COMPLAINT
The Complainant, being duly sworn, makes complaint to the above-named Court and states that there is probable cause to believe that the Defendant committed the following offense(s). The complainant states that the following facts establish PROBABLE CAUSE:

___________________________________________________________________________________________ Complainant, Mark Elliott, of the Bloomington Police Department, has investigated the facts and circumstances of this offense and believes the following establishes probable cause: On or about January 11, 2013, Bloomington police received a call from the hotel manager at the Quality Inn & Suites on American Boulevard in Bloomington, Hennepin County, Minnesota. The manager complained that a gang bang was taking place in one of the rooms, and he wanted the individuals evicted. Upon arrival, police met with the manager, who handed them a business card he had obtained in the motel parking lot. The card was labeled Scott GB Parties, and identified Scott as a Gang Bang Organizer. The manager also told police that he had gone to a group e-mail website he obtained from the card, and it listed a girl named Wendy as the woman who would be part of the gang bang. In the message there was a suggested donation of $20.00 for the gang bang, and it listed the address of the motel and also the room number. At approximately 3:45 a.m., undercover police knocked on the door to the room. They were let in by a male, later identified as SCOTT EUGENE POLLOCK, DOB 1/1/1966 (Defendant). The police told the Defendant they were present for the gang bang, and the Defendant responded that there is a $20.00 donation, and held his hand out. While the Defendant was the only person in the front room of the suite, police could see a number of individuals in the back room. The two officers asked the Defendant if they could tag team her and do her at the same time, and the Defendant responded that they could do whatever they wanted as long as the girl was ok with it, and added, her sucker is a little tired.

Upon proceeding to the back room of the suite, the officers observed two men and two women sitting on chairs. On the bed, a woman was laying on her back. One male was having intercourse with her, while another male was kneeling next to her head as she was fondling his penis. Next to the woman on the bed was an ice bucket, about half full of condoms. There was also a garbage can next to that, filled with a number of used condoms. After about one minute of observation, the police informed the Defendant he was under arrest, and the other parties in the room were detained and identified. The Defendant had $470.00 in cash on his person. There was also a hand counter on a table displaying the number 31. The Defendant indicated that it was to count how many men the woman had sex with as she wanted to have sex with 45 guys. In a subsequent recorded interview, the Defendant waived his Miranda warnings and told police that he has been hosting gang bang parties for years, and collects donations at the door to cover his expenses. He admitted taking money from the two officers.

NOTICE: You must appear for every court hearing on this charge. A failure to appear for court on this charge is a criminal offense and may be punished as provided in Minn. Stat. 609.49. THEREFORE, Complainant requests that said Defendant, subject to bail or conditions of release be: (1) arrested or that other lawful steps be taken to obtain defendants appearance in court; or (2) detained, if already in custody, pending further proceedings; and that said Defendant otherwise be dealt with according to law.
