309 of the Constitution of India and in supersession of all the existing rules, orders or instruments made in this behalf, excepting the Government Resolutions (1) Higher and Technical Education and Employment Department No. PTI. 2089/(1516)/TE-2, dated 24th December 1992 and Government Resolution, Higher and Technical Education Department No. Misci.2801/(245/05)/TE-2, dated 2nd June 2008 the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts of (1) Principal, Government Polytechnic, (2) Principal, Hotel Management and Catering Technology Institutes, (3) Head of Department in Engineering Disciplines or Workshop Superintendent (Head of Department level) in Government Polytechnic, (4) Head of Department in Non-Engineering Disciplines, (5) Head of Department in Hotel Management and Catering Technology Institutes, (6) Lecturer in Various Engineering Disciplines or System Analysts or Workshop Superintendent (lecturer level) or Controller of Examination in Government Polytechnic or Maharashtra State Board of Technical Education, (7) Lecturer in Various Non-engineering Disciplines and (8) Lecturer in Hotel Management and Catering Technology in the Maharashtra Polytechnic Teachers Services in Group "A" under the Directorate of Technical Education in the Higher and Technical Education Department of the Government, namely: These rules may be called the Principal, Government Polytechnic, Principal, Hotel Management and Catering Technology, Head of Department in Engineering Disciplines or Workshop Superintendent (Head of Department Level) in Government Polytechnic, Head of Department in Non-Engineering Disciplines, Head of Department in Hotel Management and Catering Technology, Lecturer in Various Engineering Disciplines or System Analysts or Workshop Superintendent (lecturer level) or Controller of Examinations in Government Polytechnic or Maharashtra State Board of Technical Education, Lecturer in Various Non-engineering Disciplines, Lecturer in Hotel Management and Catering Technology in the Maharashtra Polytechnic Services in Group "A" under the Directorate of Technical Education in the Higher and Technical Education Department (Recruitment) Rules, 2008. 2. In these rules, unless the context requires otherwise, (a) Board " means the Maharashtra State Board of Technical Education incorporated under the Maharashtra State Board of Technical Education Act, 1997; (b) "Commission" means the Maharashtra Public Service Commission; (c) "Degree" means a degree of a statutory university; (d) "Department" means the Higher and Technical Education Department; (e) Discipline" means the discipline shown in the schedules appended to these rules;

(f) Director" means the Director of Technical Education under Higher and Technical Education Department of the Government; (g) "Directorate" means the Directorate of Technical Education, M.S., Mumbai working under Higher and Technical Education Department of the Government; (h) Government" means the Government of Maharashtra; (i) "Government Polytechnic" means the Polytechnic established and run by the Government and it includes the Maharashtra State Institute of Hotel Management and Catering Technology, Pune; (j) "Recognised Institution" means an institution recognised by Government of Maharashtra; (k) "Schedule means the schedules appended to these rules; 3. Appointment to the post of Principal in Government Polytechnic under the Directorate shall be made either, (1) by promotion of a suitable person on the basis strict selection with due regard to seniority from amongst persons holding the post of Head of Department in Engineering Disciplines or Workshop Superintendent (Head of Department level) mentioned in Schedule D of these rules, in Government Polytechnic for at least 3 years and possessing qualifications and experience prescribed for appointment by nominaion in clause (2) (b) of these rule; or (2) by nomination from amongst candidates who, (a) are not more than forty-five years of age, and (b) possess the qualification mentioned in Schedule A, and (c) Have minimum 15 years of experience in teaching or administration in polytechnic or Engineering college, gained after acquiring the bachelor's degree in Engineering or Technology, or (d) have minimum 15 years of experience in teaching or industry or research gained in the capacity of Group "A" post in Government or equivalent post in other organisation, out of which at least 5 years experience should be as Head of Department in polytechnic, or Assistant Professor in Engineering college, gained after acquiring the bachlor's degree in. Engineering or Technology: Provided that, the Government may relax the maximum age limit up-to 5 years on the recommendation of the Commission in favour of candidates, having exceptional qualifications or experience, or both: Provided further that, preference may be given to the candidate possessing Ph.D. degree in Engineering, Technology or Technical Education.

4. Appointment to the post of Principal, Hotel Management and Catering Technology under the Directorate shall be made either, (1) by promotion of suitable person on the basis of strict selection with due regard to seniority from amongst persons holding the posts of Head of Department in Hotel Management and Catering Technology for at least 3 years and possessing qualifications and experience prescribed for appointment by nomination in clause (2) (b) of this rule ; or (2) by nomination from amongst the candiadates, who, (a) are not more than forty-five years of age, and (b) possess the qualification mentioned in Schedule B, and (c) have minimum 15 years of experience in teaching or administration in Hotel Management and Catering Technology Institutes gained after acquiring the prescribed qualification mentioned in Schedule B, or (d) have minimum 15 years of experience in Hotel industry or the research, gained in the capacity of Group "A" post in Government or equivalent post in other organisation, out of which at least 5 years, experience should be as Head of Department in Hotel Management and Catering Technology Institutes gained after acquiring the qualification mentioned in Schedule B: Provided that the Government may relax the maximum age limit upto 5 years on the recommendation of the Commission in favour of candiadates, having exceptional qualifications or experience, or both. 5. Appointment to the post of Head of Department or Workshop Superintendent (Head of Department level) in Government Polytechnic in any of the disciplines, as specified in Schedule-A shall be made either, (1) by promotion of a suitable person on the basis of seniority subject to fitness from amongst persons having minimum 3 years regular service in the post of Lecturer or system analyst or Workshop Superintendent (Lecturer level) or Controller of examination and must be working in selection grade scale, in Government Polytechnic or the Board and possessing qualification and experience prescribed for appointment by nomination mentioned in clause (b) of sub-rule 2 of this rule; or (2) by nomination from amongst the candidates who, (a) are not more than forty years of age, and (b) possess the qualification mentioned in Schedule-A, and (c) possess minimum 7 years, of experience in teaching or industry or research, gained or made in the capacity of Group "A" post in the Government or equivalent post in any other organisation, Out of which at least 3 years

experience should be as Lecturer in polytechnic or Engineering college, gained after acquiring the bachelor's degree in Engineering or Technololgy: Provided that, the Government may relax the maximum age limit up to 5 years on the recommendation of the Commission in favour of candidates, having exceptional qualifications or experience, or both: Provided further that, preference may be given to the candidate possessing Ph.D. degree in Engineering, Technology or Technical Education. 6. Appointment to the post of Head of Department in Hotel Management and Catering Technology in Hotel Management and Catering Technology Institute shall be made either ; (1) by promotion of a suitable person on the basis of seniority subject to fitness from amongst persons having minimum 3 years regular service in the post of Lecturer and must be working in selection grade in Hotel Management and Catering Technology Institute and possessing qualification and experience prescribed for appointment by nomination mentioned in clause (b) of sub-rule 2 of this rule, or (2) by nomination from amongst the candidates who, (a) are not more than forty years of age, and (b) possess the qualification mentioned in Schedule-B, and (c) possess minimum 7 years of experience in teaching or hotel industry or in the research, gained in the capacity of Group "A" post in Government or equivalent post in any other organisation, out of which at least 3 years experience should be as Lecturer in Hotel Management and Catering Technology gained after acquiring mentioned qualification in Schedule-B: Provided that, the Government may relax the maximum age limit up to 5 years on the recommendation of the Commission in favour of candidates, having exceptional qualifications or experience, or both. 7. Appointment to the post of Head of Department in non-engineering subjects as specified in Schedule-C, in Government Polytechnics shall be made either, (1) by promotion of a suitable person on the basis of seniority subject to fitness from amongst persons having minimum 3 years regular service on the post of lecturer and must be working in selection grade ir.. Government Polytechnic in the subject mentioned in Schedule-C and possessing qualification and experience prescribed for appointment by nomination mentioned in clause (b) of sub-rule 2 of this rule, or (2) by nomination, from amongst the candidates who, (a) are not more than; forty years of age, and (b) possess the qualification mentioned in Schedule-C, and

(c) possess minimum 7 years of experience in teaching or industry or in the research, gained in the capacity of Group "A" post in the Government or equivalent post in any other organisation, out of which at least 3 years experience should be as Lecturer in Polytechnic or Engineering college, gained after acquiring the bachelor's degree in engineering or technology: Provided that, the Government may relax the maximum age limit up to 5 years on the recommendation of the Commision in favour of candidates having exceptional qualifications or experience, or both: Provided further that, preference may be given to the candidate possessing Ph.D. degree in Engineering, Technology or Technical Education. 8. Appointment to the post of Lecturer or Workshop Superintendent (lecturer level) or system analyst in Government Polytechnics or Controller of examinations in Government Polytechnics or the Board in any of the disciplines as specified in Schedule-A, shall be made by nomination from the amongst the candidates who , (a) are not more than thirty five years of age, and (b) possess the qualification mentioned in Schedule-A: Provided that, the Government may relax the maximum age limit up to 5 years on the recommendation of the Commission in favour of candidates, having exceptional qualifications or experience, or both: Provided further that, preference may be given to the candidate possessing Ph.D. degree in Engineering, Technology or Technical Education: Provided further that, this rule shall be deemed to be in force from the 12th January 2000 for those lecturers recruited in the Government Service through advertisement no. 13, dated 12th January 2000 of Commission. The qualifications and other conditions prescribed in this advertisement are to be considered as valid conditions for the appointments of these lecturers. 9. Appointment to the post of Lecturer in Hotel Management and Catering Technology shall be made by nomination from the amongst the candidates who, (a) are not more than thirty five years of age and (6) possess the qualification mentioned in Schedule-B: Provided that, the Government may relax the maximum age limit up to 5 years on the recommendation of the Commission in favour of candidates having exceptional qualifications or experience, or both.; 10. Appointment to the post of Lecturer in non-engineering subjects as specified in Schedule-C shall be made by nomination from the amongst the candidates who, (a) are not more than thirty five years of age and (b) possess the qualification mentioned in Schedule-C:

Provided that, the Government may relax the maximum age limit up to 5 years on the recommendation of the Commission in favour of candidates having exceptional qualifications or experience, or both : Provided further that, preference may be given to the candidate possessing Ph.D. degree in Engineering, Technology or Technical Education: Provided also that, this rule shall be deemed to be in force from the 12th January 2000 for those lecturers recruited in the Government Service through advertisement no. 13, dated 12th January 2000 of the Commission. The qualifications and other conditions prescribed in this advertisement shall be considered as valid conditions for the appointments of those lecturers. 11. Appointment to the posts mentioned in rules No. 3, 4, 5, 6 and 7 shall be made by promotion and nomination in the ratio of 50:50. 12. A person appointed to any of the posts mentioned in rules 3 to 10 by nomination shall be on probation for a period of 2 years. Probation period may be extended maximum upto 1 year only. Person appointed shall be required to pass departmental examination and complete the probation successfully within the prescribed period. If he/she does not complete probation successfully or does not pass the departmental examination or not found suitable for the post within the prescribed period then he/she shall be liable to be terminated from service without prior notice. 13. A candidate selected for the post mentioned in rule 3 to 10 shall, if so required, be liable to serve under the defence service of India or post connected therewith anywhere in India or abroad for a period not less than 4 years including the period spend on training, if any on such condition as may be determined by Government of India, provided that such a person, (a) shall not be required to serve as aforesaid after the expiry of 10 years from the date of his appointment; (b) shall not ordinarily be required to serve as aforesaid after the age of 40 years. 14. A person appointed to any of the posts, whether by promotion or nomination, in accordance with these rules shall be required to pass the examinations in Hindi and Marathi according to the rules made in that behalf unless he has already passed or has been exempted from passing those examinations. 15. Persons appointed to any of the post mentioned in rule 3 to 10 shall possess a certificate in computer operation prescribed by the Directorate of Information Technology, Government of Maharashtra from time to time. 16. A person appointed to any of the posts, shall be liable to transfer anywhere in the State of Maharashtra. Schedule-A Educational qualifications for various posts in Maharashtra
