The contract values listed above are the maximum foreseeable cumulative for the whole of the contract term, this being a full fixed term contract of three years where all contracts expire at the end of October 2013. These figures do not represent amounts paid against this contract value. In terms of procurement, the independent contractors have been chosen for their personal expertise within a specific area at fair market rates which were negotiated with them at point of engagement. Appointment of these contractors (as for all employees) was undertaken in consultation with the Auckland Council Chief Executive as specified within the provisions of the Local Government (Auckland Council) Act 2009. The Act sets out the role of the Mayor of Auckland, whereby the mayor has the power to establish and maintain an appropriately staffed office of the mayor (9.3.e), which must be exercised: in consultation with, and acting through, the Council's chief executive (9.4.a); and within the budget in the annual plan adopted for that particular expenditure being an amount not less than 0.2% of the Council's total budgeted operating expenditure for that year (9.4.b).

The obligation of the mayoral office is to prudently manage costs within the budget provision provided for in the legislation and this has happened consistently since 1 November 2010. All contractor costs are within agreed budget and the mayoral office has consistently spent under its set budget for every financial year to date, being 2011/12 (10 per cent under budget), 2012/13 (7 percent under budget). I also wish to apologise for the delay in getting this response to you and draw your attention to your right of complaint to the Office of the Ombudsmen regarding this delay.
