CRIME
Treason (extraterritoriality)

PENALTY
Reclusion perpetua to death and shall pay a fine not to exceed 100K

DEFINITION
Is a breach of allegiance to a government committed by a person who owes allegiance to it Treason in general sense, is the violation of a subject of his allegiance to his sovereign or to the supreme authority of the state TWO ways of proving treason 1. Testimony of at least 2 witnesses to the same overt act; or 2. Confession of the accused in open court

ELEMENTS
3. That the offender is a Filipino citizen or an alien residing in the Philippines 4. That is a war in which the Philippines is involved 5. That the offender either: (a) levies war against the government (b) adheres to the enemies giving them aid and comfort TWO ways or modes of committing treason: 1. By levying war against the Government 2. By adhering to the enemies of the Phils. giving them aid or comfort.

Conspiracy and Proposal to Commit Treason

Shall be punished respectively by prision mayor and fine not exceeding 10K and by prision correcional and a fine not exceeding 5K Shall be punished as an accessory to the crime of treason

Conspiracy to commit treason is committed when in time of war two or more persons come to an agreement to levy war against the government or to adheres to the enemies and to give them aid or comfort and decide to commit it The offended must be owing allegiance to the government without being a foreigner

Proposal to commit treason is committed when in time of war, a person who has decided to levy war against the government or to adhere to the enemies and to give them aid or comfort, proposes its execution to some other person or persons

A nation or power which takes no part in a contest or arms going on between others is referred to as neutral. There must be regulation issued by competent authority for the enforcement of neutrality. It is the violation of such regulation which constitutes the crime.
