2007 at approx 0330 hours, while on uniform patrol I was dispatched to 1600 SW Archer Rd (Shands at UF) to assist with person shot incident. Upon arrival, I was directed by Ofc. Hallet (585) to standby the victims vehicle and make sure it was not disturbed by anyone. Ofc. Hallet (585) then gave me her almost completed (except signed) tow sheet to give to the tow truck driver when they arrived. I signed the tow sheet and issued a copy to the University tow truck driver. I then gave the sheet to Ofc. Bowman (741) who advised that she would turn the tow sheet in. That was the extent of my involvement with the vehicle. I then was directed by Sgt. Baker (82) to relieve Ofc. Kennedy (549) who was sitting in Room 2543 (F Space) with victim/Corey Smith. I then made contact with Dr. Velat, the neurosurgeon attending to Smith. Dr. Velat advised that at this time Smith was in stable condition. Dr. Velat advised that Smith had received one gun shot near the back/left side of his head. Dr. Velat advised that the bullet/projectile did not penetrate the skull and that it was still in the skull pending surgery. Shortly after, Smith`s mother, Sandra Hines arrived at Shands at UF. I then made contact with Hines and informed her of Smith`s stable condition. I then stood by and observed Dr. Velat brief Hines of Smith`s condition. Dr. Valet described the "Bone Flap" procedure that he would be performing on Smith. It would involve removing part of the skull to relieve the swelling of Smith`s brain. Dr. Velat advised that the surgery was planned for a time of 0800 hours. That was the extent of my involvement in standing by with Smith.

On 09-30-07 at approx 0225 while on routine patrol, I respond to a shots fired call in the 1200 block of W Univ Ave. I made contact with two individuals that had witnessed part of the incident at 1250 W Univ. (The Dill Deli). Nikki Sondergaard and William Hall advised that as they were coming into the parking lot, they observed heavy traffic backed up from the NW 13 St traffic light eastbound along Univ Ave. In the curbside lane (North side of the roadway) they saw at least 4 sedan type vehicles in a row, with the first one at the light being a white Ford Crown Victoria. After the sedans there may have be a SUV type vehicle but they were not sure. They said that a door on each side of the Ford was open and it appeared that it was the front doors. At about this time they heard was sounded like fireworks or gunfire (4 or 5 shots). They then saw two B/M`s get out of the Ford and they were very angry. They were yelling and pounding on the roof of the Ford with their fists. Numerous other people in the sedans that were behind the Ford all got out of their vehicles and stated screaming and yelling about a shooting. The two B/M`s then got back into the Ford and drove off westbound, and everyone else behind them did the same. They stated that they did not see anyone flee from the scene on foot or in a vehicle. They then went inside Dill`s and GPD officers arrived shortly afterwards. A possible suspect, a large B/M with a lime green shirt (Jeremy J Whitehead), was being detained in handcuffs by Ofc N Byrd in front of Dill`s. I asked Sondergaard and Hall if they believed that he may have been involved in the shooting. They said they did not think so and stated that they thought he had been inside the restaurant before they had entered it. There were also several other patrons of Dill`s in the parking lot that had exited after the shooting. They also advised they had seen Whitehead inside eating prior to the shooting, and that he had exited the business after the shooting had occurred. Based on this information I advised Ofc Byrd that Whitehead could be released, and asked that he get the names of some of the patrons that cleared him of any involvement. I then went to Shands ER and met with Ofc T Bowman in front of the ER entrance. She had secured the Ford Crown Victoria which had shown up at the ER with two shooting victims (Cory Smith and Justin Glass) and a witness, Randall Cason that had been in the vehicle during the incident. She updated me on the victim`s info and briefed me on what Cason had stated to her. I then did a brief interview of Cason to get additional details about the incident. Cason was distraught and emotional, and stated several times that "it should have been him that had been shot and not Cory". I asked Cason why he believed that it should have been him and he stated that it all started at The Venue, Downtown earlier tonight. Cason first explained that the prior weekend his brother had gotten into an altercation with some UF football players at the Venue. Tonight even though his brother was not at the club, Cason said "he was deep" (slang for having several buddies with him for backup) along with the football players being deep. They confronted each other as a group and Cason said "so what are going to do about this" implying to the past altercation. At this point one of the football players attempted to snatch Cason`s gold chain off his neck. The football player was not successful because the chain was thick and then the Venue Bar Staff stepped in and kicked the football players out of the club.

One of the involved players was described as a W/M or "Hawaiian" with a lot of tattoos. Besides the Hawaiian, the other football players involved that Cason knew were the "Pouncey twins" and "Reggie Nelson", a Jax Jaguar player. Cason said that they all frequent The Venue, and have also in the past, been involved in altercations with "high schoolers" at the club. He said he personally knows Nelson and at times has considered him a friend. Approx 45 minutes later, when the club closed, Cason and his friends (unnamed) met the same football players in the parking lot of 238 West. There, they were able to talk things out, shake hands, and everyone was "all smiles". At this point he thought it was all over with and they left the area in Cory Smith`s Crown Victoria. Smith was in the front right, Justin Glass was driving and Cason was sitting in the back right. All of the vehicle`s windows were open and they drove west on Univ Ave from Downtown. Cason advised that when they got to NW 13 St, they were the first car in line, but they were held up by the light. As they were waiting for the light to change, the Hawaiian football player and Reggie Nelson walked up to their car on the right side. Then without saying a work the Hawaiian pointed a small handgun in the front right window and fired five quick shots. Cason saw Smith slump over with blood coming out of the back of his head, at which time the Hawaiian and Nelson took off running towards "McDonalds". Cason then got out of the car and yelled that they had shot his friend. I asked him if he had banged on the roof of the car. He said yes, he did it in a "fit of rage" and then they got back in the car to take Smith to the hospital. At first they were going to go to AGH, but then changed their mind and drove to big Shands. I asked Cason twice about Nelson`s involvement, and he stated the he was sure it was Nelson who came up to the window and ran off with the shooter. He said that "Nelson did not have the gun, he was just there". He also said he was sure that the Hawaiian looking guy was a UF football player, but he did not know his name. At this point in the interview, Inv P Nixon arrived at Shands ER. I briefed her on Cason`s statements and she transported him to the station for further questioning. At approx 0400 hrs, Sandra Hines, the mother of Cory Smith arrived at Shands ER. She had received a call from a relative about the shooting. I briefed her on what had occurred to this point, and took her to the trauma wing on the second floor to be near her son. I made arrangements for her to meet with the Charge Nurse and Victim Advocate. I also had the mother of Justin Glass, who was being treated in the tenth floor trauma wing, meet with her in the waiting room. Ofc J Kerkau stood by with Mrs. Hines until the arrival of Victim Advocate. This concluded my involvement in this case.

On 9-30-2007 I was working in uniform, on patrol, and in a marked unit. At about 0224 hrs I responded to 1300 W University AVE reference to a shooting. Dispatch advised that a black male suspect wearing a lime green shirt was last seen running north from the scene. Ofc. Poirot advised that he need assistance reference to a possible suspect at the front of The Dill Deli, 1250 W University Ave. I arrived on scene and saw that Ofc. Poirot had a black male wearing a lime green shirt, Jeremy Whitehead, in a proned position just outside of the entrance to the Dill Deli. I went and assisted Ofc. Poirot by handcuffing Whitehead. I then patted Whitehead down for weapons and then sat him up. Whitehead did not have any weapons. I then explained to Whitehead that there was a shooting and the description was a black male wearing a green shirt. Ofc. Holt brought a witness to the scene to do a show up verification on Whitehead. Ofc. Holt told me that Whitehead was not positively identified as the shooter. I then released Whitehead from custody. I also spoke with Alfredo Castaneda, a patron at The Dill Deli, who confirmed that Whitehead was in the deli at the time of the shooting and could not have been the shooter. Castaneda said that he did not know Whitehead. I then assisted Sgt. Kays in blocking off the crime scene. The crime scene was the curb side lane of west bound traffic on W University AVE, just to the east of the intersection of NW 13th ST. I located four .380 shell casing at the scene. Three of the shell casings were in the curbside lane and one was within a few inches of the curb. Just west of the shell casings, I located drops of blood on the ground. I placed markers on the ground that next to all items of evidence that I located at scene. I maintained the crime scene integrity until Det. Woodmansee could respond to the scene. I also maintained the crime scene log for those that entered the barricaded crime scene area. When Det. Woodmansee, I assisted him in his processing of the crime scene. I assisted in the crime scene measurements. When all units had cleared the scene, I removed the barricade tape and opened all lanes of traffic on W University AVE.

Upon hearing the call come out that someone had been shot at 1300 W University Avenue I proceeded into the area and began looking for a suspect. The information provided to us was very limited at the time. I drove around for several minutes but found nothing of value to this case. I then went and contacted Sgt. Giles near the scene who advised that an article search needed to be done to the north of the incident location. I searched the area from 1300 W University Avenue north to the car wash on the corner of NW 13th Street and NW 5th Avenue. The area of focus was provided by witnesses who saw where the shooter ran. The search ended with negative results.

On 9/30/07 at approximately 0225 hours, while on uniform patrol (Downtown Detail), I responded to the area of 1300 W. University Avenue in reference to a reported person shot call. While enroute, CCC advised the reported involved victim vehicle, a white Grand Marquis, had left the area, traveling south on SW 13th Street. Due to the nature of the call and the direction of travel of the victim vehicle, I altered my response and went to the Shands @ UF ER. Upon arrival at the ER entrance, I saw a silver Grand Marquis and a white Grand Marquis stopped near the ER entrance. I notified CCC of the vehicles and then went into the ER to gather information. I learned from ER staff there were 2 victims. One victim (Trauma Room #2) had a gunshot wound to the head and the other victim had a gunshot wound to the right upper arm (Trauma Room #4). As VICT #1 was unconscious and being treated by the ER staff, I went to Room #4 and spoke to the second victim. VICT #2 verbally identified himself as Justin Glass b/m 7/16/88. Glass said he and his friends were driving on W. University after leaving Club Venue. Glass said as the stopped in traffic near the Holiday Inn (1250 WUA), an unknown suspect had approached the vehicle`s passenger side. Glass said the suspect fired 5 shots into the vehicle. Glass could not provide any suspect information. When asked to ID VICT #1, Glass could only provide a possible first name of "Courtney". Glass said "Courtney" was the rear right seat passenger in the vehicle. After confirming Glass` injury was non-life threatening, ER staff provided me with the FL DL of VICT #1 who I identified as Corey T. Smith b/m 11/18/78. I called CCC and provided them with updated information about the status of both victims. I accompanied Smith to CATSCAN where I learned Smith still had the bullet lodged inside of his head. Smith appeared to have been shot in the lower right rear portion of his head. I accompanied Smith to SICU Room #2543 upon his transfer there from the ER at 0315 hours. I was relieved by Ofc. Kerkau at approximately 0445 hours.

On 09-30-07, while on uniform patrol, I responded to 1250 West University Ave. to the report of a person shot. Upon arrival I was informed that the victims were at the hospital and that the suspect fled on foot North Bound through the "dill deli" parking lot. The description of the suspect being broadcasted on my police radio was a larger black male wearing a green shirt. I grabbed my issued shotgun from my trunk and with Ofc. D. Reveille #562 proceeded North to the "dill deli" parking lot. In the parking lot of the deli we observed a large, black male with a lime green shirt. With our weapons in the low ready position we gave verbal commands to the individual to lay on the ground. I announced on the radio we had a subject matching the description on the ground. Ofc. N. Byrd #550 responded and detained the individual in handcuffs. It was later determined the individual was not involved in the incident. I then made contact with a white female who stated she saw a black male with "corn rows" in his hair run "like he was scared" North through the parking lot just prior to our arrival. I then assisted Ofc. J. Hope #429 and his K-9 conduct a search of the area were the suspect was last seen running. We were unable to locate the suspect. I informed Ofc. Green #685 of the witness who made contact with her to get her information. After the scene was secure I was sent in an unmarked car to the "springs complex" on UF campus were UF Football players live. I was to look for a black Chevy Tahoe with FL tag GTP3R. I remained on campus until approx. 0600hours when the suspect vehicle was located in Stoneridge apartments, 3800 SW 34th St. I had no further involvement in this case.

On 09/30/07 at approximately 0225 hours while on uniform patrol in a marked vehicle, I was dispatched to the 1300 block of W University Ave in reference to a shooting. As I was responding to the scene I was flagged down by a white male, Alan Davies, at the 100 block of SW 12th St and he told me he had just witnessed the shooting. Davies said he was standing on the sidewalk on the south side of University Ave, just east of 13th St., when he saw a black male walk out of the bushes just north of the sidewalk on the north side of the road, directly across from him. The black male appeared to already have a black semi-auto small caliber handgun in his right hand and approached a white Ford Crown Victoria that was stopped in traffic at a red light. The black male then fired 4-5 shots right at the right front passenger. After firing the shots the suspect turned around and swiftly walked back through the bushes he had just come out of, and then proceeded to sprint north through the Gainesville Downtown Inn parking lot towards McDonalds, 201 NW 13th St. Seconds later Davies said the right side backseat passenger exited the vehicle and began yelling at the suspect saying, "You killed my friend". The driver of the Crown Victoria then began to exit the vehicle as well. Davies then fled the area and called 911. Davies described the suspect as approximately 5`10", 150-160 pounds and said he was wearing a green polo style shirt. No other description could be provided at the time. Davies remembered seeing a black SUV stopped in traffic in front of the Crown Victoria when the incident occurred but was unable to provide a description of any of the occupants. The Crown Victoria was also approximately four car lengths back from the traffic light while it was stopped at the red light. I then responded to the Gainesville Downtown Inn with Davies to possibly identify a suspect that had been detained by other officers in the parking lot. Davies said the man detained, who was wearing a similar green shirt, was not the shooter. I was later approached by Daniel Perkins who said he was standing on the NW corner of the intersection of 13th St and W University Ave when the shooting occurred. Perkins said he didn`t actually see the shooting but remembered hearing the shots. Perkins said as he was crossing the street towards the Gainesville Downtown Inn he saw a black male in dark colored clothing sprinting north through the parking lot towards McDonalds. No other description could be provided due to Perkins` distance from the suspect. It wasn`t until law enforcement was on scene that Perkins realized a shooting had occurred, so he decided to provide his information then. Perkins also remembered seeing a black SUV turn north onto NW 13th St seconds after he heard the shots and saw the black male running away. A large roll of firecrackers was also thrown out of the window of an unknown vehicle shortly after the shooting, landing on the sidewalk at the corner of 13th St and University Ave. My patrol car was used on the eastern end of the crime scene to help secure it and I remained on scene until it was released by Forensics Investigator Woodmansee (ID 8) at approximately 0540 hours.

On 09/30/07 at approximately 0200 hours I was on uniform patrol in a marked patrol vehicle when I responded to 1300 W University Ave in reference to a shooting. As I was enroute, I received information via the radio that the victim`s may already be on their way to Shands. I responded to Shands, where upon my arrival, found several B/M individuals standing in the ER ambulance entrance of the hospital. All of the individuals were visibly upset. I contacted a B/M, identified as Maurice Terry, wearing a black and red shorts ensemble, who stated that he was in a car near where the incident took place. Terry stated that he saw a B/M, approximately 5`11 wearing all black walk over to the victim`s car and fire 5 shots into the passenger side of the vehicle. Terry stated that the suspect then fled through the Holiday Inn parking lot. Terry stated that he did not know the suspect. I then made contact with Robert Adams, wearing a purple Polo shirt and jean shorts outfit and his hair was coiffed in medium twists, who stated that he was also in a vehicle near the location of incident. Adams stated that he saw an unknown B/M, wearing all black, walk up to the passenger side of his friend`s car and fire 5 rounds into the car. Adams said that the suspect then fled eastbound through the Holiday Inn parking lot and then north through the Mc Donalds parking lot. After talking to the two witnesses, I began to photograph the victim`s vehicle and victim Glass. The flash card was placed in the locked drop box. I also made contact with the nursing staff and collected the victim`s clothing and bed linens, labeled them with the corresponding victim`s personal information and secured them in the trunk of my patrol car. I also collected a spent round of ammunition that was found just outside the passenger side door of the victim`s vehicle while parked in the ER ambulance parking lanes. I then secured it in the trunk of my patrol car. I also contacted Teletype and requested a flat bed contract tow to the location. When FCL Investigator Woodmansee arrived on scene I turned over all physical evidence that I had collected on scene. When Det Madsen and Lt. Hoffman arrived on scene I spoke with them and provided Det Madsen with the witness information that I had collected. This was the extent of my involvement in this case.

On 09/30/07 I responded, reference ALERT, to a call of shots fired at 1300 West University Ave. I parked my car on the West side of the Holiday Inn and proceeded to the entrance of the Dill Deli where Officer Reveille #562 reported he had a B/M matching the description of the shooter detained. When I arrived at the entrance I observed a B/M matching the shooters description sitting on the ground in handcuffs. I remained with Ofc Reveille until it was verified the B/M was not involved with the shooting. Shortly after I was involved in a search of the area for the weapon that was used in the shooting. Ofc Reveille, myself, and another officer searched from West University Ave north through the Holiday Inn parking lot, through the McDonald`s property ending at the car was on NW 3rd Ave. There was no evidence and no weapon found during the search.

At roughly 0235 hours, I responded to 1300 W. University Ave. from a traffic stop at 3300 W. University Ave. (07-20046). I had heard the dispatch of the shooting and subsequent direction of the victim vehicle (southbound on SW 13th ST) and determined that most likely the victims were headed to Shands/UF. I had officers respond to Shands, not only to secure a potential crime scene there, but also to make sure that if any suspects were following the victim vehicle, law enforcement would be able to interdict in any further life-threatening criminal activity. (I learned later that Officer Kennedy and Officer Bowman were at Shands/UF as the victim vehicle pulled up and witnessed a spent shell casing fall from victim Corey Tevon Smith as Smith was removed from the car.) I also made sure that CCC contacted the District 2 Command Staff to be aware of the event, as well as the on-call CID supervisor, and FCL. Upon my arrival on scene, I saw that Sgt. Giles and Officer Byrd had discovered the crime scene, which was the westbound curb lane of W. University Ave., roughly 50 feet east of W 13th ST. I noticed that there were shell casings on the ground (4), as well as what appeared to be faint blood droplets. The entire curb lane was sealed with crime scene tape, as was the north sidewalk and south part of the Holiday Inn parking lot. I was informed by patrons leaving Dill Deli (unknown involvement) that there was a black male in the parking lot that "wanted to talk to someone high-up." For the next 30 minutes I dealt with what was originally considered an excessive use of force by the officers arriving on scene, but that force was finally determined to be not only well within Department policy, but in complete contradiction to yells of resturant patrons. Lt. Wayne Ash was on scene and appeared to by trying to console two black males in their mid to late 20`s and a black female in her early 50`s. Clasitt Leonard McCray stated that he was seated in the rear of the Dill Deli when resturant patrons yelled that there was a black male who got "slammed and hit in the head with a rifle." McCray attempted to go out of the resturant and determine if his cousin Jeremy J. Whitehead was involved. As McCray came near the main entrance of the Dill Deli, he saw Officer Poirot standing at the entrance with a shotgun, not allowing anyone exit during the arrest of the possible shooting suspect. Whitehead was indeed the person detained by Officer Reveille at riflepoint, and was handcuffed by Officer Nick Byrd. I interviewed Whitehead (who had long-since been released from handcuffs after cleared of any involvement) to determine if excessive force was used during his detainment. Whitehead explained to me that the officers ordered him to the ground and put handcuffs on him. I specifically asked, "Did they force you to the ground? Did they hit you with the rifle? Did they `slam` you at any point?" Whitehead answered, "No." to all of the inquiries. Whitehead was wearing a lime green shirt, just as was dispatched and was simply too close to the crime scene not to be regarded as a possible suspect shooter. Whitehead was checked for any sign of injury and had none. Whitehead asked

at least four times whether or not he was in any trouble, and I explained to him he was only going to be listed as in the area and wearing clothing "like" that of the shooter. (I later learned that Whitehead is on Florida Inmate Release status for sale/delivery of cocaine and most likely wanted to be assured of no violations in this regard.) I also explained this situation to Whitehead`s mother, who showed up on scene after receiving a call that Whitehead had been "slammed" by police. I took no original testimony on scene besides that of Whitehead and McCray. I left this crime scene and went to Shands/UF to assist with any needed opportunites there. Upon my arrival, I learned that the driver of the victim vehicle, Justin Glass, had not had the bullet removed from his upper arm, and the front seat passenger, Corey Smith was in critical guarded condition. The victim vehicle was not on scene, it was brought to secured storage by University Towing. I left Shands and reported to GPD headquarters. En route, I was told by Sgt. W. Stout that PIO Lt. Kameg had already been advised of the incident. At GPD, I was asked by Sgt. Baker to have Victim Advocates dispatched to Shands/UF, room 2543 in the trauma wing "J.U.I.C.E." unit. Besides assisting detectives with the gathering of information for possible suspect shooter identification, I had no further involvement with this incident.

After the surveiling was concluded; I responded to the vehicle and looked into the vehicle for any obvious plain view evidence. On 09/30/07 at approximately 0220 hrs while working uniformed party patrol, I responded to 1255 W Univ Ave in reference to shots fired. Upon arrival I immediately deployed my rifle (ALERT) and made contact with Sgt Nabet who was already on scene. Sgt. Nabet informed me that we were looking for a B/M wearing a lime green shirt as the possible shooter. The suspect was last seen fleeing northbound from 1255 W Univ Ave through the Holiday Inn parking lot. Along with Officer Poirot, we began searching the immediate area where the suspect was last seen. After conducting a search of the parking lot at 1250 W Univ Ave, we approached the Dill Deli (same address) to determine whether or not the suspect had entered the business. Just a few feet from the front door Officer Poirot alerted me to a B/M subject matching the suspects description and wearing a lime green shirt approaching me from behind. I immediately turned toward the B/M subject, pointed my rifle at him ( officer safety reasons/armed subject), and gave loud verbal commands for him to lay face down on the ground. The B/M subject only complied after several loud verbal commands had been given. Officer Byrd who was now on scene, rear handcuffed the B/M subject (double locked/checked for proper fit) and assisted him into a sitting position. The subject was released unharmed after a show up provided negative results.

He had no idea why anyone would shoot at him or any passenger in his vehicle. At approximately 2330 he and Corey Smith were joined at the Venue by Randall Cason. The three left in Glass` vehicle and were enroute to Smith`s cousin Brittany`s apartment in Huntington Lakes. Glass was driving with Smith in the front passenger seat and Cason was in the back seat. Traffic was heavy on West University Ave. and they were stopped at he light at 1300 WUA. Glass` attention was drawn to a carload of females directly to his left when he suddenly heard gunshots over his right shoulder. He turned and said he saw a person in a white T-shirt standing outside the passenger side of his car. Later in the interview he thought perhaps he saw a white flash of some type. It is not clear what Glass saw. He looked to his right to see Smith bleeding profusely and apparently unconcious. Cason was in the backseat yelling, "Oh my God". Glass attempted to eixt the car but felt great pain in his right arm. He shifted the vehicle to "PARK" and then exited the vehicle. Females in the vehicle directly to his rear were screaming. He re-entered the vehicle and drove to Shands at UF. Based upon information already developed in the investigation I pressed him about his, Cason`s and Smith`s behavior in the Venue earlier in the evening. He maintained that there were no disputes in the club with anyone and the three were together the entire time. He claimed no knowledge of any necklace incident and stated that he was unaware of any UF football players in the bar. He did tell me that Reggie Nelson was in the club somewhere but he had no contact with him. Eva Graham Arbor Cove #8104 352-505-6823 Graham is Glass` mother and was at the hospital. She believed that the shooting had something to do with a gold necklace but knew nothing more specific. I explained to her that I believed that Justin was being untruthful and asked that she encourage his cooperation in this investigation. I was assigned to collect any area surveillance videos. Several requests have yet to yield a response so I requested a subpoena from the SAO. All businesses in the area were contacted. There are no surveillance systems that cover the vicinity of the shooting. A video from the Gate station at 500 NW 13 St. was obtained but the direction of the investigation has shifted. Salley stated that she and her boyfriend were waiting in traffic in the right-hand lane two cars behind the victim`s. She stated that she first observed the suspect emerge from the bushes on the south side of the Hoilday Inn, walk directly to the victim`s vehicle producing a handgun from the rear waistband of this pants. The suspect stood directly beside the victim`s vehicle at a distance which Salley described as being about six inches from the interior and fired five times into the vehicle. Salley described this as clearly intentional. The suspect then turned and ran through the bushes northbound through the Holiday Inn parking lot. Salley stated that about ten seconds after the shooting, the driver of the victim`s vehicle emerged and began yelling and beating on his car. Salley said that the vehicles in the area of the shooting scattered, including her. 2007-20053 Supplement date: 10-04-07 On Sunday, 09-30-07, at 0340hrs, I was called out from my house and asked to respond to assist with an attempted homicide investigation. Det Patty Nixon was assigned as lead investigator. I arrived at the GPD at about 0420hrs. At 0600hrs, Det Madsen and I responded to Stoneridge Apts, where patrol officers had located Reggie Nelson`s, black GMC Denali (GTP3R). Nelson had originally been implicated in the shooting by witness, Randall Cason. We watched the vehicle for a short time, while waiting for Nelson to return. At 0735hrs, Ofc Jamie Hope took over watching the vehicle. 0800hrs Shera Jenkins, B/F, 02-11-89 818 SW 63rd Ter (c) 352-328-6962 Det Madsen and I spoke with Jenkins at Gardenia Gardens, Apt #C1. From CAD, I located a potential witness, Ashley Gainey. Ashley Gainey was not at the apartment, but her cousin, Shera Jenkins was there. Jenkins reported that Ashley Gainey, Ameria Isaac, Antoinette Gainey and she were at the same nightclub, Venue, as the victims. They were also eyewitnesses to the shooting later. Jenkins advised they were in a car about four cars behind the victim when the shooting took place. Jenkins was sitting behind the driver. Jenkins stated that she saw Ameria and Ashley speaking to the shooter as he walked down the sidewalk. She later heard the gunshots. Jenkins described the lone shooter as a B/M, about 25yoa, 5-11/ medium build, brown skin, collar length braids and wearing a green shirt. She believed she saw the suspect earlier at the Venue. Jenkins did not recognize the suspect as someone she knew. At 1000hrs, I was notified that Reggie Nelson had returned to his vehicle at Stoneridge Apts. At 1020hrs, I arrived at Stoneridge and spoke with Nelson. I asked for consent to search his truck, which he granted. He signed a consent to search form. I then asked him to return to GPD with me to speak about what occurred last night. Nelson reported the following: He arrived at the Venue last night about midnight. He was there with Demetrious Webb and Richard Lakes (cousin). Once there, they met up with Rodney Peterson. They saw the Pouncey twins (James and Lashawn) a little later. He cannot distinguish them apart. They were with , who Nelson identified by photo. told Nelson of an incident where one of the twins had his necklace snatched by Randall Cason. Later, after the club closed, one of the twins related the same story and pointed to Cason. Nelson went over to speak with Cason. They discussed the stolen necklace and Cason told him the chain had already been given away. Nelson advised they didn`t want any trouble and he left on good terms. Nelson was familiar with Cason and identified him from a photo. Nelson was parked in the 238 WUA parking lot. Webb, Lakes, Peterson and he left. They drove west down NW 3rd Ave toward NW 13th St. Nelson advised they were not on WUA when the shooting took place. They ended up at Markie Anderson`s room on the UF campus. Nelson gave me Rodney Peterson`s phone number to corroborate his story. At 1125hrs, Det Patty Nixon joined me. I read Nelson miranda from a pre-written card. He acknowledged each right and agreed to speak. At the time, we believed Nelson may have been covering up some aspect of the shooting. Nelson continued to deny any direct knowledge of the actual shooting. At about 1200hrs, Det Douglas drove Nelson back to Stoneridge and his vehicle was released to him. 1205hrs Rodney Peterson, B/M, 03-31-83 13624 NW 141 Place, Alachua, FL (c) 352-494-8181 I spoke with Peterson by phone. He reported the following: Last night, he met Nelson and Richard Lakes at the Venue. He did not see any conflicts inside the club. Once the club closed, he drove with Nelson and the others in Nelson`s vehicle. Peterson described approximately the same route to NW 13th St that Nelson described. He firmly stated that he never lost sight of Reggie Nelson after they left the club. He also said they did not witness the shooting. 1230hrs

I spoke with Gainey by phone also. She reported the following: She was in the car with her sister Antoinette Gainey (driver), her cousin Ameria Isaac (front passenger), and Shera Jenkins (rear left passenger). They were on WUA waiting for the light at NW 13th St in the curb lane. The victim`s car was two in front in the same lane. The suspect was walking west on the sidewalk passed their vehicle. Ameria began to talk to him and asked him if he needed a ride. The suspect turned his face away and kept walking. He passed their car and began a slow trot to the victim`s car, where he stopped at the passenger window. The suspect fired numerous shots into the car and then fled north through the Holiday Inn parking lot. She described the suspect as a B/M, about 6-1, slim, corn rows to collar, brown skin, wearing a green polo and blue jean shorts. She thought she`d be able to recognize him again.

I spoke with her by phone. She advised she was standing on the north side of the Kangaroo Gas Station which is at the corner of WUA and NW 13th St. She saw the suspect approach the car and shoot into the vehicle. He then fled north through the Holiday Inn parking lot. Mall described him as a B/M, collar dreds, dark skin, slim and wearing a green polo shirt. 1630hrs Antoinette Gainey 3101 NE 15th St, #E41 (h) 352-338-3509 Det Patty Nixon and I contacted Antoinette Gainey at her residence. She was driving the car that Ashley, Ameria, and Shera were in. She saw the suspect approach the victim`s car and then heard 3-5 gunshots. Gainey gave a similar description as the others, but did not get a good look at the suspect. 1720hrs Ameria C. Isaac, B/F, 02-16-87 1117 NE 24th St Det Nixon and I contacted Ameria Isaac at 405 SE 13th Ter, her grandmother`s residence. Isaac advised she did briefly dance with the suspect at the Venue earlier in the night, but that she did not know him. She similarly described the suspect, but added he had some chin hair. Isaac stated just before the shooting, the suspect got out of a dark colored car a couple car lengths in front of them and began to walk westbound. The car then turned north down an alley just east of the Holiday Inn. Isaac`s car passed the walking suspect and then came to a stop. The suspect then passed their car again and she began to speak with him, but he ignored her. The suspect continued and walked up to the victim`s car and began to shoot into the passenger window. 1800hrs Randall Cason I assisted Det Nixon with her re-interview of Randall Cason. Forsberg #078 I responded to the Holiday Inn at 1250 W. University Ave. to canvass the area in reference to the shooting. I contacted the front desk employee "Nikki" who advised me she was not working this past Saturday night (9/27) but could look at the roster and see who was. I was advised that night the front desk was staffed by "Brian" and security guards "David" and "Nate" would have also been on duty. I was told "David" would be in to work at midnight. I asked if the employee`s last names were available but was told everyone is primarily on a first name basis. I inquired about video surveillance for the hotel. "Nikki" stated the hotel currently has no surveillance system anywhere in or around the building. 2325 hours Wednesday, October 3rd, 2007 Demetrice Moorehead B/F 3/25/77 709 SW 3rd St. I went to the Dill Deli restaurant which is attached to the Holiday Inn. I made contact with Demetrice Moorehead who was the only employee currently working who was also present on the night of the shooting. Moorehead said that when the shooting occurred she did not hear anything at all due to the ambient noise in the restaurant. Moorehead said they were unaware anything occurred until someone told her that her boyfriend Jeremy Whitehead was being swarmed by police and made a statement about a shooting. Apparently Whitehead had been wearing a green shirt and was detained as possibly being involved. Moorehead said at that time they went outside and became aware of the incident. Moorehead said she and the other employees had talked about the shooting and no one stated they had been aware of anything until after the fact. Moorehead was asked about suspicious persons matching the suspect description. She advised that there were very few black males in the restaurant prior to the shooting. Moorehead did not recall anyone wearing a green shirt, other than her boyfriend. Moorehead said the restaurant does have video surveillance, however all the cameras point inward to the restaurant itself. 2345 hours Wednesday, October 3rd, 2007 McDonalds 201 NW 13th St. Angela Pittman W/F 4/5/83 916 NW 6th Ave C 561-762-0809 I spoke to Pittman who is the night crew manager at McDonalds. Pittman said she was working on 9/27 when the shooting occurred. Pittman stated McDonalds locks its doors at 2300 hours and doesn`t allow anyone in, serving drive thru traffic only. Pittman said it was extremely busy that night so all of her staff was occupied with cooking and serving. Pittman said to her knowledge no one was aware the shooting had occurred until they saw police swarming the area and asked them what was going on. Pittman had no other information to provide. There were no other employee`s working that were present on 9/27. 2355 hours Wednesday, October 3rd, 2007 David Lavender W/M 6/4/76 10845 NW 61st Ter Alachua I made contact with Lavender who is the night security guard at Holiday Inn. Lavender said he was working on the night of the incident and had just relieved the other security guard whom he knows as Nate Hope B/M. Lavender said Hope`s ride was parked in the east vehicle breezeway of Holiday Inn picking Hope up, and he had stopped to talk with them. Lavender stated Hope`s ride had just pulled off when Lavender heard the gunshots. Lavender stated he made his way back to the front of the hotel but by the time he arrived he saw nothing. Lavender stated he did not see anyone come past him nor was he aware of hearing any vehicle speed from the area. 0010 hours Thursday, October 4, 2007 Krispy Kreme 310 NW 13th St. Jimmy Sutton B/M 5/9/64 1105 NW 3rd Ave I went to Krispy Kreme and made contact with Sutton who is an employee there. Sutton said he was working the night of 9/27 and was staffing the front counter with manager Alex Lewis. Sutton said the store was extremely busy that time of night and he could not tell if anyone matching the suspect description might have come in or not. Sutton said he was completely unaware of the shooting until well after it occurred, and did not see or hear anything suspicious in relation to it. Sutton said the store does have video surveillance but he was not sure if it was recorded or not. Sutton stated he was aware the owner could view the video real time from his home if they chose. Alex Lewis was not available to speak to.

On September 30, 2007, I was requested to assist with the investigation of an Attempted Murder involving a shooting which occurred at approximately 0200 hrs at 1200 West University Avenue. Investigator Woodmansee is the original Crime Scene Investigator and responded to the scene at the time of the incident. At 1045 hrs, I was requested to respond to Shands @ UF to retrieve a bullet that had been removed from victim Corey Smith. Upon arrival, I made contact with Shands security who escorted me up to the Operating Room in which the victim was being treated. Outside the operating room I made contact with Noelia Williams RN. Williams turned over to me a plastic container with the fired bullet inside at 1100 hrs. The Dr. treating the victim was identified as Dr. Steve Lewis. After clearing the hospital, I responded to 3800 Southwest Archer Road, Stoneridge apartments, to examine a vehicle believed to have been involved in the incident. Upon arrival, contact was made with Cpl. Clinton. The vehicle in question is a 2007 black Tahoe, 4 door, Florida tag GTP3R. The vehicle is registered to a Reggie Nelson. I examined the exterior and interior of the vehicle for latent prints and by consent searched the interior of the vehicle for any evidence related to this case. No items of Physical Evidence were collected. Case Number: 07-20053 / Attempted Murder VEHICLE INFORMATION: 1997 White Ford 4 door Crown Victoria, Fl Tag #E99 5VE VIN: 2FALP71W9VX205139 CRIME SCENE INVESTIGATION: On 9-30-07 at 0240 hours I responded to 1200 West University Ave in reference to processing the scene of a shooting and attempted murder. Upon arrival I contacted Ofc. N. Byrd, who had the roadway blocked with patrol cars, and the area directly east of the intersection of NW 13 Street and West University Ave barricaded with yellow crime scene tape. Ofc. Byrd advised that the victim vehicle had been stopped in traffic in the curb lane back from the intersection of 13 Street and Univ. Ave, several cars back from the intersection, when a subject approached the victim vehicle and fired several shots into the victim`s vehicle. Ofc. Byrd directed me to several casings located in the street along W. University Ave, which had been marked with orange markers. Ofc. Byrd also marked several drips of red fluid which appeared to be blood. I photographed these items using the markers already placed next to them by Ofc. Byrd. I then received a request to respond to Shands Hospital at the University of Florida to process the victim vehicle there. I left the scene secured with Ofc. Byrd and responded to Shands at 0340 hours, where I contacted Ofc. N. Hallett. Ofc. Hallett was standing by with the above listed vehicle, which was parked in the Emergency Room pull through. Ofc. Hallett advised that she had previously photographed the vehicle, and located items of evidence which had apparently fallen from the vehicle. These items include a hat, pair of sunglasses, and a .380 auto casing, that were located next to the vehicle on the pavement. I collected these items, and then received victim clothing items from Ofc. Hallett at 0354 hours. The clothing items are detailed in the evidence section of this report. Ofc. Hallett advised that she had received these items from Emergency Room staff prior to my arrival. I sealed the doors of the vehicle with evidence tape, and then requested that Ofc. Hallett have the vehicle towed to secure storage for additional processing. Refer to Ofc. Hallett`s report for details. At 0430 hours I returned to the initial scene at 1200 West University Ave. to complete processing the scene. Ofc. Byrd had maintained scene integrity, and advised that no one was allowed into the scene while I was assisting Ofc. Hallett. I measured the locations of items within the scene, which included four 380 auto casings, a large roll of Black Cat firecrackers, a Coors Light Beer bottle, and the apparent blood drops left on the concrete and a red toothpick. Ofc. Byrd assisted me in taking measurements of items located within the scene, and I then collected the casings, fire crackers and beer bottle, and collected swabs of the apparent blood. I concluded scene investigations at 0510 hours and returned to GPD where I secured the items of physical evidence, and hung the bloody clothing items received from Ofc. Hallett in a secure drying locker. At 1630 hours I returned to duty and contacted Inv. B. Starr at GPD. Inv. Starr and I responded to University Towing and Recovery to process the victim`s vehicle (listed above). I photographed the interior and exterior of the vehicle, including its contents. Inv. .40 cal mod. 410 pistol was on the right rear floor, partially concealed under the right front seat. The serial number had been obliterated from this pistol by drilling and grinding. A second pistol was found on the left front (drivers) floor, concealed under a black XXL T-shirt with "Skoolin" logo (008-50). This pistol was a Taurus Mod. P 111 Serial # TUK 15705. An NCIC check on this pistol confirmed that it was reported stolen from the Jacksonville Sheriff`s Office (case #04-133618). JSO was notified by phone, and by teletype of the weapon`s recovery. I also conducted ATF traces on both firearms. Both weapons had ammunition in the magazines, but had empty chambers at the time of their recovery. Inv. Starr and I also conducted shooting scene reconstructions and projectile recovery. We were able to recover a fired bullet from the right front top door frame, and bullet fragments from the left front seat head rest and seat. Refer to the evidence section of this report for details of the items recovered from the vehicle. PARTICULARS OF CRIME SCENE: The scene consists of the roadway and sidewalk located at 1200 West University Ave. The roadway is five lanes, and the crime scene consists of the sidewalk and north side curb lane of West University Ave, directly east of the intersection with NW 13 St. There are four 380 auto casings in the roadway, a Coors Light beer bottle, and several areas of apparent blood drops. On 09/30/07, I responded in uniform to the 1200 block of WUA in reference to a shooting. The suspects and victims had already fled the scene. I met with several officers and attempted to determine the actual crime scene. I met with Ofc. Revielle, who smelled gunpowder on the east sidewalk in the unit block of NW 13 ST - west of the west parking lot of the Dill Deli. We searched the area of the sidewalk and the roadway without finding any signs of evidence. Ofc. Holt was with witness Alan Davies, who showed me where the shooting actually occurred. Davies walked me from the south parking lot of the Dill Deli / Holiday Inn to the north sidewalk of WUA. He said that the shooter walked south from the parking lot through the parking lot`s bordering landscaping onto the north side walk of WUA approximately 5-7 car lengths east of the NW 13 ST intersection. The shooter approached a car stopped in traffic facing westbound in the curb lane. From the sidewalk, the shooter shot into the car. He then ran back north into the Dill Deli`s south parking lot and then north through the west parking lot, towards McDonald`s. Sgt. Giles and I stopped westbound traffic at that location. I cordoned off the scene with yellow crime scene tape. The scene extended approximately 2 cars lengths east of where the shooting was described, ended just short of the NW 13 ST intersection and included the curb lane, the north sidewalk and the south landscaping border of the parking lot (see FLC processing/photographs for exact specifics.) As I was doing this, Sgt. Giles told me he saw small caliber bullet casings in the roadway. Ofc. N. Bryd started a crime scene log. He saw more bullet casings in the road and north gutter. Ofc. Bertzyk assisted in marking the casings, a beer bottle and blood splatter within the crime scene. Ofc. Woodmansee eventually processed the crime scene. I only saw the beer bottle in the roadway. I saw a roll of firecrackers bound further west on the sidewalk. It was unknown if the firecrackers were involved. I do not know if they were collected as evidence. Daniel Perkins approached me in the south Dill Deli parking lot. He told me that he did not see the shooting but heard the multiple gun shots. He was standing from the west. He saw a black male running north through the west Dill Deli parking lot. The black male was yelling something about a shooting and something about a Tahoe (vehicle.) I turned Perkins over to Ofc. Holt for identification and interviewing. I did not interview any else besides what is documented. I did not collect any evidence. I did not photograph anything.

Nixon requested that this case be compared to a firearm recovered by the Live Oak Highway Patrol and submitted to the Tallahassee FDLE Lab by FDLE Agent Tfiel. Case Number: 07-020053 / Attempted Murder On 2-26-08 I received evidence under case number 08-003824 from Ofc. Delucca #694 for latent print processing. Evidence received was listed as follows: 694-1 Semi-automatic Lorcin Pistol SN 095803 694-2 Magazine for 694-1 694-3 7 rounds of ammunition from 694-2 This evidence was examined for latent prints using dusting powders and lifting tape. No latent prints were developed. I then swabbed the grips of the pistol for potential DNA evidence. 07-020053.097 ATTEMPTED HOMICDE: On 06/15/08, I was contacted by Detective Patty Nixon and was asked if I could assist the victim in this case Corey Smith B/M, 11/18/78, in the creation a composite of the unknown suspect who shot him in the head. The composite was scheduled for Sunday 6/22/08 at approximately 1700 hrs. On 6/22/08 at 1745 hrs Det. Nixon brought Smith to the Forensic Crime Unit where the suspect composite was created using the E-Fit composite program on a personal computer. The completed composite was printed on a laser printer and signed by Smith and me at 2035 hrs. The following item of physical evidence was collected and placed into the Property and Evidence section: 097-52: Suspect composite.

07-020053.097 ATTEMPTED HOMICDE: On 07/18/08 at 2300 hrs I was contacted by Detective Patty Nixon in the Forensic Crime Unit at GPD. Det Nixon made arrangements for a witness in this case to create a composite of the subject she saw prior to the shooting incident. On 07/19/08 at 1735 hrs, Detective Nixon escorted witness Sheena Cooper B/F, 04/02/85 to the Forensic Crime Unit where I assisted Cooper in creating a composite of the subject she saw. The composite was created using the E-Fit composite program on a laptop computer. The completed composite was printed on a laser printer and signed by Cooper and me.
